The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on November 15, 1976. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Dowie, Getty, Lichty, Roehr and Wilharm. Ab-
sent: Geiger. Councilman Getty in behalf of the Mayor and Council, extended
deepest sympathy to Councilman Geiger and Family in the loss of his Mother.
Invocation by Councilman Getty.
71013 - Moved by Roehr, seconded by Getty that the Agenda, as proposed, for
the Regular Session of November 15, 1976 at 7:00 P.M., be accepted
and approved. Motion carried.
71014 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular
Session held November 8, 1976 at 7:00 P.M., be approved. Motion car-
ried.
71015 - Mayor Rooff recognized four Student Nurses from Allen Hospital and
the Salvation Army Girl Guards with Captain Doty.
71016 - Moved by Dowie, seconded by Getty that proof of publication of notice
of public hearing on proposal to vacate "All of Pett Street not now
vacated and N 62.5' of N -S Alley in Block 3, Prospect Heights Addit-
ion", and to sell and convey to John and Jean Merrick "All that part
of Pett Street lying East of the East line of Chicago Street and
West of the West line of Lot 27 extended; and the North 62.5' of N -S
Alley, all in Block 3, Prospect Heights Addition", as published in
Waterloo Courier on 10/28/76, for $232.50 plus costs, be received
and placed on file. Motion carried.
71017 - The Mayor called for written and oral objections, and there were none.
Moved by Bowers, seconded by Wilharm that "Ordinance vacating All of
Pett Street not now vacated and the North 62.5 feet of the North-
South Alley in Block 3, Prospect Heights Addition", be received,
placed on file, considered and passed for the first time. Ayes: Six.
Absent: Geiger. Motion carried.
71018 - Moved by Roehr, seconded by Dowie that proof of publication of notice
of public hearing on site development plan in parts of Block 6 and
Block 7, Original Plat of Waterloo East for the United States Postal
Service General Mail Facility, upon Plan and Program Commission's
recommendation and Council's own motion, as published in Waterloo
Courier on 10/28/76, be received and placed on file. Motion carried.
71019 - The Mayor called for oral and written objections and there were none.
Moved by Getty, seconded by Wilharm that "Resolution approving site
development plan in parts of Block 6 and Block 7, Original Plat of
Waterloo East for United States Postal Service General Mail Facility",
be adopted. Ayes: Six. Absent: Geiger. Resolution adopted and
upon approval by Mayor, assigned No. 24855.
71020 - Moved by Dowie, seconded by Bowers that proof of publication of notice
of public hearing on site plan at the Northerly Corner of Sears Street
and Crossroads Boulevard, upon application of Marc's Big Boy, upon
Plan and Program Commission's recommendation subject to certain pro-
visions, and Council's own motion, as published in Waterloo Courier
on 10/28/76, be received and placed on file. Motion carried.
71021 - The Mayor called for oral and written objections and the Clerk report-
ed no written objections had been filed.
Plan and Program Director Franke opposed a certain future Median Cut
"B" as the type of future development was unkown and once the Council
had approved the future openings it could not take them away.
Fred Debe spoke in support of a certain future Median Cut "B", stating
one opening on the curve would be closed and two other openings con-
structed.
Moved by WilhaLm, seconded by Dowie that "Resolution approving site
plan for Marc's Big Boy at the Northerly Corner of Sears Street and
Crossroads Boulevard and City to receive 40' easement parallel to
Crossroads Boulevard", be adopted. Ayes: Six. Absent: Geiger.
Resolution adopted and upon approval by Mayor, assigned No. 24856.

71022 - Mr. and Mrs. Ernest Fike, 1703 Dearborn Avenue, asked where the mobile
homes in Maywood Addition were going. Mayor Rooff reported the Build-
ing Official, Housing Inspector, etc. were at the point of asking that
a mobile home court be developed, that Plan and Program Director Franke
would work with them, and if a request for a mobile home court was
not made, then they would be out. Discussed was the amount of land
required, need for water and sewer, non -conforming use originally
grandfathered in no longer applied due to replacement of original
mobile homes.
71023 - Moved by Roehr, seconded by Bowers that request from John G. Miller
Construction Co, for permission to construct one 20' commercial curb
cut and close an unused approach, for Wonder Bakery at 325 Commercial
Street, as shown on attached plat, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received,
placed on file, recommendations approved and permission granted in
accordance therewith. Motion carried.

