The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on June 13, 1977. Mayor Rooff in the Chair.
On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Wilharm. Absent:
Roehr. Invocation by Councilman Wilharm.
72189 - Moved by Dowie, seconded by Bowers that the Agenda, as corrected, for
the Regular Session of June 13, 1977 at 7:00 P.M., be accepted and ap-
proved. Motion carried.
72190 - Moved by Geiger, seconded by Wilharm that the Minutes of the Regular
Session held June 6, 1977 at 7:00 P.M., be approved. Motion carried.
72191 - Moved by Bowers, seconded by Dowie that proof of publication of the
Notice of Proposed Resolution of Necessity for Oiling Program - Year
1977, being a Proposed Resolution of Necessity M. 25153) for the
improvement of streets, avenues, drives, roads, boulevards, alleys,
etc. or portions thereof, by oiling the same, as published in the
Waterloo Courier on May 26 and June 2, 1977, be received and placed
on file. Motion carried.
72192 - This being the time for hearing, the Mayor called for written and
oral objections. The Clerk reported the following written objections
had been filed:
1 - Mr. and Mrs. Perry K. Miller and Mr. and Mrs. Lewis H. Paulsen,
objecting to a portion of Shaulis Road;
2 - Clifford DeLong, 1309 East Shaulis Road, et al, objecting to cost.
Moved by Wilharm, seconded by Getty that the above written objections
be received and placed on file. Motion carried.
72193 - Wilma Harms, 430 South Hackett Road, protested the oiling of South
Hackett Road and presented an objection petition.
Moved by Wilharm, seconded by Geiger that the above objections be re-
ceived and placed on file. Motion carried.
72194 - Mr. and Mrs. Perry Miller stated they and the Lewis Paulsens would
receive no benefit though assessed 3/4 of costs for their portion
of East Shaulis Road which was farmland.
Rachel Kraft, 640 West llth Street, presented an objection petition
to the alley between Linwood Avenue and West llth Street from South
Street to the south.
Inez Schoonover, 149 Linwood Avenue, asked for a stop sign for the
dead end alley and Mayor Rooff said this would be checked immediately.
Larry Ernst, 1465 East Shaulis Road, stated for his street it would
be a waste of money as street would be tore up during the Summer.
V.F. Deutsch, 620 West llth Street, supported the alley between Lin-
wood Avenue and West llth Street as it was used to move traffic.
Moved by Getty, seconded by Wilharm the above objections and support
be received, placed on file and referred to the City Engineer.
Motion carried.
72195 - Moved by Dowie, seconded by Bowers that proof of publication of notice
of public hearing on conditional zoning, upon request of Rick Young,
upon recommendation of City Zoning Commission, and Council's own mo-
tion, for conditional zoning in a "R-2" One and Two Family District
on east side of Kimball Avenue between Cornwall Avenue and Terrace
Drive, as published in Waterloo Courier on May 26, 1977, be received
and placed on file. Motion carried.
72196 - This being time for hearing, the Mayor called for written and oral
objections, and the Clerk reported a petition of remonstrance had
been filed at zoning commission meeting.
Oral objections were made by:
John Beyer, 105 Cornwall Avenue, to increased traffic congestion on
24' wide streets.

Rick Young supported the triplex housing. A discussion followed.

dinance No. 2479, as amended, by adding Sub -Section No. 120 to
Section 2A-5, conditional zoning certain property", be received,
placed on file, considered and passed for the first time. Ayes:
Getty, Lichty, Wilharm. Nay: Bowers, Dowie, Geiger. Absent: Roehr.
Motion not carried.
72197 - Moved by Getty, seconded by Wilharm that proof of publication of
notice of public hearing on rezoning, upon request of Anita Andries
for Melvin H. Morris, upon recommendation of City Zoning Commission,
and Council's own motion, to rezone from "A-1" Agricultural District
and "R-1" One and Two Family Residence District to "C-1" Commercial
District a part of Section 2 -89N -13W, lying west of Logan Avenue
(Highway No. 63) and south of Midwest Garden of Memories Cemetery,
as published in Waterloo Courier on 5/26/77, be received and placed
on file. Motion carried.

oral objections, and there were none.

