Mayor Rooff in the , Getty, Roehr, Wilharm. 72956 - Moved by Roehr, seconded by Dowie that the Agenda, as amended, for the Regular Session of October 3, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 72957 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held September 26, 1977 at 7:00 P.M., be approved. Motion carried. 72958 - Moved by Roehr, seconded by Bowers that the bid of Diamond Crystal Salt Company, St. Clair, Michigan, for Treated Rock Salt for street maintenance purposes for 1977-1978 winter season, in the amount of $18.77 per ton dump truck delivery and $20.17 per ton conveyor de- livery, FOB Waterloo, and Street Superintendent's recommendation for acceptance of $18.77 per ton dump truck delivery, be received, placed on file, recommendations approved, said bid accepted in accordance therewith, and authorizing issuance of purchase order and warrant in payment thereof. Motion carried. 72959 - Building Official Parsons stated the main changes in City Hall for the handicapped would be in the rest rooms, also, drinking fountains, telephones, elevator buttons, and ramps would be provided. Moved by Bowers, seconded by Getty that communication from City At- torney, transmitting a bid for Renovation of City Hall for Handicap- ped Accommodations, in the sum of $9,824.00, and reporting same can be accepted, be received, placed on file, approved and said bid ac- cepted. Ayes: Six. Absent: Lichty. Motion carried. 72960 - Lavonne Anfinson presented a "thank you" letter to the Mayor, Council- men, Quintin Parker, Safety Committee and all others who helped in the installation of school crosswalk at the corner of West Eleventh and South Streets to insure the safety of the children. Moved by Wilharm, seconded by Getty that the above "thank you" let- ter, be received and placed on file. Motion carried. 72961 — Moved by Bowers, seconded by Geiger that communication from Plan and Program Commission requesting. permission to offer for sale Lot 15, Block 3, Manson's 2nd Addition, on+NE corner of Newell Street and Manson Street, as shown on attached plat, be received, placed on file and "Resolution fixing the time and place of hearing and receiving bids as October 24, 1977 at 7:00 P.M. in Council Chambers in City Hall on the proposal to sell and convey Lot 15, Block 3, Manson's 2nd Addition, to the highest bidder", adopted and Clerk instructed to publish notice of hearing. Ayes: Six. Absent: Lichty. Reso- lution adopted and upon approval by Mayor, assigned No. 25412. 72962 - Councilman Roehr asked for a report on restriction of parking on West Seventh Street from Highway 218 to Williston Avenue. 72963 - Moved by Roehr, seconded by Bowers that communication from Plan and Program Conuuission requesting permission to offer for sale the West 1/2 of Lot 47, Maywood Third Addition, on NW corner of Ann Street and Milwaukee Street, as shown on attached print, be received, placed on file and "Resolution fixing the time and place of hearing and receiving bids as October 24, 1977 at 7:00 P.M. in Council Cham- bers in City Hall on the proposal to sell and convey the West 1/2 of Lot 47, Maywood Third Addition, to the highest bidder", adopted and Clerk instructed to publish notice of hearing. Resolution adopted and upon approval by Mayor, as- signed No. 25413. 72964 - Moved by Roehr, seconded by Bowers that couuaunication from Plan and Program Commission, transmitting request from Verner and Donna Nelson and Rowland K. Sverdahl, 514 Columbia Circle, to purchase a City public parking lot located on East side of Cedar River, Govt. Resolution adopted and upon approval by Mayor, assigned No. 25414. 72965 - Moved by Geiger, seconded by Dowie that request from Cecil Burns Co. for permission to construct one 22' commercial curb cut to serve apartment at 2539 St. Francis Drive, as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72966 - Moved by Wilharm, seconded by Roehr that request from Mattson & Gil- liam for Crown Development for pesuaission to construct one 25' com- mercial curb cut on Wildwood Road to serve townhouses at 3705 St. Francis Drive, as shown on attached plat, and City Engineer's recom- mendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72967 - Moved by Dowie, seconded by Bowers that request of John G. Miller Con- struction Co. for Eagle Discount Supermarket, corner of West Seventh and Washington Streets, for permission to widen two existing concrete approaches, the one on South Street nearest West Seventh Street widen 10°, and the other on West Seventh Street nearest South Street widen 6', together with City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recom- mendations approved and permission granted in accordance therewith. Motion carried. 