HomeMy WebLinkAbout08/22/1977August 22, 1977 The Council of City of Waterloo, Iowa, met in Regular Session in Council Chambers in City Hall at 7:00 P.M. on August 22, 1977. Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr, Wilharm. Absent: None. Invocation by Councilman Getty. 72695 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of August 22, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 72696 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held on August 15, 1977 at 7:00 P.M., be approved. Motion carried. 72697 - Moved by Roehr, seconded by Getty that the proof of publication of Notice of public hearing on a proposal to issue Revenue Bonds under Chapter 419, Iowa Code, providing for municipal support of indus- trial projects ($4,600,000 - Allen Memorial Hospital Corporation), in the City of Waterloo, Iowa, published in Waterloo Courier on August 4, 1977, be received and placed on file. Motion carried. 72698 - The City Council investigated and found that notice of intention to issue $4,600,000 Revenue Bonds (Allen Memorial Hospital Corporation) of said City had according to law and as directed by the City Coun- cil, been duly given by publication on August 4, 1977 in the "Water- loo Courier", a legal newspaper published and having a general cir- culation within said City. This being the time and place specified in said notice for the conduct of a public hearing on the proposal to issue said bonds, the Mayor announced that any local resident attending the hearing would now be given an opportunity to express his views for or against the proposal to issue the bonds. After all local residents who appeared at the hearing, who desired to do so, had expressed their views for or against the proposal to issue the bonds, it was Moved by Dowie, seconded by Geiger that this hearing be and the same is hereby adjourned to September 6, 1977 at 7:00 P.M. at the Council Chambers in the City Hall in said City at which time and place this Council will take up and consider a resolution initiating proceedings for the issuance of said bonds, etc. Ayes: Seven. Motion carried. 72699 - Moved by Roehr, seconded by Bowers that proof of publication of notice of public hearing on Adoption of "An Ordinance to amend Ordin- ance No. 2479, as amended, the Waterloo Zoning Ordinance by repeal- ing Subsection D Existing Shopping Centers of Section 2A-23, Part XI and enacting in lieu thereof a new Subsection D, Minor Site Plan Amendment", as published in Waterloo Courier on 8/4/77, be received and placed on file. Motion carried. 72700 - The Mayor announced it was time for public hearing and called for oral and written objections, and there were none. Moved by Dowie, seconded by Bowers that "Resolution adopting an Amendment to Ordinance No. 2479, as amended, The Waterloo Zoning Ordinance by repealing Subsection D Existing Shopping Centers of Section 2A-23, Part XI and enacting in lieu thereof a new Subsec- tion D, Minor Site Plan Amendment, in a loose leaf complete munici- pal code form", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25335. 72701 - Moved by Roehr, seconded by Wilharm that "An Ordinance to amend Or- dinance No. 2479, as amended, The Waterloo Zoning Ordinance by re- pealing Subsection D Existing Shopping Centers of Section 2A-23, Part XI and enacting in lieu thereof a new Subsection D, Minor Site Plan Amendment", be received, placed on file, considered and the rules requiring ordinances to be received, placed on file, consid- ered and voted on at two prior meetings suspended, and the above Ordinance recorded as having been considered and passed for the first, second and third times, and now placed on its final adoption. Ordinance adopted and upon approval by Mayor, assigned No. 2913. 72703 - Moved by Dowie, seconded by Bowers that proof of publication of no- tice of public hearing on proposal to dispose of a part of Lot 56, Lewis Miller's Small Farms Addition, as more fully described in Waterloo Courier on 8/11/77, to Donald and Susan M. Thompson, be re- ceived and placed on file. Motion carried. 72704 - This being the time for hearing, the Mayor called for written and oral objections, and there were none. Moved by Roehr, seconded by Getty that "Resolution authorizing the sale and conveyance of a part of Lot 56, Lewis Miller's Small Farms Addition, as more fully described in Waterloo Courier publication of 8/11/77, to Donald and Susan M. Thompson, for the sum of $127.50 plus costs, and directing and authorizing the Mayor and Clerk to execute and deliver a deed for said property", be adopted, with City retention of a ponding easement. Ayes: Seven. Resolution a- dopted and upon approval by Mayor, assigned No. 25336. 