The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on November 14, 1977. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr,
Wilharm. Absent: None. Invocation by Councilman Wilharm.
73210 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended,
for the Regular Session of November 14, 1977 at 7:00 P.M., be ac-
cepted and approved. Motion carried.
73211 - Moved by Dowie, seconded by Geiger that the Minutes of the Regular
Session held November 7, 1977 at 7:00 P.M., be approved. Motion
carried.
73212 - Moved by Roehr, seconded by Wilharm that proof of publication of
notice of public hearing on rezoning, upon request of Charles S.
and Judith D. Heene, upon recommendation of City Zoning Commission,
and Council's own motion, to rezone from "U-1" Unclassified Dis-
trict to "M-1" Light Industrial District the West 45' of Lot 8,
Block 16, Hayes Addition, North of Black Hawk Street between West
16th Street and West 17th Street, as published in Waterloo Courier
on 10/28/77, be received and placed on file. Motion carried.
73213 - This being the time for hearing, the Mayor called for oral and
written objections, and there were none.
Moved by Roehr, seconded by Dowie that "An Ordinance amending Or-
dinance No. 2479, as amended, by adding Sub -Section No. 132 to
Section 2A-5, rezoning certain property", be received, placed on
file, considered and passed for the first time. Ayes: Seven.

73215 - R. J. Schnabel, Mgr., Metropolitan Transit Authority, presented a
written request for permission to install a bus waiting shelter
in the NE quadrant of intersection of Downing and South Hackett
Road to serve Central High School Students, with the installation
to be under the supervision of the City Engineer.
Moved by Roehr, seconded by Wilharm that the above request, be
received, placed on file and approved. Motion carried.
73216 - Clair Slick of Waterloo Chamber of Commerce introduced Joe Weis
of Weis Construction Co., Rochester, Minn., who presented a pro-
posal to build 80 units of low income housing for the elderly
under HUD Section 8 (#811) funding, identical to and directly
south of the recently completed housing project on East Ridgeway
Avenue. Don Turner of F. D. Benton Co., Knoxville, Tenn., muni-
cipal bonding, stated the new federal regulation was tax exempt
bond financing, the developer needed the assistance of the public
housing agency to approve the designation for non-profit corpora-
tion to issue bonds, which would be at no obligation or cost to
the City, with the developer required to provide all funding
from beginning to completion before bond proceeds could be re-
leased and the government guaranteeing payment of the revenue
bonds. In the discussion, Councilman Wilharm stressed he was
not against housing for the needy but he felt a person with
$8,000 income was not needy.

the City Attorney. Motion carried.
73217 M. C. French, 1506 Riehl Street, asked if blacktopping of Glen
Avenue, had been given consideration and was informed the Con-

sulting Engineer and Community Development Administrator were

73218 - Moved by Roehr, seconded by Wilharm that request from City Engineer
for permission to widen an existing curb cut from 35' to 45' to
accommodate traffic onto Conger Street from Electric Park, in con-
junction with Sans Souci Bridge Approaches, Contract No. 160, be
received, placed on file and approved. Motion carried.
73219 - Moved by Getty, seconded by Geiger that request from Wendell Lock-
ard for permission to construct a new railroad spur crossing across
W.C.F. & N. Drive to serve Airline Industrial Park, as shown on
attached sketch, together with City Engineer's recommendation for
approval with responsibility of maintenance to be assumed by owner
and at no cost to the City, be received, placed on file, recom-
mendations approved and permission granted in accordance therewith.

for October, 1977, showing Fund Balance 9/30/77 $14,036,808.65, Re-
ceipts $3,499,011.68, Bill Payments $1,366,283.94, Payrolls $690,-
536.21, Transfers $194,046.13, Commissions $821,000.85, Fund Bal-
ance 10/31/77 $14,463,953.20, be received, placed on file and
approved. Motion carried.
73221 - Moved by Geiger, seconded by Roehr that minutes of Community Devel-
opment Board for regular meeting of October 6, 1977, be received,
placed on file and approved. Motion carried.
73222 - Moved by Wilhaiui, seconded by Roehr that construction plans for
riv�ate sanitary and storm sewer facilities, not to be maintained
by the City, serving Tract "E" Southland Park First Addition, to-
gether with Treatment Agreement Form C/75 for Department of Envir-
onmental Quality, and City Engineer's recommendation for approval
subject to final acceptance of sanitary sewer construction plans
being reviewed and accepted by DEQ, and for permission to be
granted for connection of said private sewerage system to the
City's sewerage system, be received, placed on file, recommenda-
tions approved and Mayor and Clerk authorized to execute said
Agreement Form. Motion carried.
73223 - Moved by Dowie, seconded by Bowers that construction plans for
sanitary sewerage facilities serving Triangle Terrace, Contract
No. 189, together with Treatment Agreement Form C 9/75 for De-
partment of Environmental Quality, and City Engineer's recommenda-
tion for approval subject to final acceptance of plans being re-
viewed and accepted by DEQ, be received, placed on file, recom-
mendations approved and Mayor and Clerk authorized to execute said
Agreement Form. Motion carried.
73224 - Moved by Roehr, seconded by Wilharm that statement for engineering
services for Contract No. 163, and City Engineer's recommendation
for approval, be received, placed on file and "Resolution accept-
ing the statement dated 9/30/77 from Robinson Engineering Company
for engineering services for EDA FY 1978 Paving, Contract No. 163,
and authorizing payment accordingly", adopted. Ayes: Seven.

Recommendation of Acceptance of City Engineer for Contract No.156,
be received, placed on file and "Resolution approving the Comple-
tion Report and'Recommendation of Acceptance as to work and mater-
ials furnished by Cedar Valley Corporation for U.S. Highway 218
Resurfacing Program, Contract No. 156, accepting the work and au-
thorizing payment in full accordingly", adopted. Ayes: Seven.

Engineer, transmitting Iowa Department of Transportation invita-
tion for City to submit the following four high hazard railroad
crossings for automatic signal protection installations, with
funding 907., federal and 107 local match, estimated City's share
between $4,000 and $4,800, and recommending approval, be received,
placed on file, approved and "Resolution authorizing Iowa Depart-
ment of Transportation on behalf of City of Waterloo, Iowa, to
program the projects and begin preliminary negotiations with
the railroad companies for four certain high hazard railroad
crossings automatic signal protection installations", adopted:
1) Glenwood Street with Illinois Central Railroad,
2) Nevada Street with Illinois Central Railroad,
3) Westfield -Duryea with Waterloo Railroad,

munity Development Administrator submitting proposals from (1)
Murley, Bergen & Co. $1,028.00, and (2) DenHdrtog & Hogan Co.,
P.C. $750.00, to audit EDA Project No. 05-51-00255, West Side
Parking Ramp, and recommending acceptance of DenHartog & Hogan
Co. proposal and authorization for Mayor to enter into an Agree-
ment for said audit, be received, placed on file, recommendations
approved, and Community Development Administrator instructed to
proceed accordingly. Ayes: Seven. Motion carried.

for permission to attend functions, with expenses allowed not
to exceed the amounts shown, be received, placed on file, and
approved:
Personnel Director to Conference on "Preparing for Factfinding
and Arbitration", Iowa City, Iowa, November 29 and 30, 1977,
$174.50 plus use of City car;
Sanitation Inspector to Grain Fumigation Certification Conference,
Des Moines, Iowa, November 17 and 18, 1977, $122.00.
