The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on August 15, 1977. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr,
Wilharm. Absent: None. Invocation by Councilman Geiger.
72650 - Moved by Roehr, seconded by Bowers that the Agenda, as proposed, for
the Regular Session of August 15, 1977 at 7:00 P.M., be accepted and
approved. Motion carried.
72651 Moved by Bowers, seconded by Lichty that the Minutes of the Regular
Session held August 8, 1977 at 7:00 P.M., be approved. Motion carried.
72652 - Moved by Roehr, seconded by Lichty that proof of publication of notice
of public hearing on rezoning, upon amended request of Neva and Harry
Petersen, Jr., upon recommendation of City Zoning Commission, and
Council's own motion, to rezone from "A-1" Agricultural District to
"R-4" Multiple Residence District approximately 8 acres of unplatted
land in Section 28 -89N -13W, located south of Huntington Road between
Scott Avenue and proposed Hackett Road By -Pass, as published in Water-
loo Courier on 7/28/77, be received and placed on file. Motion car-

Sunday Sales Beer Permit Application for consideratinn tonight.
Moved by Getty, seconded by Geiger that the above application be added
to the agenda under "Miscellaneous - Sunday Sales - Beer Permits - Class
C" on page 3. Motion carried.

72659 - Agnes Robertson inquired if FY 1978 Maywood Water Extension would be
constructed this year and was informed official approval of federal
government was received today.
72660 - Agnes Robertson inquired as to progress being made on the proposal to
reduce garbage pick-ups to once a week and the fee to $1.00 per month.
She stated many citizens preferred twice weekly pick-ups with $2.00
per month fee and no refunds. Mayor Rooff responded that because there
was some abuse of the rebates, the City should not stop the function
as some people needed it, but would try to eliminate those who were
unfair.
72661 - Joe Weissman of Community Development Board presented two Offers of
Grants from the Economic Development Administration, which had to be
accepted and in the Denver office by August 22, 1977, and was addition-
al money for the projects.
Moved by Roehr, seconded by Geiger that communication from Community
Development Administrator, transmitting an Offer of Grant approved by
Economic Development Administration of the U.S. Department of Commerce
in the amount of $28,000 for construction of service facilities at
Martin Park, and recommending approval and acceptance, be received,
placed on file and "Resolution approving and providing for the execu-
tion of Offer of Grant for Project No. 05-51-26501 by and between City
of Waterloo, Iowa and the U.S. Department of Commerce", adopted. Ayes:
Seven. Resolution adopted and upon approval by Mayor, assigned No.
25322.
72662 - Moved by Bowers, seconded by Lichty that communication from Coumrunity
Development Administrator, transmitting an Offer of Grant approved by
Economic Development Administrator of the U.S. Department of Commerce
in the amount of $60,800 for construction of Water Main in the Maywood
Area, and recommending approval and acceptance, be received, placed
on file and "Resolution approving and providing for the execution of
Offer of Grant for Project No. 05-51-20320 by and between the City of
Waterloo, Iowa, and the U.S. Department of Commerce", adopted. Ayes:
Seven. Resolution adopted and upon approval by Mayor, assigned No.
25323.
72663 - Bernard Stroh, spokesman for Highland area group, stated their request
for a "stop" sign had been presented to the traffic control department
and they were told there was not sufficient traffic. He explained this
was a bad location and very hazardous as the four lots at the corner
had hedges and he expressed concern for the safety of the children;
also, it was wish of the neighborhood for a four way stop sign and
there were no objections. Mayor Rooff reported Quinton Parker had looked
at the location and did not recommend a stop sign. Accidents and fre-
quency was discussed.
Moved by Getty, seconded by Geiger that the petition from Bernard J.
Stroh, 132 Alta Vista Avenue, et al, residents of neighborhood known
as Highland, requesting a "stop" sign at the intersection of Arizona
Street and Alta Vista Avenue, be received, placed on file and approved.
Motion carried.
72664 - Moved by Dowie, seconded by Bowers that communication from Plan and
Program Director, transmitting a request from Sydney A. Thomas, Attorn-
ey, proposing the acceptance of certain existing streets within an
area legally known as the Lichty-Orange Addition by the City of Water-
loo as a part of the Waterloo Street System, be received, placed on file
and "Resolution accepting certain parcels in the City of Waterloo for
street purposes", adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor, assigned No. 25324.
72665 - Moved by Roehr, seconded by Dowie that the offer of C. Harold Truax,
636 Conger Street, and Frank T. Christie, Cedar Falls, Iowa, to purchase
Disposal Parcel No. A -20-B in Westfield -Virden Urban Renewal Area,
Project No. Iowa R-7, 117 Center Street, for the sum of $3,000 for pro-
cessing and retail outlet for building stone purposes, and approval re-
port of Community Development Board, be received, placed on file, "A
resolution authorizing the sale of Disposal Parcel No. A -20-B in the
Westfield Virden Urban Renewal Area, Project No. Iowa R-7", adopted and
hearing set for September 19, 1977 at 7:00 P.M. in Council Chambers in

131 Russell Road, to purchase Disposal Parcel No. H-5, in Westfield -
Virden Urban Renewal Area, Project No. Iowa R-7, 221 Jefferson Street,
for the sum of $9,000 for private parking purposes, and approval report
of Community Development Board, be received, placed on file, "A reso-
lution authorizing the sale of Disposal Parcel No. H-5 in the Westfield -
Virden Urban Renewal Area, Project No. Iowa R-7", adopted and hearing
set for September 19, 1977 at 7:00 P.M. in Council Chambers in City Hall.

