The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on August 1, 1977. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr,
Wilharm. Absent: None. Invocation by Councilman Getty.
72570 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for
the Regular Session of August 1, 1977 at 7:00 P.M., be accepted and
approved. Motion carried.
72571 - Moved by Geiger, seconded by Lichty that the Minutes of the Regular
Session held July 25, 1977 at 7:00 P.M., be approved. Motion carried.
72572 - Agnes Robertson asked what progress was being made on water service
installation in Maywood. Mayor Rooff reported request has been made
to Dept. of Environmental Quality and as soon as permission is grant-
ed, the City would go ahead.
72573 - Councilman Dowie presented a request from Conway Civic Center for a
promotion program with total projected expenses of 840,000, which
included, commitment for chamber payments $8,000, salary and fringe
benefits for potential promotion marketing manager $18,000, travel
expenses $7,250, miscellaneous $6,750.
Moved by Dowie, seconded by Roehr that the above request be received,
placed on file and approved.
72574 - Councilman Bowers asked that the above motion be amended to include
"that the Ex-offico Councilman on the Conway Board and the Mayor
be instructed to closely monitor the budget".
Moved by Bowers, seconded by Getty that the above amendment, be re-
ceived, placed on file, and approved. Motion carried.
72575 - Mayor Rooff called for the roll call on the motion to approve the
request from Conway Civic Center for a promotion program with total
projected expenses of $40,000, with amendment to include that the
budget be closely monitored by the Ex-Offico Councilman member and
the Mayor. Ayes: Bowers, Dowie, Geiger, Getty, Roehr, Wilharm.
Nay: Lichty. Motion carried.
72576 - City Clerk Gibbs reported Paul D. Speer, Bond Consultant, by phone,
recommended that August 22, 1977, be set as date of public hearing
on issuance of revenue bonds for Allen Memorial Hospital Corporation
and written recommendation to this effect would be forthcoming.
Moved by Wilharm, seconded by Getty that communication from Allen
Memorial Hospital Corporation, requesting that the City of Waterloo,
Iowa, issue revenue bonds under Chapter 419, Code of Iowa, to pro-
vide funds to pay part or all of the cost of certain improvements
and certain outstanding indebtedness of said Hospital, and a check
for $3500.00 in compliance with City requirements, be received,
placed on file, and "Resolution declaring the intention to issue
Revenue Bonds of the City of Waterloo under Chapter 419, Iowa Code,
in behalf of Allen Memorial Hospital Corporation, subject to various
conditions, and calling a public hearing on the proposal to issue
such bonds" adopted, and date of hearing set as August 22, 1977 at
7:00 P.M., in the Council Chambers in City Hall. Ayes: Seven.
Resolution adopted and upon approval by Mayor, assigned No. 25292.
72577 There was a discussion on selling of the alley and effect on other
business houses bordering said alley.
Moved by Getty, seconded by Geiger that request of Joe Nutting for
Kenneth G. Meyerhoff Trust, of Arthur Tomlin and of Samuel Christen-
sen for MFC Corporation, for vacation, sale and conveyance of All of
Nly-Sly alley between SWly line of Grant Avenue and NEly line of
Allen Street between West Fifth Street and West Fourth Street, all
in Block 6, Miller's Addition, as shown on attached plat, for $0.10
per square foot plus costs, and Plan and Program Commission's recom-
mendation for approval with City retention of utility easement, be
received, placed on file and "Resolution fixing the time and place
of hearing as August 22, 1977 on proposal to vacate, sell and convey
certain real property to Kenneth G. Meyerhoff Trust, Arthur Tomlin
and Samuel Christensen for MFC Corporation", adopted and Clerk in-
structed to publish notice of hearing. Ayes: Bowers, Dowie, Geiger,

72578 - Whitey Guild briefly outlined the Optimist junior baseball program,
the accomplishments and future plans. Councilman Roehr expressed
concern as to increased traffic at intersection of Highway #63 and
Ansborough Avenue and to access to Rainbow Drive. A discussion fol-
lowed on days diamonds used, time of day, number of additional cars,
adequate parking, cars exiting in about 10 minutes after games, etc.
Moved by Dowie, seconded by Geiger that request from Waterloo Optimist
Club and Exchange Club of Waterloo for permission to use a parcel
of land in the Greenbelt Park just to the east of the Flood Control
Dike along Black Hawk Creek and just north of Highway 63 and west of
Ansborough Avenue, as shown on attached Exhibit B, for a Junior Base-
ball Three Diamond Complex under the direction and control of the
Waterloo Recreation Commission and Park Department, be received, placed
on file and permission granted. Motion carried.
72579 - Mayor Rooff welcomed three members of the Junior League who were in
attendance.
72580 - Moved by Roehr, seconded by Lichty that request from Northwestern
Bell for a drive over curb along the east side of Aladdin Street
between Stratford Avenue and Upton Avenue, as shown on attached plat,
and City Engineer's recommendation for approval, subject to the pro-
visions of his letter, be received, placed on file, recommendations
approved and permission granted in accordance therewith. Motion car-
ried.
72581 - Moved by Getty, seconded by Geiger that request from Schenk Engineer-
ing Company for permission to construct two 35' commercial curb cuts
on Murphy Road and a request from Youngblut Construction for peLwis-
sion to construct one temporary concrete driveway without regard to
sidewalk grade on Hammond Avenue, to serve Balko's Furniture Mart,
4045 Hammond Avenue, together with $3.00 for recording waiver, and
City Engineer's recommendation for approval subject to the provisions
of his letter, be received, placed on file, recommendations approved,
permission granted in accordance therewith, and "Resolution granting
permission to Youngblut Construction and authorizing construction of
a temporary concrete driveway at 4045 Hammond Avenue irrespective of
a later official grade", adopted. Ayes: Seven. Resolution adopted
and upon approval by Mayor, assigned No. 25294.
72582 - Moved by Wilharm, seconded by Getty that City Treasurer's Investment
Report for FY July 1, 1976 - June 30, 1977 to Auditor of State of
Iowa, be received, placed on file and approved. Motion carried.
72583 - Moved by Roehr, seconded by Lichty that communication from Plan and
Program Canmission, transmitting a Lease Agreement, dated 8/1/77,
with Carol P. Weekley dba Weekley Auto Salvage for that portion of
vacated Kenyon Street lying between the NWly lot line of Lot 11,
Block 1, extended and NWly lot line of Lot 22, Block 2 extended,
Riverview Addition, for the period of one year of May 1, 1977 thru
April 30, 1978, for the sum of $55.00 per year, pro -rated for nine
months, for Auto Salvage Yard purposes, subject to obtaining a cur-
rent Auto Salvage Yard License each year and to fence being instal-
led by 9/1/77, be received, placed on file and "Resolution approv-
ing a Lease Agreement, dated 8/1/77, with Carol P. Weekley dba Week -
ley Auto Salvage and authorizing the Mayor and City Clerk to execute
said Lease Agreement on behalf of the City of Waterloo, Iowa", a-

