The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on December 13, 1976. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr,
and Wilharm. Absent: None. Invocation by Councilman Getty.
71142 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for
the Regular Session of December 13, 1976 at 7:00 P.M., be accepted
and approved. Motion carried.
71143 - Moved by Wilharm, seconded by Dowie that the minutes of the Regular
Session held on December 6, 1976 at 7:00 P.M., be corrected as follows
and approved:
Council Action 71139 - under Beer and Liquor License - Class C
add The Stable, Inc., 2022 Bopp Street
Motion carried.
71144 - Moved by Dowie, seconded by Bowers that proof of publication of no-
tice of public hearing on rezoning, upon request of Fred Debe for
Charles Granger and NoLiva Joy George Luitjen, upon recommendation
of Zoning Commission and Council's own motion, to rezone from "A -l"
Agricultural District to "R-1" and "R-2" One and Two Family Residence
Districts and "R-3" Multiple Residence District a part of Section
4-88-13 and all that part of vacated Margaret Street lying Southerly
of Lot 13, Guernsey Addition, located west of Kimball Avenue and
Rachael Street, as published in Waterloo Courier on 11/26/76, be
received and placed on file. Motion carried.
71145 - The Mayor called for oral and written objections and there were none.
Moved by Roehr, seconded by Lichty that "An Ordinance amending
Ordinance No. 2479, as amended, by adding Sub -Section No. 108 to
Section 2A-5, rezoning certain property", be received, placed on
file, considered and passed for the first time. Ayes: Seven. Motion
carried.
71146 - Moved by Roehr, seconded by Lichty that proof of publication of no-
tice of public hearing on rezoning, upon request of Fred Debe for
Black Hawk Development Corporation and Pearl Smith, upon recommenda-
tion of Zoning Commission and Council's own motion, to rezone from
"A-1" Agricultural District to "R-2" One and Two Family Residence
District and "R-4" Multiple Residence District a part of Section
3-88-13 located South of Columbus High between Hammond Avenue and
Ravenwood Health Care Center, as published in Waterloo Courier on
11/26/76, be received and placed on file. Motion carried.
71147 - The Mayor called for oral and written objections and there were none.
Moved by Dowie, seconded by Wilharm that "An. Ordinance amending Ordin-
ance No. 2479, as amended, by adding Sub -Section No. 107 to Section
2A-5, rezoning certain property", be received, placed on file, con-
sidered and passed for the first time. Ayes: Seven. Motion carried.
71148 - Moved by Bowers, seconded by Roehr that proof of publication of no-
tice of public hearing on rezoning upon request of Anita Andries for
James Woltz, upon recommendation of Zoning CoLmuission and Council's
own motion, to rezone from "A-1" Agricultural District to "R-1" One
and Two Family Residence District a part of Section 12 -89N -13W, an
unplatted tract of land lying North of Ralston Road and on East side
of Logan Avenue, as published in Waterloo Courier on 11/36/76, be
received and placed on file. Motion carried.

71150 - Mayor Rooff recognized Troop 72 of the Central Christian Church,
together with Mr. Schroedermeir, Troop Leader.
71151 - Larry Lehman asked why demolition -per it fees had increased and
Mayor Rooff stated the Uniform Building Code provided a fee of
$35.00 could be charged per building unit and that demolition fees
could be the same and did not need Council action or approval.
71152 - The regular meeting of December 27, 1976 was discussed as City Hall
would be closed and the employees would not be working, and the con-
sensus was there would be a lack of a quorum of Council Members in
attendance on that night.
71153 - Moved by Dowie, seconded by Bowers that communication from Plan and
Program Commission, transmitting an Offer from George D. Scully and
Clayton Bronson to purchase ten platted lots on South side of Lark
Lane East of Wren Road, being part of Lot 101, Huntington Park, be
received, placed on file and "Resolution fixing the time and place
of hearing and receiving of bids as January 3, 1977 at 7:00 P.M. in
Council Chambers of City Hall on the proposal to sell and convey
ten platted lots on South side of Lark Lane East of Wren Road to the
highest bidder", adopted and Clerk instructed to publish notice of
hearing. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 24894.
71154 - Moved by Wilharm, seconded by Roehr that five communications from
Heating Inspector, transmitting following requests for refund of
deposit in connection with heating and/or air conditioning certifi-
cate of competency, as no longer doing this work in the City, and
recommending approval, be received, placed on file and granted:

71155 - Moved by Roehr, seconded by Wilharm that communication from Community
Development Board, transmitting Final Audit Report for Urban Renewal
Project Iowa R-7, and recommending approval, be received, placed on
file and approved. Motion carried.
71156 - Moved by Dowie, seconded by Getty that City Treasurer's Financial
Report for November, 1976, showing Balance on Hand 11/1/76 $14,005,-
746.13, Receipts. $7,073,359.67, Disbursements $6,633,261.56, Balance
on Hand 11/30/76 $14,445,844.24, be received, placed on file and
approved. Motion carried.
71157 - Moved by Roehr, seconded by Wilha m that the 1976 Fiscal Year Finan-
cial Report of the City of Waterloo, Iowa, be received and placed on
file. Motion carried.
71158 - Moved by Dowie, seconded by Bowers that coumiunication from City En-
gineer, reporting the single low bid submitted by Cedar Valley Cor-
poration in the amount of $41,100 for the Virden Creek Cunette Re-
pairs, Contract No. 96, was in excess of estimated cost and recom-
mending said bid be rejected and notice for bids readvertised, be
received, placed on file, recommendations approved, said bid rejected
and City Engineer instructed to proceed in accordance with the recom-
mendations and readvertise. Motion carried.
71159 - Under Council Action #71010 of 11/8/76, action was deferred for thirty
days on Class C Beer and Liquor and Sunday Sales Applications of
Billiards Pocket Lounge, Inc. dba Corner Pocket Billiard Lounge, 3295
University Avenue. City Attorney Smith reported the Attorney General's
Office has not filed the necessary transcript and appeal with the
District Court, the case was just setting there, if the Attorney
General's Office does nothing, the case would be dismissed in favor
of the City. He stated the Pocket Billiard people have been informed
of this situation.

