The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on July 5, 1977. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Dowie, Geiger, Getty, Roehr, Wilharm. Absent:
Lichty. Invocation by Councilman Geiger.
72392 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for
the Regular Session of July 5, 1977 at 7:00 P.M., be accepted and ap-
proved. Motion carried.
72393 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular
Session held June 27, 1977 at 7:00 P.M. and the Special Session of
June 28, 1977 at 4:00 P.M., be approved. Motion carried. -
72394 - Moved by Roehr, seconded by Wilharm that the proof of publication of
notice of public hearing on plans, specifications, form of contract
and estimate of cost for Electrical Repairs to the West Side Parking
Ramp and the taking of bids, be received and placed on file. Motion
carried.
72395 - This being the time and place for hearing, Mayor called for oral and
written objections, and there were none.
Moved by Wilharm, seconded by Roehr that "Resolution confirming ap-
proval of plans, specifications, form of contract, estimated cost,
etc. for Electrical Repairs to West Side Parking Ramp, Minor Contract
No. 93", be adopted. Ayes: Six. Absent: Lichty. Resolution a-
dopted and upon approval by Mayor, assigned Noe 25244.
72396 - Moved by Bowers, seconded by Getty that "Resolution ordering the con-
struction of Electrical Repairs to West Side Parking Ramp, Minor Con-
tract No. 93", be adopted. Ayes: Six. Absent: Lichty. Resolution
adopted and upon approval by Mayor, assigned No. 25245.
72397 Moved by Wilharm, seconded by Dowie that the following bids, be re-
ceived, placed on file, Clerk instructed to open same and referred

72398 - Mayor Rooff reported the City of Waterloo was sponsoring a new Scout
Explorers group and welcomed Scott McDonald and Mark Freudenberg.
72399 - Ray Mayes dba Braley's, Inc., 403 Jefferson Street, presented an ap-
plication, bond and fee for a license to conduct a Going -Out -Of -
Business or Liquidation Sale.
Moved by Roehr, seconded by Geiger that the above application, be
received, placed on file and license granted. Motion carried.
72400 - City Attorney Smith introduced Tim Luce, the new Assistant City At-
torney and Mayor Rooff welcomed him.
72401 - Moved by Getty, seconded by Geiger that request from Alice H. Kline
and Lillian A. Kline, 219 Allen Street, for permission to construct
a railing from the lower step of the house to the curb of the street,
with the property owners to assume the proper insurance coverage,
and City Engineer's recommendation for approval subject to the pro-
visions of his letter, be received, placed on file, recommendations
approved and permission granted in accordance therewith. Motion
carried.

72402 - Moved by Roehr, seconded by Geiger that request from Peoples Bank
and Trust Company for permission to construct three commercial curb
cuts, two on Bluff Street and one on West Fourth Street, to serve
new Drive -In facility at 405 West Fourth Street, as shown on at-
tached plat, and City Engineer's recommendation for approval subject
to the provisions of his letter, be received, placed on file, recom-
mendations approved and permission granted in accordance therewith.
Motion carried.
72403 - Moved by Dowie, seconded by Bowers that request from Robert Schatz
for permission to construct a temporary asphalt driveway at 1632
Easton Avenue without regard to sidewalk grade, together with $3.00
for recording waiver, and City Engineer's recommendations for ap-
proval subject to the provisions of his letter, be received, placed
on file, approved and "Resolution granting permission to Robert
Schatz and authorizing construction of a temporary asphalt driveway
at 1632 Easton Avenue irrespective of a later official grade", a-
dopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon
approval by Mayor, assigned No. 25246.
72404 - Under Council Action #72347 of 6/27/77 action was deferred on the
petition of James M. Penne, 34 Elm Drive, et al, for the City to
take possession, and maintain Elm Drive as a public street, and
Plan and Program Commission's recommendation for denial until all
adjacent property owners are in favor of dedication. Opposed was
Gunther Maser and in support were Grace Burington and Mr. and Mrs.
James Penne. Discussed was increased traffic, blocking off resi-
dents access, fire and police protection and other city services.
Plan and Program Director Franke stated four residents wanted the
dedication and two did not. It was suggested that this year the
City put in the sewer and then, next year review street improvements,
which would have to meet minimum requirements.
Moved by Wilharm, seconded by Bowers that the above petition of
James M. Penne, et al, be denied. Motion carried.
72405 - The Engineers reported the bid of Paulson Electric Company, of
Waterloo, Iowa in the amount of $32,666.00 was the lowest bid re-
ceived for Minor Contract No. 93.
Moved by Roehr, seconded by Dowie that "Resolution making award
of contract for Electrical Repairs to West Side Parking Ramp, Minor
Contract No. 93, or accepting the low bid of Paulson Electric Com-
pany of Waterloo, Iowa in the sum of $32,666.00", be adopted. Ayes:
Six. Absent: Lichty. Resolution adopted and upon approval by
Mayor, assigned No. 25247.
72406 - Under Council Action #72336 of 6/27/77 action was deferred on ac-
ceptance of (1) The Family Guard -M self insuring proposal of the
Guardian Life Insurance Co. of America, New York, N.Y., subject to
the Council agreeing to give an additional benefit to all City em-
ployees of $10,000 life insurance which is mandatorily included in
their bid, and (2) the Group UAW Prototype Dental proposal for
Union Local 1127 and Waterloo Police Department of Aetna Life &
Casualty Company.
Mayor Rooff called for the bidders to present their proposals on
accident and health insurance.
Paul Rose for Blue Cross/Blue Shield stated his proposal matched
the specifications, the benefits were explained, and monthly rates
were: Single $38.10, Family $97.75.
Robert Hall for Guardian Life Insurance Company stated his proposal
met the specifications in all areas, including mental, and in many
areas exceeded the specifications, the benefits were explained which
included $10,000 life insurance for each employee, and monthly rates
were: Single $38.60, Family $92056.
A discussion followed, both bidders stated their companies would
handle all details of claims, etc. with no extra work on the City's
part; accident and health and life insurance convertible upon re-
tirement, etc. Bob Scharnweber, not supporting either company,
asked that the City be sure of what they were purchasing. Age 65 and
over supplemental coverage to Medicare was brought up and both bid-
ders explained their coverage. Tom Pierce asked that mental coverage