72584 - Moved by Roehr, seconded by Wilharm that construction plans for
Georgian Heights sanitary sewer outfall, together with Treatment A-
greement Form C 9/75 for Department of Environmental Quality, and City
Engineer's recommendation for approval with final acceptance of
plans to be reviewed and accepted by said DEQ, be received, placed
on file, recommendations approved and Mayor and Clerk authorized
to execute said Agreement Form. Motion carried.

72585 - Moved by Dowie, seconded by Getty that construction plans for sani-
tary sewerage facilities serving Audubon Park, together with Treat-
ment Agreement Form C 9/75 for Department of Environmental Quality,
and City Engineer's recommendation for approval with final accept-
ance of plans to be reviewed and accepted by said DEQ, be received,
placed on file, recommendations approved and Mayor and Clerk author-
ized to execute said Agreement Form. Motion carried.
72586 - DeWayne Eilers said he would like to see the easements before Council
took action.
Moved by Bowers, seconded by Roehr that communication from Plan and
Program Director, transmitting the following easements for Northeast
Sanitary Trunk Sewer Project, be received, placed on file, approved
and accepted, and Clerk instructed to have permanent easements record-
ed:
From Margaret W. Buchen, Robert J. Etringer and Lucille M. Etringer,
two Permanent Maintenance Easements, dated 7/26/77, across parts of
Section 20-89-12W, and two Temporary Construction Easements, dated
7/26/77, across parts of Section 20-89-12W, for sanitary sewer pur-
poses, for the sum of $1,070.00, subject to the conditions of attached

ions and requirements, be received and placed on file. Motion carried.
72589 - Moved by Getty, seconded by Bowers that "Ordinance to amend Ordinance
No. 2479, as amended, the Waterloo Zoning Ordinance, by repealing
Subsection D existing Shopping Centers of Section 2A-33, Part XI
and enacting in lieu thereof a new Subsection D, Minor Site Plan A-
mendment", be received, placed on file, considered and passed for
the third time. Ayes: Seven. Motion carried,
72590 - Moved by Getty, seconded by Lichty that "Resolution fixing a date for
public hearing on adoption of an Ordinance to amend Ordinance No. 2479,
as amended, the Waterloo Zoning Ordinance, by repealing Subsection D
existing Shopping Centers of Section 2A-33, Part XI and enacting in
lieu thereof a new Subsection D, Minor Site Plan Amendment", be a-
dopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 25297.
72591 - The City Council investigated and found that notices of intention to
issue Corporate Purpose Bonds of said City in the aggregate amount
of $1,350,000 had heretofore been published in a newspaper published
and having a general circulation in said City, that this City Coun-
cil met on June 27, 1977, at the time and place specified in said
published notices and conducted a public hearing on the proposal to
issue said bonds, and that no oral or written objections of any kind
having been filed or made to the issuance of said bonds and no petit-
ion or petitions having been filed with the City Clerk asking that the
question of issuing any of said bonds be submitted to the qualified
electors of said City, the hearing on the issuance of said bonds
had been adjourned to the time and place of the present meeting.
Whereupon Councilman Wilharm introduced and caused to be read a
resolution entitled "A Resolution providing for the issuance of
$1,350,000 Corporate Purpose Bonds and providing for the levy of taxes
to pay the same."
Moved by Wilharm, seconded by Roehr that "A resolution providing for
the issuance of $1,350,000 Corporate Purpose Bonds and providing for
the levy of taxes to pay the same", be adopted. Ayes: Seven. Reso-
lution adopted and upon approval by the Mayor, assigned No. 25298.

72592 Moved by Dowie, seconded by Lichty that communication from Water Pol-
lution Control Plant Superintendent, reporting resignation of Dennis
Downs as of August 1, 1977, from the Water Pollution Control Plant,
and entitlement of 278 hours 40 minutes of sick leave pay and one
week vacation pay, be received, placed on file and "Resolution ap-
proving payment of $1,647.50 to Dennis Downs, Water Pollution Con-
trol Plant employee", adopted. Ayes: Seven. Resolution adopted
and upon approval by Mayor, assigned No. 25299.
