The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M., on June 27, 1977. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Wilharm. Absent:
Lichty and Roehr. Invocation by Councilman Getty.
72308 - Moved by Bowers, seconded by Getty that the Agenda, as proposed, for
the Regular Session of June 27, 1977 at 7:00 P.M., be accepted and
approved. Motion carried.
72309 - Moved by Geiger, seconded by Dowie that the Minutes of the Regular
Session held June 20, 1977 at 7:00 P.M., be approved. Motion carried.
72310 - Moved by Bowers, seconded by Getty that the proof of publication of
notice of public hearing on plans, specifications, proposed form of
contract, etc. for the Westfield -Virden Urban Renewal Project, for
construction of Sans Souci Bridge. Approaches, Paving, Sewers and Inci-
dentals, Contract No. 160, and the taking of bids for said improve-
ments, be received and placed on file. Motion carried.
72311 - This being the time for hearing, the Mayor called for written and oral
objections, and there were none.
Moved by Geiger, seconded by Bowers that "Resolution confirming the
approval of plans, specifications, etc. for the Sans Souci Bridge
Approaches, Paving, Sewers and Incidentals, Contract No. 160", be
adopted. Ayes: Five. Absent: Lichty and Roehr. Resolution adopted
and upon approval by Mayor, assigned No. 25211.
72312 - Moved by Getty, seconded by Bowers that "Resolution ordering the con-
struction of Sans Souci Bridge Approaches, Paving, Sewers and Inciden-
tals, Contract No. 160", be adopted. Ayes: Five. Absent: Lichty and

to contractors or invitation for bids for construction of Sans Souci

of Meeting for the Issuance of Corporate Purpose Bonds ($984,000), be
received and placed on file. Motion carried.
72320 - This being the time and place for hearing,on issuance of $984,000 Cor-
porate Purpose Bonds, the Mayor called for written and oral objections
and there were none.
72321 - Moved by Bowers, seconded by Getty that proof of publication of Notice
of Meeting for the Issuance of Corporate Purpose Bonds ($366,000), be
received and placed on file. Motion carried.
72322 —This being the time and place for hearing on issuance of $366,000
Corporate Purpose Bonds, the Mayor called for written and oral object-
ions and there were none.
72323 - The City Council investigated and found that notice of intention to
take action at this meeting for the issuance of $984,000 Corporate
Purpose Bonds of said City to defray the cost of acquiring fire de-
partment equipment and of constructing street improvements and storm
sewer works and facilities for said City had heretofore been published
on the 9th day of June, 1977, in the"Waterloo Daily Courier", a news-
paper published and having a general circulation in said City, that
notice of intention to take action at this meeting for the issuance of
$366,000 Corporate Purpose Bonds of said City to defray the cost of
acquiring land in connection with carrying out urban renewal projects
in said City had heretofore been published on the 9th day of June,
1977, in the "Waterloo Daily Courier", a newspaper published and hav-
ing a general circulation in said City, and that no oral or written
objections of any kind had been filed or made to the issuance of any
of said bonds, that no one had appeared responsive to said notice to
make objection to such action, and that no petition or petitions had
been filed with the City Clerk asking that the question of issuing
said bonds be submitted to the qualified electors of said City. Where-
upon Councilman Wilharm introduced and caused to be read the resolution
shown below.
Moved by Wilharm, seconded by Getty that "Resolution initiating pro-
ceedings for the issuance of $1,350,000 Corporate Purpose Bonds of
the City of Waterloo, Iowa", be adopted, and that this hearing, be,
and the same is, hereby adjourned to the 1st day of August, 1977, at
the Council Chambers in the City Hall in said City at 7:00 P.M., at
which time and place a Resolution authorizing the issuance of $1,350,
000 Corporate Purpose Bonds of said City and providing for the levy
of taxes to pay the same will be presented to this Council for consid-
eration. Ayes: Five. Absent: Lichty and Roehr. Resolution adopted
and upon approval by Mayor, assigned No. 25215.