not be different than present.
Moved by Bowers, seconded by Wilharm that the City of Waterloo place
its accident and health insurance, as shown in the proposal, with
Blue Cross/Blue Shield, effective August 1, 1977 for a eleven month
period to expire June 30, 1977. Ayes: Bowers. Geiger, Roehr, Wil -
harm. Dowie: Declined to vote by reason of possible conflict of in-
terest under Section 362.6 of Code of Iowa. Nay: Getty. Absent:
Lichty. Motion carried.
72407 - Mayor Rooff called for the bidders to present their proposals on
dental insurance.
Paul Rose for Blue Cross/Blue Shield explained the benefits in the
proposal for Local 1127, which matched the specifications, and quoted
monthly rates of Single $6.24 and Family $16.74. For the Police spec-
ifications, which had additional benefits, the monthly rates were
Single $8.43 and Family $27.11.
Dave Lansing for Aetna Life and Casualty explained the benefits in
the proposal for Police and quoted monthly rates of Single $7.69 and
Family $21.88. Local 1127 coverage was explained and monthly rates
quoted of Single $7.79 and Family $20.82.
Mayor Rooff stated the final cost figures were Aetna $56,823.96 and
Blue Cross/Blue Shield $58,788.16. He asked the Aetna representative
if an individual outside of the groups, who would pay his own premium,
would be allowed to join the program, and this was to be checked with
the company.
Moved by Getty, seconded by Bowers that the City of Waterloo place
its dental insurance for Local 1127 and the Police with Aetna Life
and Casualty, effective August 1, 1977 for an eleven month period
to expire June 30, 1977. Ayes: Bowers, Geiger, Getty, Roehr, Wil-
hatta. Dowie: Declined to vote by reason of possible conflict of
interest under Section 362.6 of Code of Iowa. Absent: Lichty.
Motion carried.
72408 - Under Council Action #72270 of 6/20/77, consideration was to be given
for additional funds for the Library Board as promised at the FY 1977
Budget hearing if additional funds became available.
Moved by Dowie, seconded by Geiger that the request be received,
placed on file and $8,000 added to the Library Board budget from
revenue sharing funds, approved. Ayes: Six. Absent: Lichty.
Motion carried.
72409 - Under Council Action #72271 of 6/20/77 consideration was to be given
to replacement of the roof on McElroy Auditorium.
Mayor Rooff reported the total cost, which included insulation, would
be paid $12,500 by Dairy Cattle Congress, $10,000 concession fund,
$20,000 general fund, and $37,500 by City in next four years.
Moved by Wilharm, seconded by Roehr that replacement of the roof on
Mc Elroy Auditorium in keeping with the lease agreement, with the
total cost to be $80,000, with the City of Waterloo to pay $20,000
from general fund and $37,000 to be paid over the next four years,
be approved. Ayes: Dowie, Geiger, Getty, Roehr, Wilharm. Bowers:
Declined to vote by reason of possible conflict of interest under
Section 362.6 of Code of Iowa. Absent: Lichty. Motion carried.
72410 Moved by Roehr, seconded by Getty that Architectural Agreement dated
6/23/77 with Stenson, Warm & Grimes, Architects, Inc., for design of
City Hall Annex Addition on Sixth and Franklin Streets, and City En-
gineer's recommendation for approval, be received, placed on file and
"Resolution approving Architectural Agreement with Stenson, Warm &
Grimes, Architects, Inc. for design of City Hall Annex Addition of
Sixth and Franklin Streets and directing execution of said contract
by the Mayor and City Clerk", adopted. Ayes: Six. Absent: Lichty.

