On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wilharm. Absent: None. Invocation by Councilman Getty. 72111 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of June 6, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 72112 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held May 23, 1977 at 7:00 P.M., be approved. Motion carried. 72113 - Councilman Wilharm welcomed back Councilman Geiger who had been hospi- talized. 72114 - Moved by Roehr, seconded by Getty that the proof of publication of notice of public hearing on proposed plans, specifications, form of contract and estimate of cost for the Recreation Center Parking Lot Addition, Minor Contract No. 92, and the taking of bids, be received and placed on file. Motion carried. 72115 - This being the time and place for hearing, Mayor called for oral and written objections, and there were none. Moved by Bowers, seconded by Dowie that "Resolution confirming approval of plans, specifications, form of contract, estimated cost, etc. for Recreation Center Parking Lot Addition, Minor Contract No. 92", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25154. 72116 - Moved by Getty, seconded by Wilharm that "Resolution ordering the con- struction of Recreation Center Parking Lot Addition, Minor Contract No. 92", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25155. 72117 - City Clerk reported the bid of Denter Construction Co., Waterloo, for the Recreation Center Parking Lot Addition, Minor Contract No. 92, was not received until 4:03 P.M. on June 6, 1977, and the deadline for receiving bids was set as 4:00 P.M. Moved by Roehr, seconded by Bowers that the above bid of Denter Con- struction, be received, placed on file, rejected as received after time deadline and the City Clerk instructed to return same unopened. Motion carried. 72118 - Moved by Roehr, seconded by Wilharm that the following bids, be re- ceived, placed on file, Clerk instructed to open same and referred to the Engineers for checking and report back: Bidder Dale J. Motion carried. 72120 - This being the time and place fixed for a public hearing on the matter of the adoption of plans, specifications, form of contract, and esti- mated cost for the construction of F.Y. 1977 Paving Program, Contract No. 157, the Mayor called for any oral objections to the making of said improvements, or to the adoption of the plans, specifications, form of contract or estimate of cost. No oral objections were offered and the Clerk reported that no written objections thereto had been filed. - 2 - 72120 - (Continued) Moved by Roehr, seconded by Dowie that "Resolution adopting plans, specifications, form of contract and estimated cost for F.Y. 1977 Paving Program, Contract No. 157", be adopted. Ayes: Seven. Reso- lution adopted and upon approval by Mayor, assigned No. 25156. 72121 - The Mayor thereupon announced that a further purpose of the meeting was to receive, open, consider and tabulate bids for the construction of the F.Y. 1977 Paving Program, Contract No. 157, in accordance with the plans and specifications now adopted. Moved by Getty, seconded by Bowers that the following bids be received, placed on file, the Clerk instructed to open, inspect and tabulate same, and referred to the Engineers for checking and report back: Name and Address of Bidder Cedar Valley Corporation, Waterloo, Iowa Cedar Falls Construction Co., Inc., Cedar Falls, Iowa Fred Carlson Co., Inc , Decorah, Iowa Irving F. Junko, be received and placed on file. Motion carried. 72123 - The Mayor announced the time had arrived for hearing, called for writ- ten and oral objections, and there were none. Moved by Dowie, seconded by Bowers that "An Ordinance vacating a 5' easement along Northeasterly lot line except 5' adjacent to rear of lot line of Lot No. 29, Byrn Brae Replat", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 72124 - Moved by Roehr, seconded by Lichty that the rules requiring ordinances to be received, placed on file, considered and voted on at two prior meetings, be suspended, the above Ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 72125 - Moved by Bowers, seconded by Lichty that "An Ordinance vacating a 5' easement along Northeasterly lot line except 5' adjacent to rear of lot line of Lot No. 29, Byrn Brae Replat", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2892. 