The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M., on May 9, 1977. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Geiger, Getty, Lichty, Roehr, Wil -
harm. Absent: Dowie. Invocation by Councilman Geiger.
71918 - Moved by Wilharm, seconded by Bowers that the Agenda, as amended,
for the Regular Session of May 9, 1977 at 7:00 P.M., be accepted and
approved. Motion carried.
71919 - Moved by Roehr, seconded by Lichty that the Minutes of the Regular
Session held May 2, 1977 at 7:00 P.M., be approved. Motion carried.
71920 - Moved by Wilharm, seconded by Geiger that the Council adjourn to the
large courtroom for the public hearing on a proposed Resolution of
Necessity for street improvements, FY 1977 Paving Program, Contract
No. 157. Motion carried.
71921 - COUNCIL NOW IN SESSION IN THE LARGE COURTROOM
Moved by Roehr, seconded by Wilharm that proof of publication of no-
tice to property owners of public hearing on a proposed Resolution
of Necessity for street improvements, FY 1977 Paving Program, Con-
tract No. 157, be received and placed on file. Motion carried,
71922 - The Mayor announced the time had arrived for the hearing, and then
called for written and oral objections to construction of certain
street improvements under FY 1977 Paving Program, Contract No. 157.
The Clerk reported written objections were filed as follows:
1. Willie and Mattie Lee, 404 Douglas Street, objecting to Ash
Street;
2. Marion L. Place objecting to Lots 15 and 16, Block 28, Hagerman
Addition;
3. Alice Moeller and C. Harry Moeller, 548 Adrian Street;
4. Louis A. and Norma I. Westphal, et al, objecting to Wallgate Ave-
nue from Downing Avenue to University Avenue;
5. Mr. and Mrs. Terry Peters, 133 Hillside Avenue;
6. Daniel I. Holte, 150 Bellview Road, et al;
7. Rosemary Hartin, 515 Carolina Avenue, et al, to Miriam Drive,
from Hale Street to Vermont Street, including a one-half inter-
section at Knox Drive;

71923 - Oral objections were made by Louis Westphal, 504 Downing Avenue, to
Wallgate Avenue, from Downing Avenue to University Avenue and he was
informed that this block was in the block grant program and the as-
sessed properties have been benefited by a 25% reduction in assess-
ments.
Moved by Wilharm, seconded by Roehr that the above objection and the
written objection petitions from 1) Louis A. and Norma I, Westphal
et al to said Wallgate Avenue,and 2)Marion L. Place, be received and
placed on file. Motion carried.
71924 - Moved by Wilharm, seconded by Roehr that the objections to Wallgate
Avenue from Downing Avenue to University Avenue be sustained and
said street ordered deleted from the FY 1977 Paving Program, Contract
No. 157. Ayes: Six. Absent: Dowie. Motion carried.