71026 - Moved by Dowie, seconded by Bowers that construction plans for sani-
tary sewerage facilities serving Tract C, Southbrooke Addition, to-
gether with Treatment Agreement Form C 9/75 for Department of Environ-
mental Quality, and City Engineer's recommendation for approval with
final acceptance of plans to be reviewed and accepted by said De-
partment, be received, placed on file, recouuuendations approved and
Mayor and Clerk authorized to execute said Agreement Form. Motion
carried.
71027 - Moved by Wilharm, seconded by Roehr that "An Ordinance amending Ordin-
ance No. 2644 known as the Traffic Ordinance by adding Subsection
(90b) Sixth Street (West) to Section 543 Thru Streets and repealing
Subsection (104) Western Avenue in its entirety and enacting in lieu
thereof new Subsection Western Avenue to said Section 543", be re-
ceived, placed on file, considered and the rules requiring ordinances
to be voted on at two prior meetings, be suspended, the above Ordin-
ance recorded as having been considered and passed for the second and
third times, and now placed on its final adoption. Ayes: Six. Ab-
sent: Geiger. Motion carried.
71028 - Moved by Roehr, seconded by Wilharm that "An Ordinance amending Or-
dinance No. 2644 known as the Traffic Ordinance by adding Subsection
(90b) Sixth Street (West) to Section 543 Thru Streets and repealing

71029 - Moved by Getty, seconded by Wilharm that communication from Couuuunity
Development Administrator, transmitting proposed resolution for City
acceptance of responsibilities of operation and maintenance of Stage
VA of Local Flood Protection Project from the Municipal Stadium
upstream to WCF & N Drive on east side, and recommending approval,
be received, placed on file and "A resolution authorizing the Mayor
to accept on behalf of the City of Waterloo effective November 24,
1976, the assumption of operation and maintenance responsibilities
for the flood protection devices constructed as Stage VA of the Corps
of Engineers Local Flood Control Project", adopted. Ayes: Six.

71030 - Moved by Roehr, seconded by Getty that communication from Waterloo
Water Works General Manager, transmitting proposed Calendar 1977
Budget for the twelve months of January 1, 1977 through December
31, 1977, be received, placed on file, and the Council having duly
considered said Budget and being fully advised, finds that hearing
date should be fixed and does hereby set December 6, 1976 at 7:00 P.M.
in the Council Chambers, City Hall in said City, as the date, time
and place for said hearing, and the City Clerk is hereby instructed
to publish the Estimate and Notice of Hearing, which is worded and
figures as follows: (See attached page #4) Ayes: Six. Absent:

71031 - Moved by Wilharm, seconded by Roehr that Brice, Petrides & Associates,
Inc. be instructed to prepare the specifications, form of contract,
form of proposal, plans, estimate of cost, etc. for the Virden Creek
Cunette Repairs, Contract No. 96. Motion carried.
71032 - Moved by Dowie, seconded by Bowers that Contract documents for Virden
Creek Cunette Repairs, Contract No. 96, as submitted by Brice, Pet-
rides & Associates, Inc., Engineers, and the City Engineer's recom-
mendation for approval, be received, placed on file and "Resolution
preliminarily approving the specifications, plans, form of contract
and bond, estimate of cost, etc. for the Virden Creek Cunette Re-
pairs, Contract No. 96", adopted. Ayes: Six. Absent: Geiger.

71033 - Moved by Wilharm, seconded by Roehr that the City Clerk be instructed
to publish the Notice of Public Hearing on plans and specifications

of bids, said date being set as December 6, 1976 at 7:00 P.M. Motion

Chief, reporting retirement of Herbert E. Claus, Jr. as of 10/31/76
and entitlement to 5062 hours sick leave and five weeks vacation pay,

71038 — Fedon Petrides of Brice, Petrides & Associates, Inc. orally reported
the studies have been completed on flood control alternatives for
the Dry Run Creek basin and the most feasible solution was found
to be a series of three temporary flood water detention basins
located (1) south of proposed Freeway 520, (2) Bontrager Park, and
(3) Liberty Park. He stated the areas to be used for flood water
detention would be lowered but would remain dry except during large
floods; during the 100 year and other large floods, water would be
temporarily stored in the detention basins and released by gravity
after flooding had subsided. He said the preliminary construction
cost estimate for the detention basins was $4,8 M and this cost would
be reduced by approximately $2.0 M if the Corps of Engineers and
Department of Transportation used the detention areas as borrow
site for future projects and excavated the required dirt fill from
them. Slides were shown for existing land use and future land use.
