tice of public hearing on re -zoning, upon request of Westgate Villa,
Inc. and Pearl Smith, upon recommendation of City Zoning Commission,
and Council's own motion, to rezone from "A-1" Agricultural District
to "R-2" One and Two Family Residence District, "R-3" Multiple Resi-
dence District and "R-4" Multiple Residence District, unplatted real
property in Section 3-88-13 South of Hammond Hills Third Addition
between Hammond Avenue and St. Francis Drive, as published in Water-
loo Courier on 3/3/77, be received and placed on file. Motion car-
ried.

dinance No. 2479, as amended, by adding Sub -Section No. 110 to
Section 2A-5, rezoning certain property", be received, placed on

71600 - Moved by Roehr, seconded by Dowie that proof of publication of notice
of public hearing on re -zoning, upon request of Hurst Excavating, Inc.,
upon recommendation of City Zoning Commission, and Council's own
motion, to rezone from "R-3" Multiple Residence District to "R-4"
Multiple Residence District, ten lots in part of Lot 101, Huntington
Park, South of Lark Lane between Wren Road and Scott Street, as
published in Waterloo Courier on 3/3/77, be received and placed on
file. Motion carried.
71601 - The Mayor announced this was the time for hearing, called for oral
and written objections and there were none.
Moved by Getty, seconded by Bowers that "An Ordinance amending Ordin-
ance No. 2479, as amended, by adding Sub -Section No. 110 to Section
2A-5, rezoning certain property", be received, placed on file, con-
sidered and passed for the first time. Ayes: Five. Absent: Lichty
and Wilharm. Motion carried.
71602 - Mayor Rooff welcomed the members of Boy Scout Troop 2 of Whittier
School and the Scout Master.
71603 - Mayor Rooff reported that today he received an 80 page investiga-
tive report from the Department of Housing and Urban Development
which assumed there was no creditability to the CCI allegations of
misconduct by the Community Development Department, and that after
further perusal of the report, he would release the housing rehabil-
itation moratorium tomorrow. He stated he would ask for changes to
be made in the housing program, such as painting, etc. to be done
by those persons able to do the work.
71604 - Mayor Rooff suggested that the Council consider for a month the
changing of the time of the second and fourth Monday Council meetings
from 7:00 P.M. to 4:00 P.M., effective July 1, 1977, with the hand-
ling of nothing but routine business.
71605 - Moved by Bowers, seconded by Dowie that request from Harold E. Getty
for permission to construct two commercial drives at 905 Cedar Bend
Street, one on Cedar Bend Street and the other on Donald Street,
as shown on attached plat, to serve "Soft Sery Saloon, Inc." and
City Engineer's recommendation for approval subject to the provisions
of his letter, be received, placed on file, recommendations approved
and permission granted in accordance therewith. Motion carried.
Councilman Getty declined to vote by reason of possible conflict of
interest under Section 362.6 of Code of Iowa.
71606 - Moved by Bowers, seconded by Geiger that request from Linden United
Methodist Church for permission to construct a temporary commercial
asphalt driveway at 301 Butler Street, without regard to sidewalk
grade, together with $3.00 fee for recording waiver, and City En-
gineer's recommendation for approval subject to the provisions of
his letter, be received, placed on file and "Resolution granting
permission to Linden United Methodist Church and authorizing con-
struction of a temporary asphalt driveway at 301 Butler Street, ir-
respective of a later official grade", adopted. Ayes: Five. Absent:
Lichty and Wilharm. Resolution adopted and upon approval by Mayor,
assigned No. 25028.
71607 - Moved by Dowie, seconded by Geiger that minutes of Community Develop-
ment Board for their regular meeting held February 8, 1977, be re-
ceived and placed on file. Motion carried.

