On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr, Wilharm. Absent: None. Invocation by Councilman Geiger. 72258 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed, for the Regular Session of June 20, 1977 at 7:00 P.M., be accepted and ap- proved. Motion carried. 72259 - Moved by Dowie, seconded by Bowers that the Minutes of the regular session held June 13, 1977 at 7:00 P.M., and the special session of June 16, 1977 at 4:00 P.M., be approved. Motion carried. 72260 - Moved by Bowers, seconded by Roehr that proof of publication of notice of public hearing to sell Disposal Parcel No. I -15(P), in Westfield - Virden Urban Renewal Area, Project No. Iowa R-7, 325 Oak Avenue, as published in Waterloo Courier on 5/19/77, to Paul J. and Megan Flam- mang, be received and placed on file. Motion carried. 72261 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Moved by Roehr, seconded by Bowers that "A resolution approving the sale of Disposal Parcel No. I -15(P) in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25201. 72262 - Moved by Roehr, seconded by Bowers that proof of publication of no- tice of public hearing to sell Disposal Parcel No. I -30(P) in West- field -Virden Urban Renewal Area, Project No. Iowa R-7, 205 East First Street, as published in Waterloo Courier on 5/19/77, to D & S Build- ing Company, Inc., be received and placed on file. Motion carried. 72263 - This being the time for hearing, the Mayor called for oral and writ- ten objections, and there were none. Resolution adopted and upon approval by Mayor, assigned No. 25202. 72264 - Mayor Rooff welcomed Boy Scout Troop No. 25 of Knights of Columbus. 72265 - Howard Kissell presented a petition for the City to accept Rebecca Lane as a City street as is. Moved by Bowers, seconded by Getty that the above petition be received, placed on file and referred to the Plan and Program Commission. Mo- tion carried. 72266 - Paul Riggs asked for a variance for a set back of building line to put up a garage. Mayor Rooff referred him to the Building Official to be taken before the Board of Adjustment. 72267 Agnes Robertson was informed the deadline for residents to sign for Maywood water was June 22nd. Mayor Rooff reported about 807 of the area home owners have signed up and project would be stetted probably by August. 72268 Councilman Getty asked the City Attorney for a ruling in writing as to when the Council could go into a closed, executive session, with a copy to go to each Council member. 72269 Councilman Dowie called for reconsideration of the request of Rick Young for conditional zoning in a "R-2" One and Two Family Residence District on east side of Kimball Avenue between Cornwall Avenue and Terrace Drive. - 2 72269 - (Continued) After discussion, it was Moved by Dowie, seconded by Bowers that "An ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 120 to Section 2A-5, conditional zoning certain property", be received, placed on file, reconsidered and passed for the first time. Ayes: Dowie, Gei- ger, Getty, Lichty, Roehr. Nay: Bowers and Wilharm. Motion carried. 72270 - Councilman Dowie reminded the Council that at the FY 1977 Budget hearing the Library Board was promised additional money if more funds were received, and as the City did get the funds, that $8,000 be given to said Board. Finance Director Albrecht suggested this be done after July 1st. 72271 - Councilman Dowie stated under the lease agreement for McElroy Auditor- ium the City agreed to replace any ordinary wear and tear, and the roof needed to be replaced; the total cost would be $80,000, which would be spread over four years, making the payments $20,000 each year, and by raising the rent some of this money could be recouped. Mayor Rooff suggested this wait until after July 1st. 72272 - Renata Sack Pxplained the Cedar Arts Forum purposes, its funding, and requested the City to make available its fair share in the amount of $1,235.00, which would be matched by federal funds. Moved by Getty, seconded by Bowers that the above request for $1,235.00 and the communication from Henry Cutler, Atty. for City of Waterloo to participate in funding of Cedar Arts Forum, Inc., be received, placed on file and approved. Ayes: Bowers, Dowie, Geiger, Getty, Roehr. Nay: Lichty and Wilharm. Motion carried. 72273 - Moved by Bowers, seconded by Wilharm that communication from Black Hawk County Auditor, requesting special assessment waived under Council Action #72213 of 6/13/77 for Lot 7, Block 3, Rose Hill 1st Addition, be reduced from $2,218.63 to $2,190.68, with $1,890.68 to be waived, be received, placed on file and approved. Ayes: Seven. Motion car- ried. 72274 - City Engineer Radue reported the bonding attorney had informed him that as final action had been taken on the oiling program and the alley between Linwood Avenue and West llth Street from South Street to dead end had not been included, it would be necessary to start new proceedings as this could not be added to present oiling program. A discussion followed on whether the City would set up individual programs for each new petition. Moved by Getty, seconded by Geiger that communication from City Engineer, transmitting petition from Mrs. Maynard Gunhus, 608 West llth Street, et al for oiling the Alley between Linwood Avenue and West llth Street from South Street to dead end, be received, placed on file, approved and the City Engineer instructed to proceed with this program, Motion carried. 