On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr, Wilharm. Absent: None. Invocation by Councilman Getty. 72536 - Moved by Roehr, seconded by Getty that the Agenda, as amended, for the Regular Session of July 25, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 72537 Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held July 18, 1977 at 7:00 P.M., and Special Session of July 21, 1977 at 11:00 A.M., be approved. Motion carried. 72538 - Moved by Roehr, seconded by Lichty that proof of publication of no- tice of public hearing on proposal to vacate a portion of Kenyon Street in Riverview Addition, as published in Waterloo Courier on 7/14/77, be received and placed on file. Motion carried. 72539 - This being the time for hearing, Mayor called for oral and written objections, and there were none. Moved by Lichty, seconded by Dowie that "An Ordinance vacating a portion of Kenyon Street in Riverview Addition", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 72540 - Moved by Roehr, seconded by Lichty that the rules requiring ordin- ances to be considered and voted on for passage at two prior meet- ings, be suspended, the above Ordinance recorded as having been con- sidered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 72541 - Moved by Bowers, seconded by Lichty that "An Ordinance vacating a portion of Kenyon Street in Riverview Addition", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2908. 72542 - Moved by Roehr, seconded by Geiger that amended request of Neva and Harry Petersen, Jr. for Council on its own motion to rezone from "A-1" Agricultural District to "R-4" Multiple Residence District approximately 8 acres of unplatted land in Section 28 -89N -13W, loca- ted south of Huntington Road between Scott Avenue and proposed Hack- ett Road By -Pass, as shown on attached plat, and City Zoning Com- mission's recommendation for approval, be received, placed on file, recommendations approved, date of hearing set as August 15, 1977 at 7:00 P.M. and Clerk instructed to publish notice. Ayes: Seven. Motion carried. 72543 Moved by Dowie, seconded by Geiger that request of Robert Smith for William and Viola Peters for Council on its own motion to re- zone from "A-1" Agricultural District to "R-2" One and Two Family Residence District, "R-3" Multiple Residence District and "R-4" Multiple Residence District a 15 acre tract of unplatted land in Section 3 -88N -13W, located north of East San Marnan Drive between St. Francis Drive and Hammond Avenue, as shown on attached plat and legally described in attached Exhibit "A", and City Zoning Com- mission's recommendation for approval, be received, placed on file, recommendations approved, date of hearing set as August 15, 1977 at 7:00 P.M. and Clerk instructed to publish notice. Ayes: Seven. Motion carried. 72544 - Moved by Roehr, seconded by Geiger that request of Leon Lauver and Associates for Council on its own motion to rezone from "C-2" Com- mercial District to "R-4 , R -P" Planned Residence District a tract of unplatted land in Section 21 -89N -13W, located NWly of Water Tower between University Avenue and Carriage Hill Drive, as shown on at- tached plat and legally described in attached Exhibit "A", and City Zoning Commission's recommendation for approval, be received, placed on file, recommendations approved, date of hearing set as August 15, 1977 at 7:00 P.M. and Clerk instructed to publish notice. Ayes: Seven. Motion carried. - 2 - 72545 - Moved by Dowie, seconded by Bowers that request from Jane A. Gaston for permission to construct a temporary concrete driveway at 1241 Dundee Avenue without regard to sidewalk grade, together with $3,00 for recording waiver, and City Engineer's recommendation for ap- proval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting peLmission to Jane A. Gas- ton and authorizing construction of a temporary asphalt driveway at 1241 Dundee Avenue irrespective of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, as- signed No. 25283. 72546 - Moved by Getty, seconded by Geiger that request from Carpetland U.S.A. for permission to construct two commercial curb cuts at 1234 Flammang Drive, as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72547 - Moved by Dowie, seconded by Roehr that the Annual Report of the Building Inspection Department for July 1, 1976 through June 30, 1977, be received and placed on file. Motion carried. 72548 - Moved by Bowers, seconded by Getty that Construction Permit No. 77- 504-S for Sanitary Sewer Extension for John Deere Product Engineer- ing Center from the Iowa Department of Environmental Quality, sub- ject to certain conditions and requirements, be received and placed on file. Motion carried. 72549 - Moved by Roehr, seconded by Geiger that Contract and Bond for Minor Contract No. 93, in the amount of $32,666.00, and Community Develop- ment Commission's recommendation for approval, be received, placed on file and "Resolution approving Contract and Bond of Paulson Elec- tric Company for Electrical Repairs to the West Side Parking Ramp, Minor Contract No. 93", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25284. 