72968 - Under Council Action #72787 of 9/6/77 the public hearing on the pro- posal to issue $4,600,000 Revenue Bonds for Allen Memorial Hospital Corporation was adjourned to this date, time and place. Moved by Roehr, seconded by Dowie that this hearing be and the same is hereby further adjourned to November 7, 1977 at 7:00 P.M. at the Council Chambers in the City Hall in said City at which time and place this Council will take up and consider a resolution initiating proceedings for the issuance of $4,600,000 Revenue Bonds for Allen Memorial Hospital Corporation, etc. Ayes: Six. Absent: Lichty. Motion carried. 72969 - Councilman Roehr asked if a precedent would be set if the infoLmal- ities in the bidding on Minor Contract No. 96 were waived; the Roblin Construction representative stated his firm should be awarded the con- tract; Councilman Wilharm pointed out bids received after deadline were not accepted; Mayor Rooff reported the City Engineer's findings were that low bidder Cedar Valley Corporation did not meet the require- ments of submitting bid in duplicate; Councilman Getty agreed with what was said but felt the informality should be waived to allow the City to save $8,000 in contract price; Councilman Roehr was against deviation from requirements on this contract; Mayor Rooff stated the Council had a legal right to waive informalities, or could grant the bid to the second low bidder; Councilman Getty felt this was an hon- est oversight and Engineer's recommendations should be denied to al- low an $8,000 savings. Discussed was future bids be checked before read. Moved by Getty, seconded by Bowers that communication from City En- gineer, reporting on bids received for Parking Lot, Bus Transfer Station and Incidentals, Minor Contract No. 96 and recommending that low bid of Cedar Valley Corporation be declared ineligible as it did not meet the bidding requirements of submitting bid proposal in dupli- cate and bid be awarded to Rohlin Construction Company, Inc., second low bidder, and transmitting, Contract, Bond and Certificate of In- surance from Rohlin Construction Co., Inc., be received, placed on file, the informalities in bidding requirements waived and "Resolu- tion accepting the bid of Cedar Valley Corporation, Waterloo, Iowa, for the total sum of $153,333.70 for the Parking Lot, Bus Transfer Station and Incidentals, Minor Contract No. 96", adopted. Ayes: Bowers, Dowie, Geiger, Getty. Nay: Roehr and Wilharm. Absent: Lichty. - 3 72969 - (Continued) Resolution adopted. Mayor Rooff stated the bid was not submitted in accordance with City Engineer's requirements and vetoed the resolu- tion. 72970 - A discussion followed. Moved by Bowers, seconded by Dowie that both bids No. 96, be rejected, the City Engineer instructed notice, the City Clerk to publish same, and Octobe new date for new hearing and receiving bids. Ayes Geiger, Getty. Nay: Roehr and Wilharm. Absent: carried. for Minor Contract to prepare a new r 10, 1977 set as Bowers, Dowie, Lichty. Motion 72971 - Moved by Wilharm, seconded by Roehr that communication from City At- torney, reporting acquisition of part of Section 6-89-12 for Flood Control Program purposes, and transmitting a Farm Lease with Arnold Julius Kass for period of 10/1/77 thru 12/1/78 for 125 acres for the sum of $10,629.00, and recommending approval, be received, placed on file and "Resolution approving Farm Lease dated 9/28/77 with Arnold Julius Kass and authorizing the Mayor and Clerk to execute same in behalf of City of Waterloo", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 25415. 72972 - Moved by Roehr, seconded by Bowers that Preliminary Plat of Falls Avenue Replat of Part of "Westfield" and Vaughan Subdivision with Deed of Dedication, Report of City Engineer, request of property own- ers for area to be platted, Plan and Program Commission's resolution of approval and their recommendation for Council approval, be re- ceived, placed on file and "Resolution approving the Preliminary Plat of Falls Avenue Replat of Part of "Westfield" and Vaughan Sub- division", adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No 25416. 