Invocation by November 1, 1976 Waterloo, Iowa, met in Regular Session in Council Cham - :00 P.M. on November 1, 1976. Mayor Rooff in the Chair. Bowers, Dowie, Geiger, Getty, Roehr, Wilharm. Absent: Councilman Bowers. 70959 - Moved by Dowie, seconded by Bowers that the Agenda, as amended, for the Regular Session of November 1, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 70960 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held October 25, 1976 at 7:00 P.M., be approved. Motion car- ried. 70961 - Moved by Roehr, seconded by Dowie that proof of publication of notice of public hearing to sell Disposal Parcel No. H-10 in Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 409 Bluff Street, as publish- ed in Waterloo Courier on 9/30/76, to Young Plumbing & Heating Co., be received and placed on file. Motion carried. 70962 - The Mayor called for oral and written objections, and there were none. Moved by Getty, seconded by Wilharm that "A resolution approving the sale of Disposal Parcel No. H-10 in the Westfield -Virden Urban Renew- al Area, Project No. Iowa R-7, and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed", be adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24838. 70963 - Mayor Rooff recognized Webelo Scout Pack 1, Den 1, of Irving School and Scout Master Jim Lawrence. 70964 - Mayor Rooff presented to Dale Mercer the National Association of Housing Redevelopment official plaque from the members of the Board of Directors for his work in this organization. 70965 - Moved by Roehr, seconded by Wilharm that request of Don Cox, holder of option to purchase Florence Marquis, et al estate, for Council on its own motion to rezone from "R-2" One and Two Family Residence District to "R-3" Multiple Residence District a part of Section 21- 89N -13W, on south side of University Avenue frontage road between Alabar Avenue and Bel -Air Motel, as shown on attached plat and legally described in attached Exhibit "A", and City Zoning Commission's recom- mendation for approval, be received, placed on file, recommendations approved, date of hearing set as November 22, 1976 at 7:00 P.M. and Clerk instructed to publish notice. Motion carried. 70966 - Moved by Wilharm, seconded by Getty that communication from Black Hawk County Board of Supervisors, advising Lot 42, Maywood Third Addition, was sold at public auction. on 9/25/75 to Harriet R. Hutchins with the City of Waterloo receiving $590.14 in proceeds, and request- ing the City to waive special weed assessment of $44.75, be received, placed on file and said weed assessment waived. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24839. 70967 - Moved by Dowie, seconded by Wilharm that the communication from the Asst. City Attorney, stating his opinion and calling to the Council's attention the far reaching effects of their action on the Westbourne Terrace Third Addition, and requesting consideration af this time, be received, placed on file, and construction plans and revised con- struction plans for sanitary sewerage facilities, storm sewer and con- crete paving serving Westbourne Terrace Third Addition, together with Treatment Agreement Form C 9/76 for Department of Environmental Qual- ity, approved with final acceptance of plans to be reviewed by said Department and Mayor and Clerk authorized to execute said Agreement Foim. Motion carried. 70968 - Moved by Roehr, seconded by Getty that communication from Sign and Traffic Maintenance Department, reporting on traffic study around Washington Irving School, as requested by Mrs. Tom Gorton of said school's PTA, and recommending that the "yield" signs on West Sixth 70968 - (Continued) Street from Williston Avenue to Mitchell Avenue be changed to "stop" signs and that "stop" signs be installed on Western Avenue from Bertch Avenue to Eureka Street, be received, placed on file, recom- mendations approved and City Attorney instructed to submit an ordin- ance accordingly. Motion carried, 70969 - Moved by Roehr, seconded by Geiger that couuuunication from Sign and Traffic Maintenance Department, reporting traffic survey on request of Gladys Sharar and Carol Adams for pedestrian controlled push buttons signals at intersection of Falls Avenue and Ansborough Avenue, (see Council Action #70931 of 10/25/76), and recommending approval, be received, placed on file, approved and City Electrician instructed to proceed with obtaining estimate of costs, etc. and report back to the council on November 15, 1976. Motion carried. 70970 - Moved by Getty, seconded by Geiger that communication from City Engineer, reporting the sanitary sewer serving the Neil Miller property has been completed in accordance with plans and specifications, and recommending approval as an extension to the Municipal System and maintained as a "public sanitary sewer", be received, placed on file, approved and accepted. Motion carried. 