Mayor Rooff in the Chair. On roll call, Present: Dowie, Geiger, Getty, Lichty, Roehr, Wilharm. Absent: Bowers. Invocation by Councilman Getty. 72897 - Moved by Roehr, seconded by Geiger that the Agenda as proposed, for the Regular Session of September 26, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 72898 - Moved by Dowie, seconded by Geiger that the Minutes of the Regular Session held September 19, 1977 at 7:00 P.M., be approved. Motion carried. 72899 - Moved by Roehr, seconded by Lichty that proof of publication of No- tice of Public Hearing on proposed plans, specifications, form of contract and estimate of costs, etc. for Parking Lot, Bus Transfer Station and Incidentals, Minor Contract No. 96, be received and placed on file. Motion carried. 72900 - The Mayor announced this was the time for hearing, called for oral and written objections, and there were none. Moved by Dowie, seconded by Geiger that "Resolution confirming ap- proval of plans, specifications, form of contract, estimated cost, etc. for Parking Lot, Bus Transfer Station and Incidentals, Minor Contract No. 96", be adopted. Ayes: Six. Absent: Bowers. Reso- lution adopted and upon approval by Mayor, assigned No. 25395. 72901 - Moved by Geiger, seconded by Roehr that "Resolution ordering the construction of Parking Lot, Bus Transfer Station and Incidentals, Minor Contract No. 96", be adopted. Motion carried. 72904 - The Mayor announced the time had arrived for hearing, called for oral and written objections, and there were none. Moved by Dowie, seconded by Geiger that the following bids, together with deposits in full, be received, placed on file, Clerk instructed to open same and referred to Plan and Program Commission for check- ing: Bidder Amount Union M. B. Church, 130 Jackson Street $1,000.00 Motion carried. - 2 - 72905 - The Plan and Program Director reported the bid of Union Missiary Baptist Church in the amount of $1,000 for Lots 3, 4 and 5, Block 1, Shilliams 3rd Subdivision, was the highest received and recommended acceptance. Moved by Roehr, seconded by Wilharm that the above recommendation be received, placed on file and "Resolution accepting the bid of Union Missiary Baptist Church of Waterloo, Iowa in the amount of $1,000, approving and authorizing the sale and conveyance of Lots 3, 4 and 5, Block 1, Shilliams 3rd Subdivision, as published in Waterloo Courier on 9/9/77, and directing and authorizing the Mayor and Clerk to execute and deliver a deed for said property", adopted. Absent: Bowers„ Resolution adopted and upon approval by Mayor, as- signed No. 25397. 72906 - Lavonne Anfinson, 1502 Washington Street, presented a petition for painted school crossing lines and street signs at West Eleventh and South Streets, and mentioned there also was a need at Hammond Avenue and South Street and at West Ninth and South Streets. Mayor Rooff stated the Sign and Traffic Maintenance Department would check on this. Moved by Getty, seconded by Geiger that the above petition be received and placed on file and referred to said Department. Resolution adopted and upon approval by Mayor, assigned No. 25398. 72909 - Moved by Roehr, seconded by Geiger that request from Deere & Company for permission to install a heavy industrial railroad crossing and necessary grading approximately 1,100' west of Elk Run Road on Newell Street to service their Northeast Site facilities, with Deere & Com- pany to assume full responsibility for maintenance of railroad cross- ing, and City Engineer's recommendation for approval, be received, placed on file and approved. Motion carried. 72910 - Moved by Geiger, seconded by Dowie that request of The National Bank of Waterloo for permission to construct one 16' commercial curb cut on East Third Street to serve an addition to drive -up bank at 412 Mulberry Street, as shown on attached plat, and City Engineer's recom- mendation for approval subject to the provisions of his letter, be re- ceived, placed on file, recommendations approved and peLmission gran- ted in accordance therewith. Motion carried. 