The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on December 20, 1976. Mayor Rooff in the Chair.
On•roll scall, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wil -
harm. Absent: None. Invocation by Councilman Geiger.
71178 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed,
for the Regular Session of December 20, 1976 at 7:00 P.M., be accept-
ed and approved. Motion carried.
71179 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular
Session held December 13, 1976 at 7:00 P.M., be approved. Motion
carried.
71180 - Dick McCalley, 1317 Hawthorne Avenue, thanked the Mayor and Council
for the fine job they were doing and for the help on the paving of
Hawthorne Avenue but questioned why on the east side and on 9th Street
the grading, etc. was done by contractor but he had to do his own
work and others would like their yards finished.
City Engineer Radue said there was no item for grading in the contract,
and what was done on grading must have been at contractor's cost. Mayor
Rooff said he would check into this.
Mr. McCalley asked for a stop light in the morning and afternoon at
Duryea Street and Westfield Avenue. Councilman Roehr said the City
Electrician had this in his budget but waiting for the street to be
put in.
71181 - Dewayne Filers formally requested (1) an amendment to the housing
ordinance requiring all complaints on interiors of buildings be
written and signed and (2) the salary for council members be increased
to $5,000 per year, stating this would not be out of line as the
County Board of Supervisors had just voted themselves a salary of
$12,500, and the Council was deserving of an increase. Mayor Rooff
stated some research has been made and this would be given considera-
tion, with an answer after the first of the year.
Moved by Wilhasm, seconded by Roehr that the two above requests be
received and placed on file. Motion carried.
71182 - Robert J. Molinaro, President of Warren Transport, Inc. read a letter.
to clarify the purchase of Disposal Parcel No. F -6C in the Westfield -
Virden Urban Renewal Project Iowa No. R-7, for $90,000; the firm's
willingness to sell said Parcel back to the City for what they paid;
and resented implications the property was bought at an advantageous
price. A discussion followed on cost of improvements, various loca-
tions of the firm, etc. Mayor Rooff commented the City did not want
to purchase the property back.
Moved by Wilharm, seconded by Bowers that the above letter be received
and placed on file. Motion carried.
71183 - Agnes Robertson, 1030 Roosevelt Street, supported Dewayne Eilers
requests for a Housing Ordinance Amendment and a salary increase
for Council Members.
71184 - Councilman Getty asked that Quintin Parker make a study on the
feasibility to alternate "no parking" on some streets from one side
to the other on even and odd days.
Moved by Getty, seconded by Lichty that the above request be received,
placed on file and Quintin Parker be instructed to make the study.
Motion carried.
71185 - Moved by Dowie, seconded by Getty that the offer of Henry Zander to
purchase Disposal Parcel No. H-6 in Westfield -Virden Urban Renewal
Area, Project No. Iowa R-7, 208 Jefferson Street, for the sum of
$8,800.00 for a hard surfaced parking area purpose, and approval
report of Community Development Board, be received, placed on file,
"A resolution authorizing the sale of Disposal Parcel No. H-6 in the
Westfield -Virden Urban Renewal Area, Project No. Iowa R-7", adopted
and hearing set for January 24, 1977 at 7:00 P.M. in Council Chambers`
in City Hall. Ayes: Seven. Resolution adopted and upon approval
by Mayor, assigned No. 24903.

- Moved by Roehr, seconded by Lichty that City Engineer's progress re-
port on the status of addresses being placed on Mobile Homes in the
Mobile Home Parks and recommendation that renewal Mobile Home Park
license applications not be approved until full compliance with
Ordinance No. 2808 has been met, be received, placed on file and
recommendation approved. Motion carried.
71187 - Moved by Bowers, seconded by Wilhelm that the communication from
Secretary of Agriculture Lounsberry, transmitting a revised Appli-
cation and Agreement For Authority to Conduct Milk Inspections for
the City of Waterloo, Iowa, be received, placed on file and "Resolu-
tion approving the Application and Agreement For Authority to Con-
duct Milk Inspections and authorizing the Mayor to sign same in
behalf of the City of Waterloo", adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 24904.
71188 - Moved by Roehr, seconded by Dowie that communication from Community
Development Board transmitting a Flowage Easement Agreement dated
12/6/76 with J.W. Dankenbring and Mildred Dankenbring, and recom-
mending approval, be received, placed on file and "A resolution
authorizing the execution of a Flowage Easement Agreement with J.W.
Dankenbring and Mildred Dankenbring in connection with the Virden
Creek Flood Control Project", adopted. Ayes: Bowers, Dowie, Geiger,
Getty, Roehr and Wilharm. Nay: Lichty. Resolution adopted and
upon approval by Mayor, assigned No. 24905.
71189 - Moved by Roehr, seconded by Bowers that communication from Commun-
ity Development Board transmitting a Flowage Easement Agreement
dated 12/6/76 with Edward Hoffer, and recommending approval, be
received, placed on file and "A resolution authorizing the execution
of a Flowage Easement Agreement with Edward Hoffer in connection with
the Virden Creek Flood Control Project", adopted. Ayes: Bowers,
Dowie, Geiger, Getty, Roehr and Wilharm. Nay: Lichty. Resolution
adopted and upon approval by Mayor, assigned No. 24906.
71190 - Moved by Bowers, seconded by Dowie that communication from Community
Development Board transmitting a Flowage Easement Agreement dated
12/16/76 with Albert J. Hoffer, and recommending approval, be re-
ceived, placed on file and "A resolution authorizing the execution
of a Flowage Easement Agreement with Albert J. Hoffer in connection
with the Virden Creek Flood Control Project", adopted. Ayes: Bowers,
Dowie, Geiger, Getty, Roehr and Wilhatm. Nay: Lichty. Resolution
adopted and uponapproval by Mayor, assigned No. 24907.
71191 - Moved by Dowie, seconded by Bowers that construction Permit No. 77-
141-S for Sanitary Sewer Extension for Southbrooke Addition, Tract
C, from the Iowa Department of Environmental Quality, subject to
certain conditions and requirements, be received and placed on file.
Motion carried.
71192 - Moved by Getty, seconded by Bowers that "An Ordinance amending
Ordinance No. 2479, as amended, by adding Sub -Section No. 106 to
Section 2A-5, rezoning certain property", be received, placed on file,
considered and the rules requiring ordinances to be received and
placed on file at two prior meetings, suspended, the above Ordinance
recorded as having been considered and passed for the second and
third times, and now placed on its final adoption. Ayes: Seven.
Motion carried.
71193 - Moved by Wilharm, seconded by Roehr that "An Ordinance amending
Ordinance No. 2479, as amended, by adding Sub -Section No. 106 to
Section 2A-5 , rezoning certain property", be adopted. Ayes: Seven.
Ordinance adopted and upon approval by Mayor, assigned No. 2858.
71194 - Moved by Roehr, seconded by Getty that "An Ordinance amending Ordin-
ance No. 2479, as amended, by adding Sub -Section No. 107 to Section
2A-5, rezoning certain property", be received, placed on file, con-
sidered and the rules requiring ordinances to be received and
placed on file at two prior meetings, suspended, the above Ordinance
recorded as having been considered and passed for the second and
third times, and now placed on its final adoption. Ayes: Seven.