C Beer and Liquor and Sunday Sales Applications of Billiards Pocket
Lounge, Inc. dba Corner Pocket Billiard Lounge, 3295 University
Avenue, be further deferred for thirty days. Ayes: Bowers, Dowie,
Geiger, Getty, Roehr and Wilharm. Nay: Lichty. Motion carried.
71160 - Under Council Action #71120 of 12/6/76 action was deferred on ap-
plication from Waterloo Church of Christ for permission to erect a
new church, together with proposed site plan.
Moved by Roehr, seconded by Wilharm that communication from Plan
and Program Commission, transmitting further site plans and letter
of intent from Waterloo Church of Christ as to future use and willing-
ness to downgrade the zoning to "R-3" Multiple Residence District of
the 9.04 acre tract South of Highway No. 20 and West of Cedar Bend
Street in the vicinity of Greenbrier School, and recommending approval
of application and acceptance of proposed site plan with stipulation
that the waiver of paving the parking lot for two years after occu-
pancy be denied, be received, placed on file, above recommendations
approved subject to the said church entering into a contractual agree-
ment with the City that if the property so develops as proposed now,
no easement would be needed, but if it should develop differently,
the City would be given an easement, and permission granted and said
plan accepted in accordance therewith and the above recommendations,
and the City Attorney instructed to said agreement with provision
that same is binding to subsequent owners. Ayes: Seven. Motion car-
ried.
71161 - Moved by Roehr, seconded by Bowers that Quit Claim Deed dated 11/22/76
from Black Hawk County, Iowa, conveying to City Lot 27, Block 3,
Riverview Addition, be received, placed on file and "Resolution ap-
proving and accepting said Deed", adopted. Ayes: Seven. Resolu-
tion adopted and upon approval by Mayor, assigned No. 24895.
71162 - Moved by Getty, seconded by Roehr that communication from Building
Official, transmitting final statement from Flinn Saito Andersen,
Architects, for 1976 Re -roofing of City Hall, be received, placed on
file and "Resolution approving statement dated 11/30/76 from Flinn
Saito Andersen for services for 1976 Re -roofing of City Hall and
authorizing payment accordingly", adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 24896.
71163 - Moved by Roehr, seconded by Dowie that final engineering statement
from Brice, Petrides & Associates, Inc. for Contract No. 153, and
Community Development Board request for approval and payment, be
received, placed on file and "Resolution approving statement dated
11/26/76 from Brice, Petrides & Associates, Inc. for engineering
services for Chautauqua Park Area Paving, Sewers and Incidentals,
Stage I, Contract No. 153, and authorizing and certifying payment
accordingly", adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor, assigned No. 24897.
71164 - Moved by Roehr, seconded by Bowers that Estimate #3 Report for Con-
tract No. 158, with Community Development Board's recommendation
for approval, be received, placed on file and "Resolution approving
Report for work and materials furnished by Cedar Falls Construction
Company, Inc. for Falls Avenue Area Street Improvements, Sewers and
Incidentals, Contract No. 158, and certifying payment accordingly",
adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 24898.
71165 - Moved by Dowie, seconded by Lichty that Estimate #1 Report for
Bridge Contract No. 11, with Community Development Board's recommenda-
tion for approval, be received, placed on file and "Resolution ap-
proving Report for work and materials furnished by Lunda Construct-
ion Company for Demolition and Reconstruction of Sans Souci Bridges,
Westfield -Virden Urban Renewal Project Iowa R-7, Bridge Contract No.
11, and certifying payment accordingly", adopted. Ayes: Seven.

71168 - Moved by Geiger, seconded by Bowers that recommendations from Electric-
al Inspector that the following street lights be installed, be re-
ceived, placed on file, approved and "Resolution ordering installa-
tion of certain street lights", adopted:

71169 - Mayor Rooff reported that on Deere Road and Ridgeway Avenue, the
Iowa Public Service Company would install the poles Saturday, subject
to weather conditions, and by Tuesday or Wednesday of next week the
lights would be in operation.
71170 - Moved by Roehr, seconded by Bowers that the following requests for
permission to attend functions, with expenses allowed not to exceed
amount shown, be received, placed on file and approved; Finance Dir-
ector and Personnel Assistant to Revenue Sharing and Anti -Recession
Fiscal Aid Programs, Chicago, Illinois, January 21, 1977, $120.00
each. Ayes: Seven. Motion carried.
71171 - Moved by Bowers, seconded by Geiger that the following application
for a Beer Permit, be received, placed on file, approved and the

71172 - Moved by Bowers, seconded by Geiger that the following Class "B" and

71174 - Moved by Geiger, seconded by Getty that the application and fee of
Danita R. Rouzer, 212 Columbia Street, for Massage Technician Permit,
be received, placed on file and granted subject to the requirements
of ordinance governing same. Motion carried.
71175 - Moved by Geiger, seconded by Lichty that The Hartford Insurance Group
Combination Policy No. 91NG322377 for period 11/10/76 to 11/10/77 to
Waterloo Yellow Cab Co. Inc., 711 Commercial Street, be received,
placed on file and approved. Motion carried.
71176 - Moved by Bowers, seconded by Geiger that report of City Attorney and
list of bonds filed with Clerk through 12/13/76, be received, placed
on file, and report and bonds as listed, approved. Motion carried.
