November 8, 1976,; Waterloo, Iowa, met in Regular Session in Council Cham - :00 P.M. on November 8, 1976. Mayor Rooff in the Chair. Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wil - Invocation by Councilman Geiger. 70986 Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of November 8, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 70987 Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session November 1, 1976 at 7:00 P.M., be approved. Motion carried. 70988 Moved by Wilharm, seconded by Getty that request from Roger Neebel Construction Company for permission to construct a temporary concrete driveway at 1705 Pinehurst Lane without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recom- mendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permis- sion to Roger Neebel Construction Company and authorizing construct- ion of a temporary concrete driveway at 1705 Pinehurst Lane, irres- pective of a later official grade", adopted. Ayes: Seven. Motion carried. 70990 - Moved by Bowers, seconded by Dowie that construction plans for storm sewer and concrete paving facilities serving the Southdale Addition, (Phase II), and City Engineer's recommendation for approval, be re- ceived, placed on file and approved. Motion carried. 70991 Moved by Wilharm, seconded by Roehr that Change Order No. 1 for East Park Avenue Area Street Improvements, Sewers and Incidentals, Contract No. 159, for decrease in cost of $33,840.00 as work will be done by Corps of Engineers, and Community Development Administrator's recommendation for approval, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Ayes: Seven. Mo- tion carried. 70992 - Moved by Getty, seconded by Wilharm that Change Order No. 1 for Falls Avenue Area Street Improvements, Sewers & Incidentals, Phase II, Con- tract No. 158, for decrease in cost of $170.89 reflected by differ- ences in quantities, additional work, etc., and Community Development Administrator's recommendation for approval, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Ayes: Seven. Motion car- ried. 70995 Moved by Roehr, seconded by Lichty that the rules reouiring ordinances to be received, placed on file, considered and voted on at two prior - 2 70995 - (Continued) meetings, be suspended, the above Ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Motion carried. 70996 - Moved by Wilharm, seconded by Roehr that "An Ordinance amending Ordin- ance No. 2644 known as the Traffic Ordinance by adding Section 569, Reserved Parking - Handicapped Only", be adopted. Ordinance adopted and upon approval by Mayor, assigned No. 2854. 70997 - Moved by Dowie, seconded by Bowers that "An Ordinance amending Ordin- ance No. 2644 known as the Traffic Ordinance by adding Subsection (90b) Sixth Street (West) to Section 543 Thru Streets and repealing Subsection (104) Western Avenue in its entirety and enacting in lieu thereof new Subsection (104) Western Avenue to said Section 543", be received, placed on file, considered and passed for the first time. Resolution adopted and upon approval by Mayor, assigned No. 24849. 70999 - Moved by Getty, seconded by Wilharm that Final Pay Estimate of Brice, Petrides & Associates, Inc., Engineers, for Contract No. 153, and Coumiunity Development Board request for approval and payment, be received, placed on file and "Resolution approving the Final Pay Estimate Report as to work and materials furnished by Cedar Falls Construction Company for Construction of Chautauqua Park Area Paving, Sewers & Incidentals, Stage I, Contract No. 153, and authorizing and certifying payment accordingly", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24850. 71000 - Moved by Wilharm, seconded by Roehr that Completion Report of City Engineer as to work and materials furnished by U & I Construction, Inc. for Contract No. 43, together with recommendation of approval, be received, placed on file and "Resolution approving the Complet- ion Report, accepting the work and ordering preparation of plat and schedule of assessments for the 1976 Sidewalk Repair Program, Con- tract No. 43, and authorizing payment in full to the Contractors", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24851. 71001 - Moved by Wilharm, seconded by Getty that the City Engineer's Com- pletion Report together with Certificate of Completion and Recom- mendation of Acceptance for Contract No. 177, and recommendation for approval, be received, placed on file and "Resolution approving the Certificate of Completion and Recommendation of Acceptance, and the Completion Report as to work and materials furnished by Gjellefald Constructors, Inc., for the Orange Township Sanitary Sewer Outfall, Contract No. 177, accepting the work and authorizing payment accord- ingly", adopted. November 8, 1976 - 3 - 71005 Moved by Dowie, seconded by Geiger that the following requests for permission to attend functions with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Fire Captain to National Fire Protection Association Fall Conference, Cincinnati, Ohio, November 13 thru 19, 1976, $250.00; Fire Chief to Fall Workshop Paid Fire Chiefs of Iowa, Ames, Iowa, November 9 and 10, 1976, $37.50 plus use of City car; Two Engineering Senior Inspectors to Annual Fall Meeting of Iowa Chapter of American. Ridgeway Ave. Sunday Sales - Beer & Liquor - Class C Charcoal Inn, Inc., 360 E. Ridgeway Ave. Motion carried. 71010 - The Council asked when the District Court would hear and render a decision on the Corner Pocket Billiard Lounge Beer Permit appeal and City Attorney Smith said he doubted if it would be much before the first of the year. Discussed was whether the approval of the Beer and Liquor License application would nullify the Beer Permit and the court case. Robert Borgeson spoke in support of his application and Mayor Rooff stated the Council also had an obligation to listen to the people. Moved by Roehr, seconded by Wilharm that the following applications for Beer and Liquor Licenses be received, placed on file and action deferred for thirty days: Class C Billiards Pocket Lounge, Inc. dba Corner Pocket Billiard Lounge 3295 University Avenue Sunday Sales - Beer and Liquor - Class C Billiards Pocket Lounge, Inc. dba Corner Pocket Billiard Lounge 3295 University Avenue Ayes: Bowers, Geiger, Roehr and Wilharm. Nays: Dowie, Getty and Lichty. Motion carried. 71011 - Moved by Bowers, seconded by Getty that report of City Attorney and list of bonds filed with Clerk through 11/8/76, be received, placed on file, and report and bonds as listed, approved.