72275 Moved by Dowie, seconded by Getty that request from Wendell Lockard Construction, Inc. for permission to construct one 35' commercial entrance at 1209 Black Hawk Road, as shown on attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 72276 - Moved by Roehr, seconded by Geiger that request from Harold Gibleon, 605 Locke Avenue, for permission to widen the existing approach on Baltimore Street to 32', as shown on attached plat, and City Engin- eer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. June 20, 1977 - 3 - 72277 - Under Council Action #72249 of 6/13/77, action was deferred on the application of. B. Schultz Company, 1551 David Street, for renewal of Junk Dealer License. Moved by Getty, seconded by Bowers that communication from Plan and Program Director, reporting that Councilmen Bowers, Getty and Lichty recommended revision of City ordinances to (1) prohibit truck traffic on Ackermant Street, Columbia Street, Lincoln Street, Reed Street and Cutler Street, all from Parker Street to W.C.F. & N. Drive, and West Arlington Street from Logan Avenue to David Street, and (2) junk yard operators be required to plant trees as an effective screening devise along Columbia Street right-of-way adjacent to the junk yard to a point where existing vegetation is located, be received, placed on file, and approved, City Attorney instructed to submit ordinances accordingly and the above application of B. Schultz Company, 1551 David Street, for a Junk Dealer License granted in accordance therewith and subject to requirements of ordinance gov- erning junk yards. Motion carried. 72278 - Moved by Geiger, seconded by Dowie that City Finance Director's Re- port for May, 1977, showing Fund Balance on 4/30/77 $14,263,384.95, Receipts $5,096,122.32, Bill Payments $731,412.52, Payrolls $623, 479.94, Transfers $94,293.62, Commissions $2,695,572.27, Fund Balance on 5/31/77 $15, 214,748.92, be received, placed on file and approved. Motion carried. 72279 - Moved by Geiger, seconded by Bowers that communication from Waterloo Chamber of Commerce, transmitting a proposed Housing Management Agree- ment for the City's housing program recommended by FHA in their audit findings, be received, placed on file and "Resolution approving the Housing Management Agreement with the Waterloo Chamber of Commerce", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 25203. 72280 - Ron Kittrell of the Humane Society, $7.50 to $8.50 first day charge and 13 days if quarantined; (2) the new ed (3) $7,038 animals put to sleep, in Black Hawk County last year. Moved by Getty, seconded by Geiger that the Agreement dated 6/20/77 ' with the Black Hawk Humane Society for furnishing and maintaining facilities and equipment adequate for the housing, shelter, care and disposal of dogs, cats, and other small animals, except for live- stock over 150 pounds for period of 7/1/77 thru 6/30/78, be received, placed on file, approved and Mayor and Clerk authorized to sign said Agreement in behalf of the City of Waterloo. Resolution adopted and upon approval by Mayor, assigned No. 25204. 72282 - Moved by Getty, seconded by Wilharm that communication from City En- gineer, transmitting Contract and Bond for Contract No. 157, be re- ceived, placed on file and "Resolution approving Contract and Bond of Cedar Valley Corporation, Waterloo, Iowa, for the FY 1977 Paving Program, Contract No. 157", adopted. Resolution a- dopted and upon approval by Mayor, assigned No. 25205. 72283 Moved by Roehr, seconded by Getty that construction plans for sanitary sewerage facilities serving Northgate Addition, together with Treat- ment Agreement Form C-9/75 for Department of Environmental Quality, and City Engineer's recommendation for approval with final acceptance of plans to be reviewed and accepted by said DEQ, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. June 20, 1977 - 4 - 72284 - Moved by Roehr, seconded by Bowers that "An Ordinance to amend Ordin- ance No. 2479, as amended, the Waterloo Zoning Ordinance by repealing in its entirety, Part XXVI, Amendments, Section 2A-55 and enacting in lieu thereof a new Part XXVI, Amendments, Section 2A-55", be received, placed on file, considered and passed for the third time. Ayes: Seven. Motion carried. 72285 - Moved by Roehr, seconded by Getty that "Resolution fixing a date for public hearing on the adoption of An Ordinance to amend Ordinance No. 2479, as amended, the Waterloo Zoning Ordinance by repealing in its entirety, Part XXVI, Amendments, Section 2A-55 and enacting in lieu thereof a new Part XXVI, Amendments, Section 2A-55", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2896. 72292 - Moved by Getty, seconded by Wilharm that "An Ordinance amending Ordin- ance No. 2479, as amended, by adding Sub -Section No. 119 to Section 2A-5, rezoning certain property", be received, placed on file, con- sidered and passed for the second time. Motion not carried. 72294 - Mayor Rooff reported the recommendations for the Deputy City Clerk salary was $14,000; for the City Clerk, Finance Director and City Treasurer $18,000 each; Human Rights Director, Director of Parks, Park Superintendent, Asst. Park Superintendent, and Landscape Archi- tect to be removed from the resolution; the Milk Sanitarian and the Assistant, salaries passed as shown subject to review; and Council- men added to the resolution with a salary of $2400 each, to be effect- ive as of January 1, 1978. Resolution adopted as changed and upon approval by Mayor, assigned No. 25207. 72295 - Moved by Bowers, secondedbyGetty that communication from Community Development Administrator, transmitting a Grant Agreement to incorpor- ate the Iowa R-7 funds into the Community Development Block Grant Pro- gram as part of the Iowa R-7 closeout, and recommending approval, be received, placed on file and "Resolution approving and providing for the execution of Housing and Community Development Block Grant Contract No. B -76 -MC -19-0008, Amendment No. 1, by and between the City of Water- loo, Iowa and the U. S. Department of Housing and Urban Development", adopted. Ayes: Seven.
