AMENDMENT TO
SAN MARNAN URBAN RENEWAL AND REDEVELOPMENT PLAN
RECITALS
A. On April 19, 1999, the City Council of the City of Waterloo, Iowa (the "City")
adopted Ordinance No. 4351 and on July 26, 1999 adopted Resolution No. 1999-
499, determining that certain areas located within the City are eligible and should
be designated as an urban renewal area under Iowa law, and approved and
adopted the San Marnan Urban Renewal and Redevelopment Plan of the City of
Waterloo Iowa (the "Plan").
B. On December 13, 2004, the City Council adopted Ordinance 4748 and Resolution
No. 2004-835, in which it was agreed to amend the Plan by extending the property
included therein, and one or more other amendments have been made to the Plan
to include additional urban renewal projects or for other purposes.
C. On September 14, 2009, the City Council adopted Ordinance 4956 and Resolution
No. 2009-912, in which it was agreed to amend the Plan by extending the property
included therein, and one or more other amendments have been made to the Plan
to include additional urban renewal projects or for other purposes.
D. The City desires to amend the Plan again to include new urban renewal projects
and to update related information in the Plan.
AMENDMENT
NOW THEREFORE, the San Marnan Urban Renewal and Redevelopment Plan, as
previously amended, is hereby further amended as follows:

G. Bonding Capacity. For updated information about unused bonding
capacity for the City of Waterloo, see Attachment "C" attached to the
latest Plan amendment.
3. Attachments C and D to the Plan are hereby stricken in their entirety, and the
new Attachments C and D which are attached hereto are substituted in their place so that the
Plan shows current information about bonding capacity and project budgets.
4. The attachments listed below, each of which is attached hereto, are included in
this amendment to show compliance with procedural requirements under state law for adoption
of this amendment, but do not replace or supersede similar attachments to the original Plan or
any amendment thereto adopted prior to this amendment:

Attachment J (resolution adopting this amendment)
Attachment L (published notice of public hearing)
Attachment M (posted notice of public hearing)
5. Except as modified by this amendment, the Plan, as previously amended, shall
continue unmodified in full force and effect.

The following representatives of taxing entities were invited to the meeting: T.J. Koenigsfeld—Black
Hawk County Assessor; Dr. Linda Allen—Hawkeye Community College; Tom Little—Chair, Black Hawk
County Board of Supervisors; Jane Lindaman—Superintendent, Waterloo Community Schools; Shelly
Smith—Black Hawk County Extension Service; David Schmitt—Iowa Department of Agriculture.
The following attended the meeting: Noel Anderson and Aric Schroeder—City of Waterloo Planning
Department.
The City of Waterloo held the consultation meeting for taxing entities. There were no other taxing entities
present, and no questions or comments regarding the proposed amended and restated plan.
Schroeder noted that Iowa Code Chapter 403 governed the establishment of Urban Renewal areas, and that
section 403.5 provided for a consultation with the taxing entities and indicates that the designated
representative of the affected taxing entity may make written recommendations for modification to the
proposed division of revenue no later than seven days following the date of the consultation.

RESOLUTION AFFIRMING DETERMINATION OF AN AREA 6F

THAT THE F REHABILITATION, CONSERVATION,
REDEVELOPMENT, DEVELOPMENT, OR A COMBINATION
THEREOF, OF SUCH AREA IS NECESSARY IN THE INTEREST
OF' tHE PUBLIC HEALTH,. SAFETY OR WELFARE OF THE
RESIDENTS OF THE CITY; AFFIRMING DESIGNATION, OF
SUCH AREA AS APPROPRIATE FOR AN URBAN RENEWAL •