72705 - Moved by Getty, seconded by Lichty that proof of publication of no- tice of public hearing on proposal to vacate, sell and convey to Kenneth G. Meyerhoff Trust, to Arthur Tomlin and to MFC Corporation All of Nly-Sly alley between SWly line of Grant Avenue and NEly line of Allen Street between West Fifth Street and West Fourth Street, all in Block 6, Miller's Addition, as published in Waterloo Courier on 8/5/77, for $0.10 per square foot plus costs, be received and placed on file. Motion carried. 72706 - This being the time for hearing, the Mayor called for written and oral objections, and there were none. Moved by Bowers, seconded by Dowie that "Ordinance vacating All of Northerly -Southerly alley between Southwesterly line of Grant Ave- nue and Northeasterly line of Allen Street between West Fifth Street and West Fourth Street, all in Block 6, Miller's Addition", be re- ceived, placed on file, considered and passed for the first time. Ayes: Bowers, Dowie, Geiger, Getty, Lichty. Nays: Roehr and Wil - harm. Motion carried. 72707 - Terry Culpepper, 1731 Cottage Grove Avenue, asked if everyone who signed for Maywood water would get water. A discussion followed which brought out that all but perhaps two or three houses would get water, the Maywood water installation would be completed in two contracts, one now and another in a few weeks. Mayor Rooff pointed out that the houses which were already built would be taken care of and it was not the City's intent to serve lots on which houses might be built in the future, and these future houses could be served by hook -on at builder's expense. 72708 - Moved by Roehr, seconded by Lichty that request of Howard Berland for Kenny Corporation for vacation, sale and conveyance of certain excess right-of-way in part of Section 30-89-12 in the vicinity of Idaho Street and Butler Street, as shown on attached plat, for $600 plus costs, and Plan and Program Commission's recommendation for approval subject to City Code requirements and City Engineer recommendation of a 25 foot set back line along the I.C. R.R. tracks be received, placed on file and "Resolution fixing the time and place of hearing as September 12, 1977 on proposal to vacate, sell and convey certain real property to Kenny Corporation", adopted and Clerk instructed to publish notice of hearing. Motion carried. 72712 - Moved by Geiger, seconded by Dowie that request from Cecil Burns Company for permission to construct one commercial curb cut at 516 Wildwood Road, to serve an 8-plex apartment building, as shown on attached sketch, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Stevens for peimission to construct a temporary asphalt driveway at 1146 Ohio Street without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Gerald C. Stevens and authorizing construction of a temporary as- phalt driveway at 1146 Ohio Street irrespective of a later official grade", adopted. Ayes: Seven. August 22, 1977 - 4 - 72715 - Under Council Action #72671 of 8/15/77, action was deferred on petition of Lucille Henkle, et al, for traffic lights, etc. at Independence Avenue and Vinton Street. Mayor Rooff read the traffic report and recommended that the City Engineer be instructed to request the Iowa Department of Transpor- tation to investigate the intersection for a traffic light instal- lation. Several area residents reported they took a traffic count on 8/19/77 of 144 cars per hour crossing Vinton Street, spoke in support of the lights and presented a petition. City Engineer Radue explained the 24 hour formula used by the State in determining the traffic figures, Mayor Rooff asked for a copy of the citizens' count so this also could be forwarded to the State and once again repeated his recom- mendation that the State be requested to install said lights. Moved by Bowers, seconded by Lichty that the traffic count report of Quintin Parker, Sign & Traffic Maintenance Department, at the intersection of Independence Avenue and Vinton Street, and the above petition of support, be received, placed on file, the Mayor's recommendations approved and the City Engineer instructed to re- quest the Iowa Department of Transportation to install traffic lights at said intersection. Motion carried. 