72911 — Moved by Dowie, seconded by Getty that request of Rick Young for per- mission to construct one 24' commercial cut on Kimball Avenue to serve two tri-plexes at 1705-1707-1709 and 1719-1721-1723 Kimball Avenue, as shown on attached sketch, and City Engineer's recommendation for ap- proval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72912 - Gene Yagla, Atty. for Waterloo Yellow Cab Company, spoke in support of increasing the rates and William Lemke stated he did not want to reduce the hours as it is the night hours which cause the loss and this is when the cabs are needed by Deeres, Northwestern Bell girls, emergencies; limousine service to the airport has been eliminated un- less requested. Absent: Bowers, Motion car- ried. 72915 - Mayor Rooff commended the Tilbury area residents who opposed the pre-school for the fine way they handled the situation, with no anger, accusations, etc. and for welcoming the Sells as neighbors but not the pre-school. Roger Fisher, 2006 Tilbury Road, spoke against the pre-school and Barbara Sells in support of her request. Moved by Roehr, seconded by Geiger that request from Robert and Barbara Sells for Council on its own motion to Conditional Zone in a "R-1" One and Two Family Residence District, for proposed pre- school in home purposes, Lot 82, Westbourne Terrace Addition, 1959 Tilbury Road, as shown on attached plat, and construction plans, petition in support, and a petition of remonstrance by majority of property owners within 250°, and City Zoning Commission's recommen- dation for denial, be received, placed on file, and request denied. Resolution adopted and upon approval by Mayor, assigned No. 25399. 72917 - Under Council Action ##72798 of 9/6/77, action was deferred on the vacation, sale and conveyance of All of Nly-Sly alley between SWly line of Grant Avenue and NEIy line of Allen Street between West Fifth Street and West Fourth Street, all in Block 6, Miller's Ad- dition, to Kenneth G. Meyerhoff Trust, Arthur Tomlin and MFC Cor- poration until the City receives an easement for the public to have complete access to the said alley. Mo- tion carried. 72919 - Moved by Roehr, seconded by Wilharm that communication from City En- gineer, transmitting construction plans from Schenk Engineering Com- pany for paving of Hillside Addition. and recommending financial par- ticipation from Developer Chuck Granger for replacement of temporary asphalt paving with concrete curb and gutter paving after additional storm sewer improvements are constructed, be received, placed on file, recommendations approved and construction plans approved in accord- ance therewith. Resolution adopted and upon approval by Mayor, assigned No. 25403. 72928 - Mayor Rooff stated the library bond issue would be in the amount of $3,650,000 for the purpose of acquiring, reconstructing, improving and equipping the old post office building at West Park Avenue and Commercial Street and adoption of the proposed resolution would al- low the people of Waterloo to vote on the issue. A discussion fol- lowed. Mayor Rooff stated that if the two present library buildings were sold, the money probably would go into the general fund; there would be one central library; that the federal government has signed off on the old post office, as far as he knew, no state agency wants it, and it will probably be offered to the City but as yet he was unaware of any figure for purchase. Craig Stainbrook asked if the voters will be made aware of the options in case of a no vote at the election, that certain requirements for handicapped had to be met. Mayor Rooff said if the election fails, the Library Board would have to decide whether to renovate the pres- ent buildings or go for a new building. Library Director Phipps stated therewas no estimate for renovation of the present buildings, many things needed to be done and it would be a poor investment of money. Mayor Rooff stressed everything would be told to the public; the pub- lic was invited to the Library Board meetings; if a different loca- tion was selected, it will take more property off the tax rolls. Moved by Wilharm, seconded by Dowie that "Resolution calling an election on the proposition of issuing bonds for Public Library pur- poses", be adopted. Ayes: Six. Absent: Bowers. Motion carried. 72945 - After discussion and due consideration, it was Moved by Roehr, seconded by Getty that couuuunication from City En- gineer, submitting the following Alternate #1 and #2 for new side- walk construction under the Third Year Block Grant Program alloca- tion of $30,000, proposed 1977 New Sidewalk Program, Contract No.44, and recommending Alternate #1, concurred by the Mayor's Safety Com- mittee, be received, placed on file, recommendations and Alternate #1 approved, and City Engineer instructed and authorized to proceed accordingly with right-of-way, specifications and plans, etc.: ALTERNATE #1 - East side of Idaho Street from Alta Vista Avenue to City View Street and on the west side of Idaho Street from Independ- ence Avenue to French Street. ALTERNATE #2 - Both sides of Greenbrier Road from Wakonda Drive to Hyperion Drive, both sides of Oakwood Drive from Candlewick Road to Greenbrier Road and on the south side of Oakwood Drive from Green- brier Road to Cedar Bend Street.