72550 - Moved by Dowie, seconded by Bowers that Preliminary Plat of South- land Park, with Deed of Dedication, Report of City Engineer, Plan and Program Commission's resolution of approval, be received, placed on file, and "Resolution approving the Preliminary Plat of Southland Park Second Addition, Waterloo, Iowa, Black Hawk County, Iowa", a- dopted. Ayes: Seven. Resolution adopted and upon approval by Ma- yor, assigned No. 25285. 72551 - Discussed was the ground water drainage problems. Moved by Wilharm, seconded by Getty that Preliminary Plat of West- bourne Terrace Fourth Addition, with report of City Engineer, Deed of Dedication, Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "Resolution approving the Preliminary Plat of Westbourne Terrace Fourth Addition, Waterloo, Black Hawk County, Iowa", adopted. Ayes: Bowers, Dowie, Geiger, Getty, Roehr, Wilharm. Nay: Lichty. Resolu- tion adopted and upon approval by Mayor, assigned No. 25286. 72552 - Moved by Roehr, seconded by Bowers that Final Plat of Audubon Park with Engineer's Certificate of Survey, Deed of Dedication, Contract and Waivers, Report of City Engineer, Plan and Program Commission's resolution of approval and their recouuuendation for Council approv- al, be received, placed on file and "Resolution approving the Final Plat of Audubon Park, Waterloo, Black Hawk County, Iowa", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, as- signed No. 25287. 72553 - Moved by Dowie, seconded by Bowers that "Ordinance to amend Ordin- ance No. 2479, as amended, the Waterloo Zoning Ordinance, by repeal- ing Subsection D existing Shopping Centers of Section 2A-33, Part XI and enacting in lieu thereof a new Subsection D, Minor Site Plan Amendment", be received, placed on file, considered and passed for the second time. Ayes: Seven. Motion carried. July 25, 1977 - 3 - 72554 - The Council discussed the Mayor's salary. Moved by Getty, seconded by Bowers that "An Ordinance the salary of the Mayor of the City of Waterloo, Iowa beginning January 3, 1978, and repealing Ordinance No ceived, placed on file, considered and passed for the Ayes: Seven. Motion carried. 72555 - Moved by Getty, seconded by Wilharm that rules requiring ordinances to be considered and voted on for passage at two prior meetings, be suspended, the above Ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 72556 - Moved by Roehr, seconded by Getty that "An Ordinance establishing the salary of the Mayor of the City of Waterloo, Iowa, as $26,750.00, beginning January 3, 1978, and repealing Ordinance No. 2760", be adopted. Ayes: Seven. Ordinance adopted and upon approval of Mayor, assigned No. 2909. 72557 - Mayor Rooff stated the recommended figure was $2,400.00. Moved by Dowie, seconded by Wilharm that "An Ordinance fixing the compensation of Councilmen of the City of Waterloo, Iowa, as $2,400.- 00 per annum, beginning January 3, 1978, and repealing Ordinance No. 2515", be received, placed on file, considered and passed for the first time. Ayes: Bowers, Dowie, Getty, Lichty, Roehr, Wil - harm. Nay: Geiger. Motion carried. 72559 - Moved by Bowers, seconded by Getty that "An Ordinance fixing the compensation of Councilmen of the City of Waterloo, Iowa, as $2,400.00, beginning January 3, 1978, and repealing Ordinance No. 2515", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2910. 72560 - Moved by Getty, seconded by Roehr that "Resolution, Bills", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25288. 72561 - Moved by Bowers, seconded by Dowie that "Resolution accepting a deed for street purposes", be adopted. Ayes: Bowers, Dowie, Gei- ger, Roehr, Wilharm. Nays: Getty and Lichty. Resolution adopted and upon approval by Mayor, assigned No. 25289. 72562 - Moved by Roehr, seconded by Getty that communication from Plan and Program Director, reporting an error in the legal description in the vacation, sale and conveyance of a part of Riehl Street to Ralph and Hazel Thierman with City's retention of a utility ease- ment, and requesting reconsideration, be received, placed on file and "Resolution rescinding Resolution No. 25252 adopted July 5, 1977, and fixing the time and place of hearing as August 8, 1977 on proposal to vacate, sell and convey certain real property to Ralph and Hazel Thierman", adopted and Clerk instructed to publish notice of hearing. Resolution adopted and upon approval by Mayor, assigned No. 25290. 72563 - Moved by Dowie, seconded by Geiger that the communication from the City Attorney, transmitting a proposed easement across a portion of vacated Kenyon Street to Bernard Kent and Haby Kent, owners of, adjacent lots, to be terminated upon City acquisition of Lots 18, 19 and 20, Riverview Addition, in the Flood Control Program, and recommending approval, be received, placed on file and "Resolu- tion fixing the date, time and place of hearing on proposal to con- vey an easement to Bernard Kent and Haby Kent for property access purposes across a portion of vacated Kenyon Street", adopted and date of hearing set as August 8, 1977.