72126 - Moved by Getty, seconded by Roehr that communication from Finance Director, transmitting the recommendations of the Finance Committee on bids submitted by various suppliers for tires, tubes, batteries, fuel oil, etc., be received, placed on file, recommendations approved, bids accepted as recommended, for period of 7/1/77 thru 6/30/78, and Finance Director directed and authorized to issue purchase orders and warrants in payment in accordance therewith, Motion carried. 72127 - Mayor Rooff reported the sewer conditions were very bad on Elm Drive and recommended some uncommitted block grant funds be used for the city to pick up one-third of the assessment costs for making improvements. Moved by Roehr, seconded by Dowie that Mayor Rooff and Co unity De- velopment Administrator Mercer be instructed to check into the uncom- mitted block grant funds and report back with valuations, etc. Motion carried. June 6, 1977 - 3 - 72128 - Mayor Rooff reported he had heard unofficially that the federal govern- ment had approved the block grant funds for the Maywood area water main project, and that only one-half of the people had signed committments to hook up to the water main stub within 24 months. Agnes Robertson, 1030 Roosevelt Street, stated the people do not feel they should have to sign a form for the federal funding. Mayor Rooff reminded when the city water project was first approved, the people were told they would have to make such committments, and if they didn't want to hook on within two years the city should not put in the water main; however, the water main would be put in for all existing homes except three or four and that those who do not sign committments will have to pay for the hook on from the water main to the property line. 72129 - Mayor Rooff stated thirteen easements were needed for the Northeast Sanitary Trunk Sewer Project on which agreement could not be reached. Councilman Getty suggested the Council study this item for a week. Dewayne Eilers requested the easement through his property be totally removed as he didn't want it. Moved by Bowers, seconded by Roehr that the above request of Dewayne Eilers, be received and placed on file. Motion carried. 72130 - Moved by Getty, seconded by Dowie that the communication from the Assistant City Attorney, transmitting a proposed "Resolution authoriz- ing the condemnation of certain parcels of real property for the North- east Sanitary Trunk Sewer Project", be received, placed on file, and action deferred until June 13, 1977. Motion carried. 72131 - A petition from James M. Penne, 34 Elm Drive, et al, who live on and require access from Elm Drive, requesting the City of Waterloo to take possession and maintain Elm Drive as a public street. Moved by Roehr, seconded by Lichty that the above petition be received, placed on file and referred to the Plan and Program Commission. Motion carried. 72132 - Moved by Getty, seconded by Roehr that five copies of Iowa Department of Transportation Application for use of Highway Right of Way for Utilities Accommodation, Form #562, with plat attached, from Gene Bond, for permission to install an 8" sanitary sewer line on SEly side of U.S. #63 between Sta. 953+00- to 954+30+, near Carrington Road, and City Engineer's recommendation for approval, be received, placed on file, approved and Mayor authorized to sign said application for the City. Motion carried. 72133 - Moved by Bowers, seconded by Geiger that request from Power Engineering and Manufacturing, Ltd., 724 Sycamore Street, for permission to relo- cate commercial drive on East Sixth Street, as shown on attached plat, and City Engineer's recommendations for approval subject to the pro- visions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72134 - Moved by Roehr, seconded by Getty that request from Robert J. Brown for peLmission to construct one 32' curb cut to serve three stall garage at 3665 Inverness Road, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72135 - Moved by Dowie, seconded by Bowers that communication from City Engi- neer, transmitting a request from Schenk Engineering Company for (1) route approval and (2) for construction of a sanitary sewer to serve proposed Gaertnier's Subdivision, and recommending routing as pro- posed be approved and said sewer not constructed at this time but subjected to Capital Improvements Program procedure for 5 -year period FY 1979-83, be received, placed on file and recommendations approved. Hesse for permission to construct a temporary asphalt driveway at 115.2 Ore- gon Street without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendations for approval sub- ject to the provisions of his letter, be received, placed on file, ap- proved and "Resolution granting permission to Michael M. Hesse and authorizing construction of a temporary asphalt driveway at 1152 Oregon Street irrespective of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25157. 