71925 - Dan Holte, 150 Belleview Road, orally protested the paving of Belle -
view Road from Windsor Drive to Derbyshire Road.
Moved by Roehr, seconded by Wilharm that the above objection and writ-
ten objection petitions of 1) Esther B. Angus and Arnold Angus,
225 Windsor Drive, and of 2) Daniel P-Hdlte,et al, be received, placed
on file, said objections sustained, Belleview Road from Windsor Drive
to Derbyshire Road ordered deleted from the FY 1977 Paving Program,.
Contract No. 157, and the Mayor to inspect the situation. Ayes: Six.
Absent: Dowie. Motion carried.
71926 - Terry Meier, 316 Reed Street, objected to Kern Street from Reed
Street to Cutler Street.
Moved by Geiger, seconded by Bowers that the above objection, written
objection of Terry Meier, et al, be received, placed on file, said
objections sustained, and Kern Street from Reed Street to Cutler
Street ordered deleted from the FY 1977 Paving Program, Contract No.
157. Ayes: Six. Absent: Dowie. Motion carried.
71927 - Tim Miller, 1118 Kern Street, supported the paving of Kern Street
from Longfellow Avenue to Burton Avenue. Several property owners
objected to thickness and non -reinforcement of concrete.
Moved by Wilharm, seconded by Roehr that the above objections and
support, be received, placed on file, objections overruled, and
Kern Street from Longfellow Avenue to Burton Avenue ordered included
in the FY 1977 Paving Program, Contract No. 157. Ayes: Six. Ab-
sent: Dowie. Motion carried.
71928 - Rodney Hartman, 424 Black Hawk Road stated Community Development
block grant funds should pay 75% of assessment and property owner
25%.
Mayor Rooff reported only the second year in paving program was
being talked about, that of money left unspent last year, $264,000
was allocated to pick up portions of assessments; also, he had been
informed by federal government today that in the block grant area
funding, whatever is done for one, the City must do for the whole
block grant program; that all the people would be heard, and then
the Council would determine what would be done, that the City En-
gineer would remove the streets deleted and report back next week.
Mayor Rooff repeated that in hardship cases the federal government
would not permit any different consideration, that what is done
for one must be done for all. Bill Ritter, 1619 Hawthorne Avenue,
stated the concrete should be reinforced and there was a discussion.
71929 - Lonnie Moore, 123 Ash Street, stated he circulated a petition for
paving of Ash Street from Waterloo Railroad to Douglas Street.
Moved by Bowers, seconded by Getty that the above support and written
objection petition from Willie and Mattie Lee, 404 Douglas Street,
be received, placed on file, said objections overruled and Ash
Street from Waterloo Railroad to Douglas Street ordered included
in the FY 1977 Paving Program. Ayes: Six. Absent: Dowie. Mo-
tion carried.
71930 - C. J. Klatt, 555 Carolina Street, opposed paving of Miriam Drive
from Hale Street to Vermont Avenue and Shirley Slagter, 1326 Vermont
Street, and others objected.Ray Mayes supported the paving. Assess-
ments were discussed and the City Engineer recommended the two
southeast corner lots be reduced to 257, which would make the assess-
ments the same as the other south side lots.
Moved by Getty, seconded by Wilharm that the above objections, support,
written objection petitions of Rosemary Hartin, 515 Carolina Avenue,
et al and of Curtis J. Klatt, 555 Carolina Avenue, et al, be re-
ceived, placed on file, said objections overruled, Miriam Drive from
Hale Street to Vermont Street ordered included in the FY 1977 Paving
Program, Contract No. 157, and the City Engineer instructed to
reduce the assessments to 257 for two end lots in accordance with
his oral recommendation. Ayes: Six. Absent: Dowie. Motion car-
ried.

71931 - Mayor Rooff called for objections to Aladdin Street. Several af-
fected property owners objected to assessments, and to unopened,
dedicated Brender Street. The underground assessment could be for
1) sanitary sewer stub from main to property line, 2) installation
of water service pipe, 3) replacement of galvinized pipe with copper
pipe.
Moved by Roehr, seconded by Getty that the above objections be re-
ceived, placed on file, overruled and Aladdin Street from Stratford
Avenue to Upton Avenue ordered included in the FY 1977 Paving Pro-
gram, Contract No. 157. Ayes: Six. Absent: Dowie. Motion car-
ried.
71932 - Bonnetta Maledy, 1111 Bauch Street and other oral objections were
made to assessments for Bauch Street from Maxwell Street to Aladdin
Street and support given for additional block grant funding. Mayor
Rooff, again repeated, the federal government said what is done for
one must be done for all, the rules must be abided to, and that 25%
of the assessments were being picked up by said funding.
Moved by Wilharm, seconded by Bowers that the above objections be
received, placed on file, sustained and Bauch Street from Maxwell
Street to Aladdin Street ordered deleted from the FY 1977 Paving
Program, Contract No. 157. Ayes: Six. Absent: Dowie. Motion
carried.
71933 - Mayor Rooff reported 4% objection against paving Plain View Street
from South View Drive to Anthony Street, none against Spring View
Street from Cordell Street to Newell Street and 4% against City
View Street from South View Street to Newell Street. Objections
were made to amount of block grant funding of 257.
Moved by Roehr, seconded by Bowers that the above objections and
of Young Development Company to City View Street and to Plain View
Street, be received, placed on file, objections overruled, and
(1) Plain View Street from South View Drive to Anthony Street,
(2) Spring View Street from Cordell Street to Newell Street, and
(3) City View Street from South View Street to Newell Street ordered
included in the FY 1977 Paving Program, Contract No. 157. Ayes:

71934 - On Adrian Street from Lafayette Street to Highway #20, Mayor Rooff
reported the assessments reflected 257 reduction by block grant
funding. Howard Perry objected due to future traffic lane to new
Deere & Co. plant. Jessie Holder, Hobert Dowell, Alice Moeller
and others objected.
Moved by Bowers, seconded by Roehr that the above objections and the
written objections of Robert A. White, 507 Adrian Street and of Alice
Moeller and C. Harry Moeller, 548 Adrian Street, be received, placed
on file, overruled and Adrian Street from Lafayette Street to High-
way #20 ordered included in the FY 1977 Paving Program, Contract No.
157. Ayes: Six. Absent: Dowie. Motion carried.
71935 - Mayor Rooff called for objections to Archer Avenue from Nevada Street
to Colorado Street and there were four objectors. Carl Hansen, 533
Archer Street, asked that fire plug and tree be moved from his drive-
way.
Moved by Bowers, seconded by Roehr that the above objections be re-
ceived, placed on file, overruled, and Archer Avenue from Nevada
Street to Colorado Street ordered included in the FY 1977 Paving Pro-
gram, Contract No. 157. Ayes: Six. Absent: Dowie. Motion carried,
71936 - Moved by Bowers, seconded by Getty that the objection petitions of
Charles R. Snowden, 139 Dearborn Avenue, and of Arletta K. Lantz,
238 Cottage Grove, et al to paving of Colorado Street from Lafayette
Street to Highway #20, be received and placed on file. Motion car-

71937 - Robert Brennan, 142 Dearborn Avenue, Charles Snowden, and others
opposed the paving of Colorado Street from Lafayette Street to
Highway #20.

included in the FY 1977 Paving Program, Contract No, 157. Ayes:

71938 - Glen Rokes, 120 Hillside Avenue, and Everett De Smidt, 216 Frederic
Avenue objected to paving of Hillside Avenue from Carolina Avenue
to Frederic Avenue.

written objection of Mr, and Mrs. Terry Peters, 133 Hillside Avenue
be received, placed on file, overruled and Hillside Avenue from
Carolina Avenue to Frederic Avenue ordered included in the FY 1977
Paving Program, Contract No. 157. Ayes: Six. Absent: Dowie.

71939 - Howard Berry, corner of Oregon Street and Hawthorne Avenue, Mrs.
Ruth Jensen, Ray Thomas, and Jim Evans supported the paving of
Oregon Street.
Richard Pierce, 1622 Forrest Avenue, presented a petition of object-
ions to paving Oregon Avenue from the Hawthorne Avenue to Forrest
Avenue. Wayne Winkie, 1545 Hawthorne Avenue, John Lindeman, 1632
Williston Avenue, and others opposed the paving.
Moved by Bowers, seconded by Wilharm that the above support and
objections and objection petition be received and placed on file.

71940 - After further discussion, it was

71941 - Mayor Rooff called for objections to Flower Street from Scott Avenue
to Sheerer Avenue and there were none. Councilman Roehr asked that
consideration be given to a reduction of assessment for the elderly.

Avenue to Sheerer Avenue be ordered included in the FY 1977 Paving
Program, Contract No. 157. Ayes: Six. Absent: Dowie. Motion
carried.
71942 - There were no objections to paving of Sheerer Avenue from Flower
Street to University Avenue.

71943 - There was no opposition to paving of Anthony Street from Neville
Street to Idaho Street.

71944 - There were no objections to paving of Twelfth Street from Commer-

71946 - Tim Mc Bride, 657 Dawson Street, presented a petition objecting to
paving of Grandview Avenue from Riehl Street to West Parker Street.
Moved by Roehr, seconded by Bowers that the above petition of Tim
McBride, et al, be received and placed on file. Motion carried.
71947 - Councilman Getty reported he had received a number of calls in
favor of Grandview Avenue paving. A petition was presented re-
questing that 75% block grant funds be used for assessment costs.
Gale Williams and others supported the paving.
Moved by Roehr, seconded by Getty that the above petition of Frank
Van Kerckhove, 701 Newton Street, et al, and the above and written
support for paving of Grandview Avenue, be received and placed on
file. Motion carried.
71948 - Moved by Roehr, seconded by Wilharm that the objections to paving
of Grandview Avenue be overruled and Grandview Avenue from Riehl
Street to West Parker Street ordered included in the FY 1977 Paving
Program, Contract No. 157. Ayes: Six. Absent: Dowie. Motion
carried.
71949 - Mayor Rooff reported there was a 67 objection against paving of
Patton Avenue from Ohio Street to Wisconsin Street.

Lois E. Fitkin, 942 Wisconsin Street, to paving of Patton Street,
be received, placed on file, objection overruled and Patton Avenue
from Ohio Street to Wisconsin Street ordered included in the FY 1977

nue to Hartman Avenue.