WHEREAS, a proposed 2015 Amendment (the "Amendment") to the
Plan has been prepared, which proposed Amendment is on file in
the office of the City Clerk and which is incorporated herein by
reference, the purpose of which is to set forth and. include
within the Plan one or more additional urban renewal projects and
to update related financial summaries of bonding capacity,
project expenses, and funding sources, but not to alter the land.
previously designated as the urban, renewal plan area; and
WHEREAS, on `September 18, 2015, a consultation was held with
the designated representatides of all affected taxing entities to
discuss the proposed Amendment to the San Marnan Development Plan
and the division of revenue described therein, and that notice of
said consultation and a copy of the proposed Amendment was s'ent
to all affected taxing entities, all required responses to the
recommendations made by the affected taxing entities, if any,
have been timely made as set forth in the report of the•Community
Planning & Development Director submitted to Council and
incorporated herein by this reference, which report is in all
respects approved; and
WHEREAS, by a resolution passed September .21, 2015, this
Council also set a public hearing on the adoption, of the
Amendment for this meeting of, the Council, and due and proper
notice of, said public hearing was given, as provided by law, by
timely' publication in the "Waterloo Courier", which notice set
fbrth the time and place for this hearing and .the nature and
purpose thereof; and
WHEREAS, 'in accordance with said notice; all persons or
organizations desiring'to be heard on the proposed Amendment,
both for and against, have been given an'opportunity to be heard
with respect thereto, and due consideration has been given to all
comments and views expressed to the Council in connection
therewith, and said public hearing has been closed.
NOW, THEREFORE., BE IT RESOLVED, BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA:
Section 1•. That the findings and conclusions set forth or
contained in the Plan and the Amendment thereto concerning the
area of the City, of Waterloo, lows described in the preamble
hereof, be and the same are hereby ratified -and confirmed in all
respects as—the findings of this Council for this area, including
but. not limited to determinations that. the Plan area is eligible
for designation as an urban renewal area and otherwise meets all
:requisite under the provisions of Chapter 403 •of the Code of.
Iowa; that the Plan area is an economic development. area; that
the rehabilitation, conservation, redevelopment, development or a
combination of such activities, of said area is necessary in the
interest of the public health, safety or welfare of the residents
of this City; and designating said area as appropriate for an
urban renewal project.
' Section '2. This Council further finds that (a) a feasible
method exists for the location of families who will be displaced
from the San Marnan Development Plan Area into decent, safe and

sanitary dwelling accommodations within their means and without
undue hardship to` such families, and .(b) the Plan and 2015
Amendment thereto conform to the general plan for the development
of the City as a whole.
Section 3. That the 2015 Amendment to the San Marnan
Development Plan of the City of Waterloo, Iowa. be and the same is
hereby approved and adopted as "2015 Amehdment.to the San Marnan
Development Plan for the City of Waterloo, Iowa"; that said
Amendment isohereby in all respects approved; and that the City
Clerk is hereby directed to file a certified copy of. said
Amendment with the proceedings of this meeting.
Section 4. That the Plan, as sonamended, for the -San Marnan
Development Plan Area shall be in full force and effect from the
date of, this Resolution until 'the later of the date of
termination set forth in the Plan as so amended, or the date on
which payment of all obligations issued or advances made to carry
out the purposes thereof shall be fully provided for. Said
proposed Amendment 'to the San Marnan Development Plan shall be
forthwith certified by the City Clerk, along with a copy ,of this
Resolution, to the Recorder for Black Hawk Couhty, Iowa, to be
filed and recorded inthe manner provided by law.
Section 5. 'That all other provisions of the Plan not
affected or otherwise revised by the terms of. 2015 Amendment„
thereto be .and the same are hereby ratified„ confirmed, and
approved in all respects. '

2. Paragraph I.G is hereby stricken in its entirety and replaced with the following
paragraph I.G:
G. Bonding Capacity. For updated information about unused bonding
capacity for the City of Waterloo, see Attachment "C" attached to the
latest Plan amendment.
3. Attachments C and D to the Plan are hereby stricken in their entirety, and the
new Attachments C and D which are attached hereto are substituted in their place so that the
Plan shows current information about bonding capacity and project budgets.
4. The attachments listed below, each of which is attached hereto, are included in
this amendment to show compliance with procedural requirements under state law for adoption
of this amendment, but do not replace or supersede similar attachments to the original Plan or
any amendment thereto adopted prior to this amendment:
Attachment H (notice of consultation)
Attachment J (resolution adopting this amendment)
Attachment L (published notice of public hearing)
Attachment M (posted notice of public hearing)
5. Except as modified by this amendment, the Plan, as previously amended, shall
continue unmodified in full force and effect.