72137 - Moved by Bowers, seconded by Geiger that request from William E. Narey for permission to construct a temporary asphalt driveway at 3024 West Fourth Street without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to William E. Narey and authorizing construction of a temporary ashphalt driveway at 3024 West Fourth Street irrespective of a later official grade", adopted. Ayes: Seven. Motion carried. 72141 - Moved by Roehr, seconded by Wilharm that City Treasurer's Financial Report of May, 1977, showing Balance on Hand 5/1/77 $14,955,536.18, Receipts $5,096,122.32, Disbursements $4,417,930.32, Balance on Hand 5/31/77 $15,633,728.18, be received, placed on file and approved. Motion carried. 72142 - Moved by Dowie, seconded by Roehr that communication from Waterloo Chamber of Commerce, transmitting a Rent Collection Policy for Low Rent Housing Projects, be received, placed on file and "Resolution of City Council of Waterloo, Iowa, adopting a Rent Collection Policy Statement for the Public Housing Authority of the City of Waterloo, Iowa, as suggested by the Department of Housing and Urban Development in connection with the Low Rent Housing Program", adopted. Resolution adopted and upon approval by Mayor, assigned No. 25161. 72143 - Moved by Roehr, seconded by Bowers that the Fiscal Year 1978 Operating, Budget for Low Rent Housing Projects 50 - 1 & 2 and 50 - 3 ending 6/30/78, be received, placed on file "A resolution of the City Council of the City of Waterloo, Iowa, approving and confirming an operating budget for the Public Housing Authority of the City of Waterloo for Projects 50 - 1 & 2 and 50 - 3, said budget being for a twelve month period", adopted, and the Mayor and Clerk authorized and instructed to execute same. June 6, 1977 - 5 - 72144 - Moved by Bowers, seconded by Wilharm that col .unication from Community Development Administrator, transmitting a Block Grant Agreement be- tween the City of Waterloo, Iowa and Department of Housing and Urban Development for $1,182,000 community development block grant funding, and recommending approval, be received, placed on file, and "Resolu- tion approving and providing for the execution of Housing and Community Development Block Grant Contract No. B -77 -MC -19-0008 by and between the City of Waterloo and the U.S. Department of Housing, and Urban Development", adopted. Resolution adopted and upon ap- proval by Mayor, assigned No. 25163. 72145 - Moved by Roehr, seconded by Wilharm that Public Employees Contract between the City of Waterloo, Iowa and Teamsters Union Local No. 844, be received, placed on file and "Resolution approving the Public Employees Contract with the Teamsters Union Local No. 844 and authoriz- ing the Mayor to sign and execute same in behalf of the City of Water- loo, Iowa", adopted. Moved by Roehr, seconded by Bowers that communication from Plan and Program Director, transmitting Fiscal Year 1978 thru Fiscal Year 1982 Capital Improvements Program, and recommending adoption with the dele- tion of potable water supply for City Hall project, be received, placed on file, recommendations approved and said Program adopted in accordance therewith. Weekley dba Weekley Auto Salvage for 2.38 acres in Riverview Addition for auto salvage yard purposes for the period of 5/1/77 thru 4/30/78 for the sum of $476.00, be received, placed on file, approved subject to erection of a fence by 9/1/77, and "Resolution approving a Lease Agreement dated 6/1/77 with Carol P. Clark Contracting Co. of Waterloo, Iowa in the sum of $29,055.20 was the lowest bid received for the Recreation Center Parking Lot Addition, Minor Contract No. 92. Moved by Getty, seconded by Wilharm that the above recommendations be received, placed on file and "Resolution making award of contract for Recreation Center Parking Lot Addition, Minor Contract No. 92, or ac- cepting the bid of Dale J. Clark Contracting Co. of Waterloo, Iowa in the sum of $29,055.20", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25168. 