72667 - Moved by Roehr, seconded by Lichty that request of Ernest Lang for va-
cation of portion of Ralph Road lying adjacent to Lots 21, 24, 25, 28,
29, and 32, Lobdell's Second Addition with sale and conveyance of cer-
tain parcels to Herbert G. Smith, Robert M. and Judith K. Winters, James
H. Tainor, Sr. and Ernest Lang, as shown on attached plat, for $37.50,
$135.00, $102.00 and $1.00 plus other valuable considerations, respec-
tively, and Plan and Program Commission's recommendation for approval
subject to retention of a utility easement, be received, placed on file,
and "Resolution fixing the time and place of hearing as September 6,
1977, on proposal to vacate sell and convey certain real property to

for permission to construct one 24' commercial curb cut and approach

as shown on attached plat, and City Engineer's recommendation for ap-
proval subject to the provisions of his letter, be received, placed on
file, recommendations approved and permission granted in accordance
therewith. Motion carried.
72669 - Moved by Bowers, seconded by Getty that request from Roosevelt Roby,
Jr. for permission to construct a 24' commercial curb cut at 201 Lin-
coln Street, as shown on attached plat, and to concrete a small area
of the parking for beautification purposes only, not to be used as
parking, and City Engineer's recommendations for approval subject to
the provisions of his letter, be received, placed on file, recommenda-
tions approved and permission granted in accordance therewith. Motion
carried.
72670 - Moved by Geiger, seconded by Wilharm that request from Donald R. Holt
for permission to construct a temporary asphalt driveway at 146 Lichty
Boulevard without regard to sidewalk grade, together with $3.00 for
recording waiver, and City Engineer's recommendations for approval
subject to the provisions of his letter, be received, placed on file,
approved and "Resolution granting permission to Donald R. Holt and
authorizing construction of a temporary asphalt driveway at 146 Lichty
Boulevard irrespective of a later official grade", adopted. Ayes:
Seven.. Resolution adopted and upon approval by Mayor, assigned No.

72671 - Upon the request of Lucille Henkle, the report of Quinton T. Parker
was read. Mayor Rooff explained the Highway Commission would have
to give its permission for the installation of a signal. Discussed
was a new survey scheduled for this year, heavy truck traffic, the
elderly unable to cross to the grocery store, safety hazard to children
catching school bus, the survey should cover the trouble and problems
at 7:00 A.M. and again between 3:00 and 4:00 P.M.
Moved by Wilharm, seconded by Getty that the communication from the
Sign & Traffic Maintenance Department, reporting on the petition of
Lucille Henkle, 731 Vinton Street, et al, concerned citizens of the
Independence Avenue and Vinton Street area, for traffic lights with
left turn signal at this corner, etc., referred to it under Council
Action #72616 of 8/8/77, together with recommendations, be received,
placed on file, a new traffic count ordered to be taken and action
deferred until the report is brought back to the Council. Motion
carried.
72672 - Moved by Geiger, seconded by Dowie that the minutes of the Community
Development Board for regular meeting of July 5, 1977, be received
and placed on file. Motion carried.

