The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on October 10, 1977. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr, Wilhaiin.
Absent: None. Invocation by Councilman Geiger.
72994 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed, for
the Regular Session of October 10, 1977 at 7:00 P.M., be accepted and
approved. Motion carried.
72995 - Moved by Wilharm, seconded by Getty that the Minutes of the Regular
Session held October 3, 1977 at 7:00 P.M., be approved. Motion car-
ried.
72996 - Moved by Dowie, seconded by Bowers that proof of publication of notice
of hearing on proposed plans, specifications, form of contract, esti-
mate of cost, etc. for Parking Lot, Bus Transfer Station and Inciden-
tals, Minor Contract No. 96, be received and placed on file. Motion
carried.
72997 - This being the time for hearing, the Mayor called for oral and writ-
ten objections and there were none.
Moved by Roehr, seconded by Dowie that "Resolution confirming approv-
al of plans, specifications, form of contract, estimated cost, etc.
for Parking Lot, Bus Transfer Station and Incidentals, Minor Contract
No. 96", be adopted. Ayes: Seven. Resolution adopted and upon ap-
proval by Mayor, assigned No. 25421.
72998 - Moved by Geiger, seconded by Bowers that "Resolution ordering the
construction of Parking Lot, Bus Transfer Station and Incidentals,
Minor Contract No. 96", be adopted. Ayes: Seven. Resolution adopted
and upon approval by Mayor, assigned No. 25422.
72999 - Moved by Wilharm, seconded by Roehr that the following bids be received,
placed on file, Clerk instructed to open same, but not read, and re-
ferred to Engineers for checking and report back:

timate of cost, etc. for FY 1978 Sanitary Sewer Program #1, Contract
No. 190, be received and placed on file. Motion carried.

73003 - Moved by Geiger, seconded by Bowers that "Resolution ordering the
construction of FY 1978 Sanitary Sewer Program #1, Contract No. 190",
be adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 25424.
73004 - Moved by Geiger, seconded by Bowers that the following bids be re-
ceived, placed on file, Clerk instructed to open same, but not read,
and referred to Engineers for checking and report back:

73005 - The City Engineer reported the bids of Hurst Excavating, Inc. and
Larry Lehman Trucking for Contract No. 190 were not submitted in du-
plicate and did not meet the bidding requirements.
Moved by Roehr, seconded by Geiger that the bids of Hurst Excavating
Inc. and Larry Lehman Trucking for the FY 1978 Sanitary Sewer Program
#1, Contract No. 190, be rejected, and the Clerk instructed to read
the remaining bid, which was as follows:

73006 - Marvin Bartels, Director of the Northeast Iowa Crime Commission, orally
requested that the City of Waterloo provide $2,353 matching funds for
the Urban 4-H Program for disadvantaged young people who need counsel-
ing. A discussion followed on duplication of recreational and educa-
tional activities with Boy and Girl Scouts, Y.M.C.A. AND Y.W.C.A., etc.;
on conducting a fund raising drive, funds from United Appeal; on Iowa
State University Extension Services picking up salaries if funds not
available; program phasing out in four years; in 1977 out of 465 par-
ticipants, 350 were from Waterloo with 60% to 70% in attendance each
week. Councilman Wilharm felt that tax money should not be spent in
this way. Councilman Getty urged that the request be granted for one
year only.
Moved by Wilharm, seconded by Roehr that the above request for $2,353
matching funds for the Urban 4-H Program, be received, placed on file

Getty, Lichty. Motion not carried.
73007 - Councilman Wilharm pointed out that the group was supported by one
taxing body and asked if it was right for another taxing body to sup-
port the program.
Moved by Getty, seconded by Dowie that the request of Marvin Bartels,
Director of the Northeast Iowa Crime Commission for $2,353 matching
funds for the Urban 4-H Program, be approved and granted for one year
only and that some other funding source be found for next year. Ayes:
Bowers, Dowie, Geiger, Getty, Lichty, Roehr. Nay: Wilharm. Motion
carried.
73008 - Dorothy Severson, 927 Forest Avenue, requested that parking be banned
on the portion of West 7th Street south from Grant Street to Easton
Avenue, as it was unsafe for two-way traffic as parking was allowed
on the west side.
Moved by Roehr, seconded by Getty that the above request be received,
placed on file and referred to Quintin Parker, Sign and Traffic Main-
tenance Department, with a report back and a copy sent to Dorothy
Severson. Motion carried.

73009 - Councilman Lichty presented a petition from the residents in the 600
blocks of Dawson and Riehl Streets objecting to the maintenance of
a dog kennel at 633 Dawson Street.
E.S. Kerr, 637 Dawson Street, reported there were 6 to 10 collie dogs,
excess barking at all hours, offensive smells, noxious exhalations
and noise, which was injurious and dangerous to their health, comfort
and property. Olga Gahwiller and others complained of stench, unable
to sleep due to barking dogs, etc.