72155 - The Engineers, having checked the bids for the F.Y. 1977 Paving Program, Contract No. 157, reported the bid of Cedar Valley Corporation of Water- loo, Iowa in the sum of $995,686.83 was the lowest bid received. Moved by Getty, seconded by Geiger that "Resolution making award of contract for F.Y. 1977 Paving Program, Contract No. 157, or accepting the low bid of Cedar Valley Corporation of Waterloo, Iowa, in the sum of $995,686.83", be adopted. Resolution adopted and upon approval by Mayor, assigned No. 25169. 72156 - Moved by Dowie, seconded by Bowers that construction plans for sanitary sewerage, storm sewer and concrete paving facilities serving Pinnacle Place Addition, together with Treatment Agreement Form C 9/75 for Dept. of Environmental Quality, and City Engineer's recommendation for ap- proval with final acceptance of plans to be reviewed and accepted by DEQ, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 72159 - Moved by Getty, seconded by Bowers that "An Ordinance amending Ordinance No. 2446, as amended, known as the Milk Ordinance by repealing Subsec- tion (1) of Section 5-A, Inspection Fees, and enacting in lieu thereof new Subsection (1) of Section 5-A, Inspection Fees", be received, placed on file, considered and passed for first time. Motion carried. 72160 - Moved by Roehr, seconded by Dowie that communication from Waterloo Zoning Commission, recommending that Ordinance No. 2479, as amended, June 6, 1977 - 7 72160 - (Continued) Zoning Ordinance, be amended to increase Zoning Filing Fee from $25.00 to $75.00 for regular rezoning request and to establish a Filing Fee of $100.00 for conditional zoning request, transmitting proposed "An Ordinance to amend Ordinance No. 2479, as amended, the Waterloo Zoning Ordinance, by repealing in its entirety, Part XXVI, Amendments, Section 2A-55 and enacting in lieu thereof a new Part XXVI, Amendments, Section 2A-55", be received, placed on file, approved and said Ordinance con- sidered and passed for the first time. Beh Co., investment securities, lost and muti- lated $40,000 of Waterloo sewer bonds, and (2) that court approval for reissuance of said bonds has been obtained and indemnity bond filed with the court by said firm, transmitting proposed "An Ordinance directing the issuance of $40,000 Sewer Bonds in substitution for a like amount of mutilated or destroyed bonds", and recouuuending suspension of rules, be received, placed on file, recommendations approved, and said Ordin- ance considered and passed for the first time. Motion carried. 72163 - Moved by Getty, seconded by Wilharm that "An Ordinance directing the issuance of $40,000 Sewer Bonds in substitution for a like amount of mutilated or destroyed bonds", be adopted. Ordinance adopted and upon approval by Mayor, assigned No. 2893. 72164 - Matters concerning the raising of funds to defray the cost of construct- ing storm sewers and street improvements and the acquisition of fire department equipment for said City were discussed, whereupon Councilman Roehr introduced and caused to be read in full a resolution entitled "Resolution to fix a date of meeting at which it is proposed to insti- tute proceedings for the issuance of $984,000 Corporate Purpose Bonds". Moved by Roehr, seconded by Bowers that "Resolution to fix a date of meeting at which it is proposed to institute proceedings for the issu- ance of $984,000 Corporate Purpose Bonds", be adopted, and date set as June 27, 1977. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25171. 72165 - Matters concerning the raising of funds to defray the cost of acquiring land in connection with carrying out urban renewal projects in and for said City were discussed, whereupon Councilman Dowie introduced and caused to be read in full a resolution entitled "Resolution to fix a date of meeting at which it is proposed to institute proceedings for the issuance of $366,000 Corporate Purpose Bonds". Moved by Dowie, seconded by Bowers that "Resolution to fix a date of meeting at which it is proposed to institute proceedings for the issu- ance of $366,000 Corporate Purpose Bonds", be adopted, and date set as June 27, 1977. Ayes: Seven.
