Members present: Morrissey, Powers, Lind, Amos, Schmitt, and Welper.
Absent: Jacobs
Moved by Welper seconded by Schmitt that the Agenda, as proposed, be approved.
Objective: Update on Sunnyside South
Dave Zellhoefer, City Attorney, provided an overview of the Iowa Supreme Court ruling
regarding whether or not the city was found in contempt of court. The Supreme Court ruled in
the city's favor. He further explained that the court clarified that Sunnyside South, LLC could
not be offered a chance to bid.
Mr. Lind questioned if the city has to include the improvements in the appraisal.
Dave Zellhoefer confirmed.
Mr. Schmitt questioned if Sunnyside South, LLC is allowed to bid.
Dave Zellhoefer explained that Sunnyside South, LLC cannot bid as they were not an original
owner.
Mr. Lind questioned what would happen if no bids are received.
Dave Zellhoefer explained that if no bids are received then it will be up to council to decide who
the property is disposed to.
With no further business before the Council, it was moved by Welper seconded by Schmitt that
the meeting be adjourned at 5:02 p.m. Ayes: Six. Motion carried.
