Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Roehr, Wilharm. Absent: Lichty. Invocation by Councilman Getty. 73366 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of December 27, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 73367 - Moved by Dowie, seconded by Bowers that the Minutes of the Regu- lar Session held December 19, 1977 at 7:00 P.M., be approved. Motion carried. 73368 - Moved by Bowers, seconded by Geiger that proof of publication of notice of public hearing on proposal to vacate, sell and convey to Joseph C. Roethler that part of Dearborn Avenue located East of Easterly right-of-way line of Rooff Avenue, Sunshine Subdivis- ion, as published in Waterloo Courier on 12/15/77, for $600.00 plus costs, be received and placed on file. Motion carried. 73369 - This being the time for hearing, the Mayor called for written and oral objections and there were none. Moved by Bowers, seconded by Getty that "Ordinance vacating that part of Dearborn Avenue located East of Easterly right-of-way line of Rooff Avenue, Sunshine Addition", be received, placed on file, considered and passed for the first time. Ayes: Six. Absent: Lichty. Motion carried. 73370 - Moved by Roehr, seconded by Bowers that the rules requiring ordin- ances to be considered and voted on for passage at two prior meet- ings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Six. Absent: Lichty. Motion carried. 73371 - Moved by Roehr, seconded by Bowers that "Ordinance vacating that part of Dearborn Avenue located East of Easterly right-of-way line of Rooff Avenue, Sunshine Addition", be adopted. Ayes: Six. Absent: Lichty. Ordinance adopted and upon approval by Mayor, assigned No. 2933. 73372 - Moved by Bowers, seconded by Getty that "Resolution authorizing the sale and conveyance of that part of Dearborn Avenue located East of Easterly right-of-way line of Rooff Avenue, Sunshine Addition, to Joseph C. Roethler for $600.00 plus costs, and direct- ing and authorizing the Mayor and City Clerk to execute and de- liver a deed for said property", be adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 25520. 73373 - Mayor Rooff welcomed Councilman Getty's brother Dewayne and niece Diane of Dallas, Texas. 73374 - Councilman Roehr reported he and the Mayor met with a group of the area residents on removal of their properties from the Hunting- ton Road Storm Sewer Project and proposed Garden Avenue paving project, and presented a petition from residents of 1200, 1300, 1400 and 1500 blocks of Garden Avenue requesting they not be as- sessed for above work. Moved by Roehr, seconded by Bowers that the above petition be received, placed on file and referred to the City Engineer. Motion carried. 73375 - Moved by Dowie, seconded by Roehr that communication from City Engineer advising improvements required as a condition precedent to the final approval of Southland Park Subdivision (Stage I Construction) have been completed in substantial conformance with construction plans, standards and requirements of his office, sub- mitting four-year maintenance bond for street improvements and two-year maintenance bond for sewer improvements, and reco wend- ing acceptance, be received, placed on file, approved and accepted with effective dates on bonds being December 27, 1977. Motion carried. - 2 - 73376 - Moved by Roehr, seconded by Getty that Finance Director's Report for November, 1977, showing Fund Balance 10/31/77 $14,462,023.00, Receipts $5,191,883.07, Bill Payments $1,880,534.08, Payrolls $694,028.69, Transfers $135,325.84, Commissions $2,969,515.24, Fund Balance 11/30/77 $13,974,503.10, be received, placed on file and approved. Motion carried. 73377 - Under Council Action #73305 of 12/12/77 action was deferred on the sale and conveyance of a certain parcel of land South of Illinois Central Gulf Railroad and North of West Airline Hiway. The Asst. Plan and Program Director stated one of the bidders had indicated his bid not be read and the other bidder had submitted plans in narrative form only. There was a discussion on giving more time to get plans together. Moved by Roehr, seconded by Getty that the report of the Plan and Program Director on bids received for the above parcel of land and recommendation that same be rejected, be received, placed on file, recow.utendation approved, all bids rejected, City Clerk in- structed to return deposits to bidder and said property readver- tised. Motion carried. 73378 - Moved by Dowie, seconded by Roehr that the following Construction Permits from Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file: No. 78-121-S Sanitary Sewer Extension, Westdale Extensions No. 78-114-W Water Main Extension, Westdale Extensions No. 78-124-S Sanitary Sewer Extension, Sturdy Addition Motion carried. 73379 --Moved by Roehr, seconded by Bowers that the City Engineer's Certi- ficate of Completion and Recommendation of Acceptance of Guernsey's Orange View Sanitary Sewer, Contract No. 187, be received, placed on file and "Resolution approving and accepting the Certificate of Completion and Recommendation of Acceptance of City Engineer, as to work performed and materials furnished by Brown & Cris, Inc., Eden Prairie, Minnesota, Contractors, for the construction of Guernsey's Orange View Sanitary Sewer, Contract No. 187", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approv- al by Mayor, assigned No. 25521. 73380 - Moved by Bowers, seconded by Getty that "An Ordinance amending Or- dinance No. 2479, as amended, by adding Sub -Section No. 133 to Section 2A-5, rezoning certain property", be received, placed on file, considered and the rules requiring ordinances to be con- sidered and voted on for passage at two prior meetings, be suspend- ed, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Six. Absent: Lichty. Motion carried. 73381 - Moved by Getty, seconded by Bowers that "An Ordinance amending Or- dinance No. 2479, as amended, by adding Sub -Section No. 133 to Section 2A-5, rezoning certain property", be adopted. Motion carried. 73386 - Mayor Rooff announced that on Monday, January 2, 1978 at 11:45 A.M. the outgoing Council would meet to close their business, immediately thereafter at 11:50 A.M. the new Council would be sworn in and at 12:00 Noon proceed with the organization meeting, and on Tuesday, January 3, 1978 at 7:00 P.M. the regular meeting would be held. 73387 — Moved by Geiger, seconded by Bowers that the Council adjourn.