72324 - The matter of offering for sale $1,350,000 Corporate Purpose Bonds of
said City was discussed, whereupon Councilman Bowers introduced and
caused to be read the resolution shown below.
Moved by Bowers, seconded by Wilharm that "Resolution providing for
the advertisement of $1,350,000 Corporate Purpose Bonds", be adopted.
Ayes: Five. Absent: Lichty and Roehr. Resolution adopted and upon
approval by Mayor, assigned No. 25216.
72325 - Moved by Dowie, seconded by Bowers that proof of publication of notice
of public hearing on proposal to vacate, sell and convey to Ralph and
Hazel Thierman that part of Riehl Street located West of the Westerly
line of vacated Riverside Drive, Cedar River Place, as published in
Waterloo Courier on 6/17/77 for $131.70 plus costs, be received and
placed on file. Motion carried.

objections, and there were none.

of Riehl Street located West of the Westerly line of vacated Riverside
Drive, Cedar River Place", be received, placed on file, considered and

72330 - This being the time for hearing, the Mayor called for written and oral
objections, and there were none.
Moved by Bowers, seconded by Getty that "Resolution authorizing the
sale and conveyance of a part of Lot 56, Lewis Miller's Small Farms
Addition, as more fully described in Waterloo Courier publication of
6/17/77, to Donald and Susan M. Thompson, for the sum of $127.50 plus
costs, and directing and authorizing the Mayor and Clerk to execute
and deliver a deed for said property", be adopted, with City retention
of a ponding easement. Ayes: Five. Absent: Lichty and Roehr. Res-
olution adopted and upon approval by Mayor, assigned No. 25217.
72331 - Moved by Dowie, seconded by Getty that proof of publication of notice
of public hearing on proposal to dispose of All that part of vacated
alley lying Northwesterly of C.N.W.R.R. between the east line of Ans-
borough Avenue and the north line of vacated Kingsley Avenue, as pub-
lished in Waterloo Courier on 6/17/77, for $500.00 plus costs, be re-

for $500.00 plus costs, and directing and authorizing the Mayor and
City Clerk to execute and deliver a deed for said property", be a-

72335 - Moved by Getty, seconded by Bowers that the above bids be received,
placed on file and referred to the Supt. of the Waterloo Pollution
Control Plant and Finance Committee. Motion carried.
72336 Moved by Getty, seconded by Wilharm that the recommendations of the
Citizens' Insurance Advisory Committee to accept, (1) the Family Guard -
M self insuring proposal of The Guardian Life Insurance Co. of America,
New York, N.Y., subject to the Council agreeing to give an additional
benefit to all City employees of $10,000 life insurance which is man-
datorily included in this bid, for one year only, and (2) the Group
UAW Prototype Dental proposal for Union Local 1127 and the Waterloo
Police Department of Aetna Life & Casualty Company, be received, placed
on file, action deferred for one week, and accident, health and dental
insurance continued with Blue Cross/Blue Shield to August 1, 1977.

72337 - Harold Brock briefly reviewed the past history of Hawkeye Institute
of Technology, the enrollment growth, and financial impact of current
$5,585,712 budget. He reported on the current building project, need
of $415,591 for parking and roadways, and requested the City to pro-
vide this assistance from the federal Economic Development Grant of
$2,018,000.
Moved by Wilharm, seconded by DOwie that the above request be received,
placed on file, and given consideration at a later date. Motion car-
ried.
72338 - The Engineers recommended acceptance of low bid of Denman Phillips
Construction Co. of Waterloo, Iowa in the amount of $36,049.05 for
Orange Township Asphalt Paving Program, Contract No. 161.

received, placed on file and "Resolution accepting bid of Denman Phill-
ips Construction Co. in the amount of $36,049.05 for Orange Township

report on petition from James M. Penne, 34 Elm Drive, et al, for City
of Waterloo to take possession and maintain Elm Drive as a public
street, referred to it under Council Action #72131 of 6/6/77, and rec-
ommendation denial until all adjacent property owners are in favor
of said dedication, be received, placed on file, action deferred for

Republic Construction Company, Waterloo, Iowa, for West Fourth Street
and Shaulis Road Borrow, Stage IIIB, at the rate of 25Q per cubic
yard, and City Engineer's recommendation for approval, be received,
placed on file and "Resolution approving an Agreement with Republic
Construction Company for West Fourth Street and Shaulis Road Borrow,
Stage IIIB, and authorizing Mayor and Clerk to execute said Agreement