72411 - Moved by Roehr, seconded by Bowers that communication from Community
Development Administrator, transmitting Contract and Bond for Con-
tract No. 160, be received, placed on file and "Resolution approving
the Contract and Bond of Cedar Falls Construction Co., Inc. for the
Sans Souci Bridge Approaches, Westfield -Virden Urban Renewal Project
R-7, Contract No. 160", adopted. Ayes: Six. Absent: Lichty. Res-
olution adopted and upon approval by Mayor, assigned No. 25249.
72412 Moved by Roehr, seconded by Getty that the Bituminous Casualty Cor-
poration Policy No. WC 542 296 for Workmen's Compensation and Em-
ployers' Liability Policy for period of 7/1/77 to 7/1/78 for the
City of Waterloo, Iowa, for a premium in the amount of $98,414,
subject to later audit, be received, placed on file and "Resolution
accepting Bituminous Casualty Corporation Policy for Workmen's Com-
pensation and Employers' Liability, etc. and directing and author-
izing payment therefor", adopted. Ayes: Bowers, Geiger, Getty,
Roehr, Wilharm. Dowie: Declined to vote by reason of possible
conflict of interest under Section 362.6 of Code of Iowa. Absent:
Lichty. Resolution adopted and upon approval by Mayor, assigned No.
25250.
72413 - Mayor Rooff recommended the following changes be made in the Fringe
Benefit Program:
1. Under Item 3. Vacation Leave: Second sentence, strike the words
"appointment by the Mayor" and insert in lieu thereof the words
"one full year of service".
2. Under Item 4. Sick Leave (on Page 2): the renumeration stipu-
lations to follow union contracts.
3. Add Item 6: Non-union secretaries (those not eligible for union
membership) shall receive the same benefits as Teamsters contract.
Gene Bernstein in behalf of the Assistant Fire Chiefs, who were non-
voting members of the Firefighters Association and not included in
collective bargaining benefits, objected to the fringe benefits not
being as good as those of the fire deparLment union contract.
Mayor Rooff stated the benefits in the program were the minimum and
the Chiefs and Assistants would receive the same benefits as the
union contract.
Clerk Gibbs inquired if other department heads and assistants would
receive the same benefits as the union contract governing their de-
partments
Moved by Wilharm, seconded by Bowers that the communication from
the Personnel Assistant, transmitting the Fringe Benefit Program
entitled to all Directors and Assistant Directors in the employment
of the City of Waterloo, and recommendation for adoption, and
Mayor Rooff's above recommendations, be received, placed on file,
Mayor Rooff's recommendations approved and "Resolution adopting the
Fringe Benefit Program entitled to all Directors and Assistant Dir-
ectors", adopted. Ayes: Six. Absent: Lichty. Resolution adopted
and upon approval by Mayor, assigned No. 25251.
72414 - Moved by Roehr, seconded by Getty that the objections of Harry Peter-
sen, Jr. for denial of conditional zoning on Kimball Avenue between
Cornwall Avenue and Terrace Drive to allow construction of two tri-
plexes, be received and placed on file. Motion carried.
72415 - Moved by Dowie, seconded by Bowers that the revised plans for proposed
Tri-plex Residence for Lots 1, 2 and 3, Kimball Heights Replat, lo-
cated on east side of Kimball Avenue between Cornwall Avenue and
Terrace Drive, be received and placed on file. Motion carried.
72416 - Moved by Getty, seconded by WilhaLm that "An Ordinance amending Or-
dinance No. 2479, as amended, by adding Sub -Section No. 120 to
Section 2A-5, conditional zoning certain property", be received,
placed on file, considered and passed for the third time. Ayes:

sale and conveyance of part of Riehl Street located West of the West-
erly line of vacated Riverside Drive, Cedar River Place, to Ralph
and Hazel Thierman for $131.70 plus costs, and directing and author-
izing the Mayor and City Clerk to execute and deliver a deed for said

Country Club for permission to stage a fireworks display at 1600
