Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Lichty, Roehr, Wilharm. Absent: Getty. Invocation by Councilman Wilharm. 73339 - Moved by Roehr, seconded by Bowers that the Agenda, as proposed, for the Regular Session of December 19, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 73340 - Moved by Dowie, seconded by Lichty that the Minutes of the Regular Session held December 12, 1977 at 7:00 P.M., be approved. Motion carried. 73341 - Moved by Roehr, seconded by Bowers that proof of publication of notice of public hearing on rezoning, upon request of Ferm Devel- opment, Inc., upon recommendation of City Zoning Commission, and Council's own motion, to rezone from "A -l" Agricultural District to "R-1" One and Two Family Residence District a tract of land in Section 2 -89N -13W, North of West Airline Hiway and West of Logan Avenue (US Hwy. 63), as published in Waterloo Courier on 12/2/77, be received and placed on file. Motion carried. 73342 - This being the time for hearing, the Mayor called for oral and written objections, and there were none. COUNCILMAN GETTY NOW PRESENT. Moved by Dowie, seconded by Lichty that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 133 to Section 2A-5, rezoning certain property", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 73343 - Moved by Bowers, seconded by Roehr that proof of publication of notice of public hearing on rezoning, upon request of Midway Motor Lodges, upon recommendation of City Zoning Commission, and Council's own motion, to rezone from "R-2" One and Two Family Residence Dis- trict to "C-2" Commercial District a part of Section 21 -89N -13W on East side of Hackett Road and North of University Avenue (US Hwy. 218), as published in Waterloo Courier on 12/2/77, be received and placed on file. Motion carried. 73344 - This being the time for hearing, the Mayor called for oral and written objections, and there were none. Moved by Roehr, seconded by Bowers that "An Ordinance amending Or- dinance No. 2479, as amended, by adding Sub -Section No. 134 to Section 2A-5, rezoning certain property", be received, placed on file, considered and passed for the first time. Ayes: Seven. Mo- tion carried. 73345 - Moved by Dowie, seconded by Geiger that the rules requiring ordin- ances to be considered and voted for passage at two prior meetings, be suspended, the above ordinance recorded as having been consider- ed and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 73346 - Moved by Bowers, seconded by Geiger that "An Ordinance amending Or- dinance No. 2479, as amended, by adding Sub -Section No. 134 to(Sect- ion 2A-5, rezoning certain property", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2932. 73347 - Dave Olive, North Liberty, stated as cable t.v. was a community function and belonged to the citizens of the City he would like to point out some pros and cons which should be considered, and briefly outlined his background. Mayor Rooff said he could meet with him in the Mayor's office, or with the Council. City Attorney Smith said he should be here at the time of the hearing. - 2 - 73348 - Agnes B. Robertson thanked Mayor Rooff and the Council members for their past dedicated work, Councilman Geiger for his San Francisco convention report and supported his going, and looked forward to the next two years of good representation. 73349 - City Attorney Smith reported that Pederson Distributing Company, Inc. through The National Bank of Waterloo had submitted a proposal for the issuance of $600,000 Industrial Development Revenue Bonds, for acquisition of land, construction of warehouse and purchasing equipment, under Chapter 419 of the Iowa Code, for Coors Beer distribution in Waterloo, with proposed location to be Airline Hiway and no timetable set up as yet. He stated a date of hearing could be set but did not recommend acceptance of the Memorandum of Agreement until more information was available. Jim Martin of The National Bank of Waterloo Trust Department intro- duced Dennis Pederson and stated the Bank was taking the entire bond issue, which was a ten year issue and would not be offered publicly. He presented a $3,500 comfort check and asked that January 16, 1977 be set as date of hearing. Moved by Dowie, seconded by Roehr that "Resolution fixing a date of hearing on proposed Industrial Development Revenue Bonds, Series 1978 (Pederson Distributing, Inc. Project)", said date being set as January 16, 1977 at 7:00 P.M. in Council Chambers in City Hall and Clerk instructed to publish notice of public hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25514. 73350 - Moved by Rroehr, seconded by Bowers that the proposal of Pederson Distributing Company, Inc. and $3,500 comfort check for $600,000 Industrial Revenue Bonds issuance, be received and placed on file. Motion carried. 73351 - Bill Parker, 419 Wheeler Street, asked about status of sale of Airline Hiway property on which bids were received last week, and was told this could be on next week's agenda. 73352 - Moved by Roehr, seconded by Geiger that the offer of Ronald N. Weber to purchase Disposal Parcel No. A-19, 137 Center Street, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, for the sum of $450.00 for purpose of erection of 60' x 100' cement block warehouse building, and approval report of Community Development Board, be received, placed on file, "A resolution authorizing the sale of Disposal Parcel No. A-19 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7", adopted and hearing set for January 23, 1978 at 7:00 P.M. in Council Chambers in City Hall. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25515. 73353 - Moved by Getty, seconded by Wilharm that request from William Smith of Globe Building Company for permission to raise the sidewalk at 235-237 Meadowbrook Lane four to six inches, together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Globe Building Company, and authorizing raising of sidewalk at 235-237 Meadowbrook Lane irrespective of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25516. 73354 - Under Council Action #73298 of 12/12/77 the bids for Virden Creek Cunette Repairs, Contract No. 96, were referred to the Engineers. The Engineers recommended acceptance of the low bid of Cedar Valley Corporation of Waterloo, Iowa in the amount of $48,000 for Contract No. 96. Moved by Getty, seconded by WilhaLm that the above recommendation be received, placed on file and "Resolution accepting bid of Cedar Valley Corporation for Virden Creek Cunette Repairs, Contract No. 96", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25517. - 3 - 73355 - Moved by Roehr, seconded by Dowie that communication from City Engineer, advising improvements required as a condition precedent to the final approval of Westbourne Terrace III Addition have been completed in substantial conformance with construction plans, standards and requirements of his, office, submitting four-year maintenance bond for street improvements and two-year for sewer improvements, and recommending acceptance of said Addition and bonds, be received, placed on file, approved and accepted with effective dates of bonds being December 19, 1977. Motion carried. 73356 - Moved by Geiger, seconded by Bowers that minutes of the Community Development Board for regular meeting of November 7, 1977, be re- ceived and placed on file. Motion carried. 73357 - Councilman Getty reported after the closing ceremonies on West- field -Virden project at Conway, that Community Development took the guests on a bus tour and when the project was observed at one time, it was a very remarkable undertaking. 73358 - Moved by Dowie, seconded by Geiger that the following Construct- ion Permits from Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file: No. 78-128-S No. 78-133-S No. 78-122-W Motion carried. Sanitary Sewer Extension Sanitary Sewer Extension Water Main Extension Schukei Counuercial Park Tract E -Southland Park First Addition Tract E -Southland Park First Addition 73359 - Community Development Administrator Mercer reported the large parcel of land was all owned by the Railroad and a portion would be needed for right of way for future Sixth Street Bridge, and to purchase a part at this time would cost as much as the whole parcel. Moved by Roehr, seconded by Bowers that communication from Couuuun- ity Development Administrator, transmitting a proposed resolution for acceptance of an offer from Illinois Central Gulf Railroad to sell the City Parcel No. V -C-1 for right-of-way for Stage V -C of local Flood Control Project, and recommending approval, be re- ceived, placed on file, "Resolution accepting and approving cer- tain offers to sell real property to the City and accepting and approving certain deeds", adopted and the Finance Director dir- ected and authorized to issue a warrant for $2,600.00 required deposit to the Illinois Central Gulf Railroad. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25518. 73360 - Moved by Geiger, seconded by Getty that communication from Commun- ity Development Administrator, transmitting a proposed resolution for City acceptance of responsibilities of operation and mainten- ance of Stage V -B of Local Flood Control Project, being the flood wall between East First Street and East Park Avenue, and recommend- ing approval, be received, placed on f ile and "A resolution author- izing the Mayor to accept on behalf of the City of Waterloo effect- ive December 15, 1977, the assumption of operation and maintenance responsibilities for the flood protection devices constructed as Stage V -B of the Corps of Engineers Local Flood Control Project", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25519. 73361 - Moved by Geiger, seconded by Lichty that communication from Fire Chief requesting Council approval of the promotion of Fire Fighter Patrick Vollbrecht to the rank of Lieutenant, effective December 15, 1977, to fill a vacancy created by retirement, be received, placed on file and approved. Motion carried, December 19, 1977 - 4 - 73362 - Moved by Bowers, seconded by Geiger that communication from Plan and Program Director, reporting a public input hearing is required on the possible uses of Revenue Sharing Entitlement for Fiscal Year July 1, 1978 thru June 30, 1979, be received, placed on file, date of hearing set as January 16, 1978 at 6:30 P.M. in the Coun- cil Chambers in City Hall and Clerk instructed to publish notice. Motion carried. 73363 - Councilman Wilharm, on behalf of the Council, wished everyone a Merry Christmas and Happy New Year: 73364 - Moved by Geiger, seconded by Bowers that report of City Attorney and list of bonds filed with Clerk through 12/19/77, be received, placed on file and report and bonds approved.