Dwayne Eilers asked if the Weed Ordinance had been changed and City
Attorney Smith stated no changes were warranted at this time as it
was fair and effective. Discussed was cutting weeds strictly on a
complaint basis; Street Department cuts City property and Park De-
partment private property; notification of property owners before
cutting.
73011 - Mayor Rooff welcomed Don McDermott, Miami Beach, Fla., who was in
attendance.
73012 - Moved by Bowers, seconded by Getty that request of Union Baptist
Crusaders for petuiission to stage fireworks display at the Union
Missionary Baptist Church, 130 Jackson Street, on Sunday October 16,
1977, between 5:00 P.M. and 6:00 P.M., be received, placed on file
and permission granted subject to bond being filed and to approval
of Fire Chief. Motion carried.
73013 - Moved by Dowie, seconded by Bowers that request of Community Mortg-
age and Investment Company for permission to blacktop the parking at
503-509 Ansborough Avenue for beautification purposes only without
regard to sidewalk grade, together with $3.00 for recording waiver,
and City Engineer's recommendation for approval, be received, placed
on file, approved and "Resolution granting permission to Community
Mortgage and Investment Company and authorizing blacktopping park-
ing at 503-509 Ansborough Avenue for beautification purposes only
irrespective of a later official grade", adopted. Ayes: Seven.

73014 - Moved by Geiger, seconded by Roehr that request from Robert R. Black
and Keith E. Siglin for peLmission to blacktop the alley between 613
Vermont Street and 1425 West Fifth Street, together with City Engin-
eer's recommendation for approval subject to the provisions of his
letter, be received, placed on file and approved at no cost to the
City. Motion carried.
73015 - Moved by Roehr, seconded by Geiger that request

73017 - Moved by Dowie, seconded by Geiger that request from Edward H. Wilson
for permission to construct one 30' curb cut to serve a three stall
garage at 3375 Inverness Road, with curb cut on West Ridge Drive and
existing driveway to be closed, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received,
placed on file, recommendations approved and peiuiission granted in
accordance therewith. Motion carried.
73018 - Building Official Parsons stated the Arthur's Athletic Lounge had not
brought the building at 211 Linn Street up to City Code by 10/1/77,
as agreed to, Mayor Rooff stated a date of hearing should be set
and City Attorney Smith said disapproval of license would be the only
action necessary.
Moved by WilhaLm, seconded by Bowers that communication from Building
Official, reporting Arthur's Athletic Lounge, 211 Linn Street, Beer
Liquor License was approved conditional to bringing the building up
to City Code by October 1, 1977; that same had not been done; and
requesting said Class C and Sunday Sales Beer Liquor Licenses be
suspended until such time as the building meets the City Code, be
received, placed on file and said license disapproved. Motion carried.
73019 - Moved by Wilharm, seconded by Roehr that City Treasurer's Financial
Report for September, 1977, showing Balance on Hand 9/1/77 $14,977,-
424.54, Receipts $2,210,007.92, Disbursements $2,669,338.94, Balance
on Hand 9/30/77 $14,518,093.52, be received, placed on file and ap-
proved. Motion carried.
73020 - Moved by Roehr, seconded by Geiger that minutes of the Community De-
velopment Board for regular meeting of September 6, 1977, be received
and placed on file. Motion carried.
73021 - Moved by Wilharm, seconded by Dowie that "An Ordinance amending Chap-
ter 36, Vehicles for Hire, of the Code of Ordinances, City of Water-
loo, Division 4, Rates & Fares", be received, placed on file, con-
sidered and the rules requiring ordinances to be considered and voted
on for passage at two prior meetings, be suspended, the above ordin-
ance recorded as having been considered and passed for the second
and third times, and now placed on its final adoption. Ayes: Seven.

73030 - The Engineers recommended acceptance of the low bid of Cedar Valley
Corporation of Waterloo, Iowa in the amount of $153,333.70 for Minor
Contract No. 96.
Moved by Getty, seconded by Geiger that the above reconmiendation be
received, placed on file and "Resolution accepting bid of Cedar Val-
ley Corporation in the amount of $153,333.70 for Parking Lot, Bus
Transfer Station and Incidentals, Minor Contract No. 96", adopted.

73031 - The Engineers reported that the bid for Contract No, 190 of B & B
Excavating, Inc. did not meet the requirement of unit bid price
being spelled out in the space provided.
Moved by Roehr, seconded by Dowie that the bid of B & B Excavating,
Inc. be rejected and the Clerk instructed to republish the notice
and October 24, 1977 set as new date for new hearing and receiving
of bids. Motion carried.