71952 - Charles Spates objected to variance in assessments for Black Hawk
Road from Fletcher Avenue to Downing Avenue. Underground assessments
were discussed.

71953 - There were no objections to Newell Street from Elk Run Road to East
2 mile.

71954 - Mayor Rooff declared the time for receiving objections to be closed.
Moved by Getty, seconded by Lichty that the hearing be adjourned to
the Council Chambers and convened at 10:50 P.M. Motion carried.
71955 - After reviewing all the objections received, the Council found and
determined that no remonstrance, pursuant to the provisions of
Section 384.51 of the City Code of Iowa, was filed with the Council,
pertaining to the proposed improvement as set out in said Resolution
of Necessity as originally proposed.
Moved by Getty, seconded by Lichty that action on said Resolution
of Necessity, and all other matters related or incidental thereto
be and are hereby deferred and continued to a meeting of this Coun-
cil to be held on the 16th day of May, 1977 at 7:00 o'clock P.M.
at this place, that this Council retains jurisdiction of said Res-
olution of Necessity, objections thereto, and other related matters
for consideration and action thereon at said adjourned meeting. Ayes:

71957 - The Mayor announced the time had arrived for hearing, called for

dard Subdivision", be received, placed on file, considered and

71958 - Moved by Getty, seconded by Lichty that the rules requiring ordin-
ances to be received, placed on file, considered and voted on at
two prior meetings, be suspended, the above Ordinance recorded as
having been considered and passed for the second and third times,
and now placed on its final adoption. Ayes: Six. Absent: Dowie.

71960 - Councilman Getty reported Larry Lehman has cleaned up and enclosed
Stoddard Addition with link fencing.

tice of public hearing to vacate, sell and convey to Michael D. and
Patricia Rottinghaus and to Harold E. and Jeanne L. Gott a portion
of Regent Street, located North of Hollywood Avenue, as published
in Waterloo Courier on 4/28/77 for $360 and $360 plus costs, re-

71964- Moved by Getty, seconded by Lichty that "Ordinance vacating a por-

and directing and authorizing the Mayor and City Clerk to execute

tice of proposal to dispose of real property to Allen Bower and

71967 - The Mayor announced the time had arrived for hearing, called for
oral and written objections, and there were none.

conveyance of North 10' of Lot 7, Peverill's Addition, as published
in Waterloo Courier on 4/28/77, to Allen Bower and Janice Bower,
husband and wife, and directing and authorizing the Mayor and Clerk
to execute and deliver a deed for said property", be adopted. Ayes:

71968 - Councilman Getty reported he had the budget information requested by
Councilman Dowie and Mayor Rooff asked that Councilman Getty come
in and visit with him.
71969 - Moved by Bowers, seconded by Geiger that request of Sky Vue Drive -
In Theatre for permission to stage a fireworks display at 3066 Inde-
pendence Avenue on July 4, 1977, with alternate nights of July 8 or
9, 1977 in case of inclement weather, be received, placed on file
and permission granted subject to $1,000 bond being filed and to
the approval of the Fire Chief. Motion carried.
71970 - Moved by Roehr, seconded by Geiger that five copies of Iowa Depart-
ment of Transportation Entrance Permit Application, Foim 640004,
with plat attached, from Rohlin Construction Company for permission
to construct two Type "B" entrances on Iowa Highway #k57 at Station
115+63.1 and 112+63.1, east of the junction of Airline Highway and
Airport Boulevard, and City Engineer's recouuuendation for approval
subject to the provisions of his letter, be received, placed on file,
approved and Mayor authorized to sign said application for City.

71971 - Moved by Roehr, seconded by Geiger that the request from John Rooff,
Sr. for permission to construct one 22' commercial curb cut on
Commercial Street to serve 212 West 14th Street, as shown on attach-
ed plat, and City Engineer's recommendations for approval subject
to the provisions of his letter, be received, placed on file, recom-
mendations approved and permission granted in accordance therewith.

71972 - Moved by Geiger, seconded by Bowers that request from Cecil Magee
Realtors for permission to construct a temporary asphalt driveway
at 808 Rainbow Drive without regard to sidewalk grade and to black-
top the parking area for beautification purposes,only, together with
$3.00 for recording waiver, and City Engineer's recommendation for
approval subject to the provisions of his letter, be received, placed
on file, recommendations and said black topping approved and "Reso-
lution granting permission to Cecil Magee Realtors and authorizing
construction of a temporary asphalt driveway at 808 Rainbow Drive
irrespective of a later official grade", adopted. Ayes: Six.