dinance No. 2479, as amended, by adding Sub -Section No. 119 to Sect-
ion 2A-5, rezoning certain property", be received, placed on file,
considered and passed for the first time. Ayes: Dowie, Geiger,
Getty, Lichty, Wilharm. Nay: Bowers. Absent: Roehr. Motion car-
ried.
72199 - Moved by Bowers, seconded by Dowie that proof of publication of no-
tice of public hearing on rezoning, upon request of Fred Debe for
Ivan and Virginia Meyers and Youngblut Construction Company, upon
recommendation of City Zoning Commission, and Council's own action,
to rezone from "A-1" Agricultural District to "R-2" One and Two Fam-
ily Residence District a 40 acre tract in Section 13 -88N -13W, located
west of Dysart Road and north of East Orange Road, as published in
Waterloo Courier on 5/26/77, be received and placed on file. Motion'

dinance No. 2479, as amended, by adding Sub -Section No. 121 to Sect -
tion 2A-5, rezoning certain property", be received, placed on file,

72201 - Moved by Dowie, seconded by Lichty that proof of publication of notice
of public hearing on rezoning, upon request of Fred Debe for Kay and
Mildred Gaertnier, upon recommendation of City Zoning Commission, and
Council's own action, to rezone from "A-1" Agricultural District to
"R-1" One and Two Family Residence District approximately 12 acres
in part of Section 14 -88N -13W located west of Hess Road about 1/8
mile south of East Shaulis Road, as published in Waterloo Courier

72203 - Leota Rice, 1320 South Street, supported the oiling of Alley between
Linwood Avenue and West llth Street.
City Engineer Radue reported that 607 of property owners opposed
South Hackett Road and over 50% to Shaulis Road, East, and to the

be received, placed on file and "Resolution sustaining the object-

Street and Linwood Street from South Street to the south, from the

72205 - Moved by Bowers, seconded by Getty that "Resolution of Necessity,
as amended, for oiling various streets, avenues, drives, roads, boule-

Iowa, under the Oiling Program for Year 1977", be adopted. Ayes:

72206 - Moved by Bowers, seconded by Dowie that "Resolution directing the
oiling of various streets, avenues, drives, roads, boulevards and
alleys, etc. or portions thereof, in the City of Waterloo, Iowa, as
designed in Resolution No. 25178, being the Resolution of Necessity,
as amended, adopted June 13, 1977", be adopted. Ayes: Six. Absent:

72207 - Moved by Getty, seconded by Geiger that Petition from Exceptional
Persons, Inc. for George E. Wyman, Jr. requesting suspension of
taxes against East 30' Lot 4, Block 14, William Watkins Sub -Division
for tax years 1975/1976 and 1976/1977, pursuant to Chapter 427.8 of
the 1975 Code of Iowa, be received, placed on file, and action de-

72223 - Under Council Action #72130 of 6/6/77, action was deferred on the
adoption of "Resolution authorizing the condemnation of certain
parcels of real property for the Northeast Trunk Sewer Project".
Mayor Rooff recommended the DeWayne Eilers property be deleted as
requested as a less costly route had been found.

mendation for approval with final acceptance of plans to be reviewed
and accepted by said DEQ, be received, placed on file, recommendations

72226 - Moved by Wilharm, seconded by Lichty that Construction Plans for
the sanitary sewerage facilities serving Hillside Addition, together
with Treatment Agreement Form C-9/75 for Department of Environmental
Quality, and City Engineer's recommendation for approval with final
acceptance of plans to be reviewed and accepted by said DEQ, be re-
ceived, placed on file, recommendations approved and Mayor and Clerk
authorized to execute said Agreement Form. Motion carried.
72227 - Moved by Lichty, seconded by Geiger that "An Ordinance amending Or-
dinance No. 2446, as amended, known as the Milk Ordinance by re-
pealing Subsection (1) of Section 5-A, Inspection Fees, and enacting
in lieu thereof new Subsection (1) of Section 5-A, Inspection Fees",
be received, placed on file, considered and the rules requiring or-
dinances to be received, placed on file,considered and passed on
at two prior meetings, be suspended, the above Ordinance recorded as
having been considered and passed for the second and third times,

ance No. 2446, as amended, known as the Milk Ordinance by repealing

thereof new Subsection (1) of Section 5-A, Inspection Fees", be a-

ance No. 2479, as amended, the Waterloo Zoning Ordinance by repealing

in lieu thereof a new Part XXVI, Amendments, Section 2A-55", be re-
ceived, placed on file, considered and passed for the second time.