72973 - When and who's responsibility to pave a street in the Final Plat of Westdale was discussed with Plan and Program Director Franke and Fred Debe; and also, the making of a policy at this time. Plan and Program Director Franke orally stated the provisions that, the Council would require this segment of Neeb Street would not need to be improved at this time and has been accepted for right of way purposes only, and at such time that the property to the west is developed, then that street would be required to be developed by the person on the west. Moved by Roehr, seconded by Dowie that Final Plat of Westdale with Engineer's Certificate of Survey, Deed of Dedication, Contract and Waivers, Report of City Engineer, Plan and Program Commission's res- olution of approval and their recommendation for Council approval, be received, placed on file and "Resolution approving the Final Plat of Westdale, Waterloo, Black Hawk County, Iowa", adopted, Mayor and Clerk authorized to execute said Contract, subject to the above oral provisions of the Plan and Program Commission. Ayes: Six. Ab- sent: Lichty. Resolution adopted and upon approval by Mayor, as- signed No. 25417. 72974 - Moved by Roehr, seconded by Bowers that communication from Asst. City Attorney, reporting four-way stop intersection of Bertch Avenue and Western Avenue had been inadvertently repealed, and transmitting "An Ordinance amending Ordinance No. 2644, known as the Traffic Or- dinance by adding new Subsection (28) Bertch Avenue and Western Ave- nue to Section 544, Four -Way Stop Intersections", be received, placed on file and said Ordinance considered and passed for the first time. Ayes: Six. Absent: Lichty. Motion carried. 72975 - Moved by Roehr, seconded by Getty that the rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. October 3, 1977 - 4 - 72976 - Moved by Roehr, seconded by Bowers that "An Ordinance amending Or- dinance No. 2644, known as the Traffic Ordinance by adding New Sub- section (28) Bertch Avenue and Western Avenue to Section 544, Four - Way Stop Intersections", be adopted. Ayes: Six. Absent: Lichty. Ordinance adopted and upon approval by Mayor, assigned No. 2924. 72977 - Moved by Dowie, seconded by Bowers that "An Ordinance amending Chap- ter 36, Vehicles for Hire, of the Code of Ordinances, City of Water- loo, Division 4, Rates & Fares", be received, placed on file, con- sidered and passed for the first time. Ayes: Six. Absent: Lichty. Motion carried. 72978 - Moved by Roehr, seconded by Bowers that proof of publication of No- tice to Property Owners for Manson Street Underground Water Services, Contract No. 157A, be received and placed on file. Motion carried. 72979 - Moved by Getty, seconded by Bowers that City Engineer's Final Sched- ule of Assessments, etc. for the Manson Underground Water Services, Contract No. 157A, be received and placed on file. Motion carried. 72980 - Moved by Bowers, seconded by Dowie that "Resolution adopting and levying final schedule of assessments, and providing for the payment thereof for Manson Underground Water Service , Contract No. 157A", be adopted. Resolu- tion adopted and upon approval by Mayor, assigned No. 25419. 72983 - Moved by Getty, seconded by WilhaLm that the Clerk be instructed to publish the notice of public hearing on plans and specifications, etc. for E.D.A. Project, Addition to the City Hall Annex, Contract No. B-38, and the taking of bids for the improvement, with date set as October 24, 1977 at 7:00 P.M. Motion carried. 72984 - Moved by Roehr, seconded by Geiger that following request for permis- sion to attend function, with expenses not to exceed amount shown, be received, placed on file and approved: Five Sanitation Department Personnel to Iowa Association of Milk, Food and Environmental Sanitarians, Inc., Waterloo, Iowa, October 12, 1977, $5.00 each. Motion carried. 72987 - Moved by Roehr, seconded by Bowers that "Resolution adopting and levying final schedule of assessments, and providing for the payment thereof for Ash Street Underground Water Services, Contract No. 157B", be adopted. October 3, 1977 - 5 - 72988 - Mayor Rooff recommended that action be deferred on the Sunday Sales Beer Liquor License - Class C application of William Oleson dba The Red Cedar Lounge, 102 West Eleventh Street, until substantiation is received that gross sales comply with the requirements of Iowa Code Section 123.36 for qualifying for said Sunday Sales License.