71196 - Moved by Getty, seconded by Wilharm that "An Ordinance amending Or-
dinance No. 2479, as amended, by adding Sub -Section No. 108 to
Section 2A-5, rezoning certain property", be received, placed on
file, considered and the rules requiring ordinances to be received
and placed on file at two prior meetings, suspended, the above Or-
dinance recorded as having been considered and passed for the
second and third times, and now placed on its final adoption. Ayes:

71197 - Moved by Wilharm, seconded by Lichty that "An Ordinance amending
Ordinance No. 2479, as amended, by adding Sub -Section No. 108 to
Section 2A-5, rezoning certain property", be adopted. Ayes: Seven.
Ordinance adopted and upon approval by Mayor, assigned No. 2860.
71198 - Moved by Getty, seconded by Roehr that communication from Building
Official, reporting it is the policy of H.U.D. to review and re-
vise Tenant Admission Schedules, transmitting a proposed resolution
increasing the minimum requirements for Section 23 Housing Program
and Turnkey Elderly Project, and recommending approval, be received,
placed on file and "A resolution of the Waterloo City Council ap-
proving revised initial income limit schedule for tenant admission
to Low -Rent Public Housing as found in the statement of policy
approved under City Council Resolution No. 24471 of March 1, 1976",
adopted. Ayes: Bowers, Dowie, Geiger, Getty, Lichty, Roehr. Nay:
Wilharm. Resolution adopted and upon approval by Mayor, assigned
No. 24908.
71199 - Moved by Roehr, seconded by Getty that communication from Building
Official, transmitting Final Pay Estimate #1 together with Certifi-
cate of Completion and Recommendation of Acceptance from Flinn
Saito Andersen, Architects, for Rennovation of Roof and Penthouse
on City Hall, and recommending approval, be received, placed on file
and "Resolution approving and accepting the Certificate of Completion
and Recommendation of Acceptance, and the Final Pay Estimate #1 as
to work and materials furnished by John G. Miller Construction Co.
for the Rennovation of Roof and Penthouse, accepting the work and
authorizing payment accordingly", adopted. Ayes: Seven. Resolu-
tion adopted and upon approval by Mayor, assigned No. 24909.
71200 - Moved by Dowie, seconded by Lichty that communication from Community
Development Administrator, transmitting the following offer of sale
to the City of Waterloo certain real property for Black Hawk Creek
Greenbelt Project, and recommending acceptance, be received, placed
on file and "A resolution accepting and approving certain offers
to sell real property to the City and accepting and approving certain
deeds", adopted: Parcel No. 1 - Murle Dietz, Sr., 2761 Deere Road
$1,100.00. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 24910.
71201 - Moved by Geiger, seconded by Bowers that conuuunication from Mayor
Rooff, submitting for Council approval the appointment of Daniel
J. Langan, 216 Southcrest Drive, to the Waterloo Plumbing Examining
Board, be received, placed on file and approved. Motion carried.
71202 - Moved by Lichty, seconded by Geiger that the following request for
permission to attend function, with expenses allowed not to exceed
amount shown, be received, placed on file and approved: Building
Official to Annual Seminar, Iowa. Chapter. International Conference
of Building Officials, Sioux City, Iowa, January 25 thru 28, 1977,
$261.00. Ayes: Seven. Motion carried,
71203 - Moved by Geiger, seconded by Bowers that the following applications
for taxicab driver's permits, be received, placed on file and granted:

71205 - Moved by Geiger, seconded by Bowers that report of City Attorney
and list of bonds filed with Clerk through 12/20/76, be received,
placed on file, and report and bonds as listed, approved. Motion
carried.
71206 - Mayor Rooff stated the Attorney General had given an oral opinion
that the Ellis Hotel to be operated as a correctional facility
would not have to meet Waterloo city building requirements as
long as it met the State code. The Mayor commented "It will not
be the first time the Attorney General has been wrong, we'll see
them in court".
71207 - Moved by Bowers, seconded by Geiger that the Council adjourn.