72673 - Under Council Action #72615 of 8/8/77, consideration of selling Dis-
posal Parcel I-22, known as 307 East Mullan Avenue, to Alan and Susan
Brase was to be placed on this week's agenda.
Moved by Dowie, seconded by Bowers that petition of Alberta Lininger,
303: East Mullan Avenue, et al, objecting to the sale of Disposal Par-
cel I-22, known as 307 Mullan Avenue, to Alan Brase for the purpose
of moving thereon an old two story house, be received and placed on
file. Motion carried.
72674 - Mayor Rooff reported HUD's response was that the removal of a deter-
iorated substandard structure onto an urban renewal site was contrary
to the local urban renewal plan, and should such action take place,
it would be a flagrant violation of the local urban renewal plan and
urban renewal grant agreement; but should the Council approve this,
it should seek assurances for completion of development to city codes
within a reasonable time period, which could be accomplished by re-
quiring the developer to post bond and City establish a time period
for completion; and that HUD would monitor the City's actions.
The Mayor stated that the requirement of a financial statement from a
bank or lending institution had not been met by Mr. Brase; he con-
curred with HUD that a bond should be set and a time period for com-
pletion. A discussion followed covering financial statement require-
ment; structure being substandard and an eyesore; since there was
such a misunderstanding, could another offer be accepted; length of
time taken by Mr. Brase to complete other projects; encouragement by
Community Development to move the structure on the lot before sale
completed; after Council approval, then HUD approval.
Moved by Bowers, seconded by Roehr that the objections of Alberta
Lininger, 303 East Mullan Avenue, et al, to the sale of Disposal
Parcel I-22, to Alan Brase for the purpose of moving thereon an old
two story house, be sustained and the offer of Alan Brase to purchase
said parcel, rejected. Ayes: Bowers, Dowie, Roehr, Wilharm. Nays:
Geiger, Getty, Lichty. Motion carried.
72675 - Moved by Roehr, seconded by Bowers that communication from Plan and
Program Director, transmitting Land Patent No. 2311 and Land Patent
No. 2312, both dated July 12, 1977, from the State of Iowa conveying
unto the City of Waterloo, Iowa two tracts of land in Section 27,
T89N, R13W, be received, placed on file and "Resolution approving
and accepting Land Patent No. 2311 and Land Patent No. 2312 from
the State of Iowa", adopted. Ayes: Seven. Resolution adopted and
upon approval by Mayor, assigned No. 25329.
72676 - Moved by Bowers, seconded by Wilharm that Engineering Services Contract
dated 8/10/77 with Robinson Engineering Company for survey work in
proposed dedication for Rebecca Lane, for an estimated cost not to
exceed $1,000, and City Engineer's recommendation for approval, be
received, placed on file and "Resolution approving the Engineering
Services Contract with Robinson Engineering Company for survey work
in proposed dedication for Rebecca Lane, and directing execution of
said contract by Mayor and City Clerk", adopted. Ayes: Seven. Res-

dated 6/9/77 with Robinson Engineering Company for survey work for
1977 Elm Drive Sanitary Sewer Extension, for a minimum charge of
$150.00, and City Engineer's recommendation for approval, be received,
placed on file and "Resolution approving the Engineering Services Con-
tract with Robinson Engineering Company for survey work for 1977
Elm Drive Sanitary Sewer Extension, and directing execution of said
contract by Mayor and City Clerk", adopted. Ayes: Seven. Resolu-

dated 8/15/77 with Brice, Petrides & Associates, Inc. for Castle Hill
Drainage Study, for an estimated cost not to exceed $18,152, and City
Engineer's recommendation for approval, be received, placed on file
and "Resolution approving the Engineering Services Contract with Brice,
Petrides & Associates, Inc. for Castle Hill Drainage Study, and
directing execution of said contract by Mayor and City Clerk", adopted.

72679 - Moved by Bowers, seconded by Getty that Change Order No. 1 for FY
1977 Paving Program, Contract No. 157, for additional work done by
Cedar Valley Corporation at an additional cost of $61,603.90 and
City Engineer's recommendation for approval, be received, placed
on file, approved and Mayor and Clerk authorized to execute same.

72680 - Moved by Bowers, seconded by Roehr that communication from Plan and
Program Director, transmitting Permanent and Temporary Easements,
dated 8/8/77, from Craig H. Mosier, for Anthony Street in the 1977
Paving Program, be received, placed on file, approved and accepted
and Clerk instructed to have Permanent Easement recorded. Motion
carried.
72681 - Moved by Bowers, seconded by Lichty that communication from Plan and
Program Director, transmitting Permanent and Temporary Easements, dated
8/8/77, from Ida Ruth Mae Tillman for Anthony Street in the 1977
Paving Program, be received, placed on file, approved and accepted
and Clerk instructed to have Permanent Easement recorded. Motion
carried.
72682 - Mayor Rooff stated that barbers and beauticians should be treated
the same, either they should all be licensed or all not licensed.
Carroll Anderson representing the barbers, and Shirley Johnson repre-
senting the beauticians, vigorously opposed dual inspection by the
State and City. Keith Rankin, executive secretary of the State Barber
Board, Department of Health, reported the State Office did not feel
there was a need for dual inspection; offered the services of said
Board, which was the only one who could suspend or revoke a license;
offered to forward copies of the State inspections to the City;
stated the barber must pay a fee for himself, for his shop and contin-
ue his education, and this could be a burden. A discussion followed
covering State inspector would be here within three days upon request;
"kitchen" operations being looked into; services performed to be paid
by users. Sanitation Director Hoffman defended the need for the or-
dinance for entry purposes for sanitation and health reasons.
Moved by Roehr, seconded by Bowers that "An Ordinance to amend Ordin-
ance No. 1453, providing sanitary and health regulations for barber-
shops and establishments by repealing in its entirety, Section 4,
known as Section 23-16 Barbershops: License required; License fee;
when inspection required; fees, in the Code of Ordinances, City of
Waterloo, Iowa, and enacting in lieu thereof a new Section 4, known
as Section 23-16 in the Code of Ordinances", be received, placed on
file, considered and passed for the second time. Ayes: Bowers,
Dowie, Getty, Roehr, Wilharm. Nay: Lichty. Geiger: Declined to
vote by reason of possible conflict of interest under Section 362.4
of Code of Iowa. Motion carried.

ed to prepare plans and specifications, form of contract, etc. for
the FY 1978 Maywood Water Extension, Minor Contract No. 95. Motion