72716 - Moved by Roehr, seconded by Bowers that communication from Community Development Administrator, transmitting an Audit Report for Commun- ity Development Block Grant Fund for 5/1/75 thru 4/30/77 as submit- ted by Den Hartog & Hogan Company, P.C., Certified Public Account- ants, be received and placed on file. Resolution adopted and upon ap- proval by Mayor, assigned No. 25339. 72720 - Moved by Dowie, seconded by Lichty that communication from Community Development Administrator, transmitting an Offer of Grant approved by Economic Development Administrator of the U.S. Department of Commerce in the amount of $1,203,850 for paving of Idaho Street and Newell Street and the widening of Independence Avenue, and recom- mending approval and acceptance, be received, placed on file and "Resolution approving and providing for the execution of Offer of Grant for Project No. 05-51-20254 by and between the City of Water- loo, Iowa, and the U.S. Department of Commerce", adopted. Resolution adopted and upon approval by Mayor, assigned No. 25340. 72721 - Mayor Rooff reported an Offer of Grant for the City Hall Annex from the U.S. Department of Commerce would be received shortly and asked permission to execute said Agreement. Resolution adopted and upon approval by Mayor, as- signed No. 25346. 72730 - Shirley Chapman, president of Waterloo branch of National Associa- tion of Hairdressers and Cosmetologists, vigorously protested the licensing by City and dual inspections, and was supported by Jean Redmon, Harriet Frank and others. A discussion followed on barbers being discriminated against; cost of inspections to City; new State licensing of salons be given a change; leased chairs not licens- ed, only the shop; leased operators violating regulations could cause shop owner license revocation; raise in rates. Sanitation Director Hoffman stated the City would have better con- trol by licensing and supported the proposed ordinance. Moved by Roehr, seconded by Wilharm that "An Ordinance to amend Ordinance No. 1453, providing sanitary and health regulations for barbershops and establishments by repealing in its entirety, Section 4, known as Section 23-16 Barbershops; License required; License fee; when inspection required; fees, in the Code of Ordinances, City of Waterloo, Iowa, and enacting in lieu thereof a new Section 4, known as Section 23-16 in the Code of Ordinances", be received, placed on file, considered and passed for the third time. Ordinance adopted and upon approval by Mayor, assigned No. 2917. 72738 - Mayor Rooff reported that he and Councilman Geiger inspected the area and recommended suspension of rules and adopting amendment to Traffic Ordinance as the conditions at West Second Street, Vermont Street and Sullivan Avenue were very bad and hazardous and that one stop sign at Sullivan Avenue and one at Johnson Street be in- stalled immediately. Moved by Getty, seconded by Lichty that "An Ordinance amending Or- dinance No. 2644, known as the Traffic Ordinance, by repealing Sub- section 88, Second Street (West) of Section 543, Thru Streets, and enacting in lieu thereof new Subsection 88, Second Street under Section 543, Thru Streets", be received, placed on file, considered and passed for the first time. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25347. 72742 - Moved by Roehr, seconded by Geiger that communication from Community Development Administrator, transmitting a proposed resolution for City acceptance of responsibilities of operation and maintenance of C and D of Local Flood Protection Project, and recommending approval, be received, placed on file and "Resolution authorizing the Mayor to accept on behalf of the City of Waterloo, Iowa, effective August 24, 1977, the assumption of operation and maintenance responsibilit- ies for the flood protection devices constructed as Construction Mitigation, Reaches C and D of the Corps of Engineers Flood Control Project", adopted. Resolution adopted and upon ap- proval by Mayor, assigned No. 25348. 72743 - Moved by Bowers, seconded by Wilharm that statement from Brice, Petrides & Associates, Inc. for engineering services for Comprehen- sive Drainage Study, and City Engineer's recommendation for approval, be received, placed on file and "Resolution accepting the statement dated 8/4/77 from Brice, Petrides & Associates, Inc. for engineering services for Dry Run Creek, Blowers Creek and Other Related Drainage Work Study, and authorizing payment accordingly", adopted.