70971 - Mayor Rooff explained that the subdivision of South Acres Second Addition now has some asphalt paving built to county specifications, the city ordinance calls for concrete, and recommended that the sub- divider be permitted to continue with asphalt paving. Plan and Program Director Franke stated the Commission recommended denial so as to not set a precedent but also recommended consideration of waiving certain requirements. Discussed was, this subdivision being caught between county and city ordinances, county requirement of three acres for one house, if City waived requirements and in some future time annexed the area the City would have a problem with storm and sanitary sewers, cul de sac streets, etc. Moved by Bowers, seconded by Dowie that Preliminary Plat of South Acres. Second Addition with City Engineer's report recouunending denial, Deed of Dedication, and City Plan and Program Commission's resolution of denial and their recommendation for Council denial or consideration of waiving certain requirements of the subdivision ordinance, be received, placed on file, objections overruled, and "A resolution ap- proving the Preliminary Plat of South Acres Second Addition", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24840. 70972 — Moved by Wilharm, seconded by Roehr that Final Plat of Southland Park Replat of part of Southland Park Subdivision, with Engineer's Certifi- cate of Survey, Deed of Dedication, Report of City Engineer, City Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "A resolution ap- proving the Final Plat of Southland Park Replat of Part of Southland Park Subdivision", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24841. 70973 - Moved by Roehr, seconded by Wilharm that communication from City En- gineer, transmitting three "Applications for Sidewalk Paving and Waiver of All Legal Proceedings Relative Thereto:" with work and assessment to be done in conjunction with 1976 Sidewalk Repair Program, Contract No. 43, be received, placed on file, and "Resolution accepting and approv- ing Applications for Sidewalk Paving and Waiver of All Legal Proceed- ings Relative Thereto from Lonnie L. Barker and Pamela J. Barker, Buster Redd and Lydia Redd, and Cuba E. Tredwell Jr. and Marguerite Tredwell", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24842. 70974 - Moved by Dowie, seconded by Bowers that Construction Permit No. 77-44- S for Sanitary Sewer Extension for Parkridge Addition and Construction November 1, 1976 70974 - (Continued) Permit No. 77-52-5 for Sanitary Sewer Extension for Bronson Addition from the Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received,and placed on file. Motion carried. 70975 - Moved by Roehr, seconded by Getty that the contract and Bond for Con- tract No. 159 in the amount of $805,607.85, be received, placed on file and "Resolution approving the Contract and Bond of Cedar Valley Corporation for East Park Avenue Area, Westfield -Virden Urban Renewal Project R-7, street improvements, sewers and incidentals, Contract No. 159", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24843. 70976 - Moved by Wilharm, seconded by Bowers that communication from Community Development Administrator, transmitting an offer of sale to the City of Waterloo from Iowa Public Service Co. of Parcel No. 73+50, North- west corner of Vacated River Street and 17th Street, Lots 1 and 2, Block 22, Hayes Addition, for amount of $200.00 for Phase IIID, Flood Control Project, and recommending approval, be received, placed on file and "A resolution accepting and approving certain offer to sell real property to the City and accepting and approving certain deeds", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24844. 70977 - Moved by Dowie, seconded by Geiger that communication from Community Development Administrator, transmitting Change Order No. 3 adjusting final quantities at a decrease of costs of $13,166.30 and Certificate of Completion and Recommendation for Acceptance for the Chautauqua Park Area Paving, Sewers and Incidentals, Stage I, Contract No. 153, and recommending approval and acceptance, be received, placed on file, approved, Mayor and Clerk authorized to execute said Change Order No. 3, and "Resolution approving and accepting the Certificate of Comple- tion and Recommendation for Acceptance for Chautauqua Park Area Pav- ing, Sewers and Incidentals, Stage I, Contract No. 153, and accepting the work", adopted. Resolution adopted and upon approval by Mayor, assigned No. 24845. 70978 - Moved by Getty, seconded by Roehr that "An Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance, by repealing Subsection (216) Park Lane, of Section 551, Parking Prohibited At All Times on Certain Streets, and enacting in lieu thereof new Subsection (216) Park Lane, and also by adding Subsections (9a) Anthony Street, (18a) North Barclay Street, (52a) Cottage Street, (69b) Edgewood Drive, (94a) Fleur Drive, (133a) Ingersoll Road, (197a) Monterey Drive, (210a) Onawa Drive, (255a) Shilliam Avenue, (259a) Southview Drive, (280a) Valdez Drive, and (303a) Wren Road, to Section 551", be received, placed on file, considered and the rules requiring ordinances to be received, and placed on file at two prior meetings, suspended, the above Ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption.