71608 - Under Council Action #71561 of 3/14/77 the hearing on Resolution of
Necessity for the 1977 Guernsey's Orange View Sanitary Sewer, Contract
No. 187, was adjourned to this time and place.
Moved by Roehr, seconded by Dowie that the hearing on the 1977 Guern-
sey's Orange View Sanitary Sewer, Contract No. 187, be further ad-
journed to March 28, 1977 at 7:00 P.M. in the Council Chambers in
City Hall at which time and place a Resolution of Necessity shall be
presented for adoption. Ayes: Five. Absent: Lichty and Wilharm.
Motion carried.
71609 - The Engineers recommended acceptance of the low bid of Acton Con-
struction Company, Inc., Waterloo, Iowa, in the total amount of
$305,765.80, itemized as Base $257,031.80, minus deletion of linseed
oil sealer $8,850.00, plus Alternate 1 $57,584.00, for the Repairs
to West Side Parking Ramp, Minor Contract No. 90.
Moved by Dowie, seconded by Roehr that the above recommendation be
received, placed on file and "Resolution accepting the bid of Acton
Construction Company, Inc. for the total amount of $305,765.80,
Base minus Linseed Oil Sealer plus Alternate 1, for the Repairs to
West Side Parking Ramp, Minor Contract No. 90", adopted. Ayes: Five.
Absent: Lichty and Wilharm. Resolution adopted and upon approval
by Mayor, assigned No. 25029.
71610 - Moved by Roehr, seconded by Getty that communication from Plan and
Program Director, transmitting a Warranty Deed for right of way for
Flammang Drive between Highway #412 and Richland Park Subdivision,
be received, placed on file and "Resolution approving and accepting
a Warranty Deed dated 2/27/77 from Donald R. Flammang and Lennette
V. Flammang, Campbell Homes, Inc. and Clarence H. Schukei and Betty
Jean Schukei", be adopted. Ayes: Five. Absent: Lichty and Wilharm.
Resolution adopted and upon approval by Mayor, assigned No. 25030.
71611 - Moved by Roehr, seconded by Dowie that communication from City Engin-
eer, transmitting two copies of License Agreement dated 3/21/77 with
Chicago and North Western Transportation Company for a crossing and
easement use of railroad right-of-way for Northeast Annexation Trunk
Sewer, Contract No. 188, for $75.00 preparation fee and $50.00
annual rental charge, and recommending approval, be received, placed
on file and "Resolution approving the License Agreement with Chicago
and North Western Transportation Company, authorizing Mayor and Clerk
to execute same and directing issuance of a warrant in payment thereof",
adopted. Ayes: Five. Absent: Lichty and Wilharm. Resolution a-
dopted and upon approval by Mayor, assigned No. 25031.
71612 - Moved by Dowie, seconded by Geiger that proposed Contract for Engin-
eering Services dated 3/21/77 with Schenk Engineering Company for
street design for paving extension of East San Marnan Drive, at an
estimated cost of $1,000, and City Engineer's recommendation for
approval, be received, placed on file and "Resolution approving the
Contract for Engineering Services with Schenk Engineering Company,
Waterloo, Iowa, for paving extension of East San Marnan Drive, and
directing execution of same by Mayor and Clerk", adopted. Ayes: Five.
Absent: Lichty and Wilharm. Resolution adopted and upon approval by
Mayor, assigned No. 25032.
71613 - Moved by Bowers, seconded by Dowie that construction plans for sani-
tary sewerage, storm sewer, and paving facilities serving Prairie
Meadow West Fourth Addition, together with Treatment Agreement Foimi
C 9/75 for Department of Environmental Quality, and City Engineer's
recommendation for approval with final acceptance of plans to be re-
viewed and accepted by said DEQ, be received, placed on file, recom-
mendations approved and Mayor and Clerk authorized to execute said
Agreement Form. Motion carried.

paving facilities serving Cloverdale Acres Replat No. 1, and City
Engineer's recommendation for approval, be received, placed on file

ance No. 2479, Zoning Ordinance, Part V, General Regulations, Section
2A-7, by adding Section M. Conditional Zoning, Thereto", be received,

71616 - Moved by Dowie, seconded by Bowers that "Resolution fixing a date for
public hearing on the adoption of An Ordinance to amend Ordinance No.
2479, Zoning Ordinance, Part V, General Regulations, Section 2A-7, by
adding Section M, Conditional Zoning, Thereto", be adopted. Ayes:

Development Administrator, transmitting proposed resolution for public
works funding and requesting authorization to submit an application
to the Economic Development Administrator, be received, placed on file,
authorization granted and "Resolution approving the submission of a
preapplication for federal assistance for the Northeast Annexation
Area Sanitary Trunk Sewer and authorizing the Mayor to execute the
preapplication as the authorized representative of the City of Water-

71618 - Moved by Dowie, seconded by Getty that the City Engineer be instructed
and authorized to prepare the plans and specifications, form of con-
tract and bond, form of proposal, estimate of cost, etc. for the 1977
Huntington Road Storm Sewer District Improvement Project, Contract No.
95. Motion carried.
71619 - Moved by Geiger, seconded by Getty that "Preliminary Resolution for
the construction of sewer improvements in the City of Waterloo, Iowa
(Huntington Road Storm Sewer District Improvement Project, Contract
No. 95)", be adopted. Ayes: Five. Absent: Lichty and Wilharm.
Resolution adopted and upon approval by Mayor, assigned No. 25035.
71620 - Moved by Geiger, seconded by Bowers that "Resolution fixing values
of lots for the Huntington Road Storm Sewer District Improvement
Project, Contract No. 95", be adopted. Ayes: Five. Absent: Lichty
and Wilharm. Resolution adopted and upon approval by Mayor, assigned
No. 25036.
71621 - Moved by Bowers, seconded by Roehr that the City Engineer's prelimin-
ary plans, specifications, estimate of cost, plats and schedule of
assessments, etc. for Huntington Road Storm Sewer District Improve-
ment Project, Contract No. 95, be received and placed on file. Motion
carried.
71622 - Moved by Geiger, seconded by Dowie that "Resolution adopting Prelim-
inary Plat and Schedule, Estimate of Cost and Proposed Plans and
Specifications for the construction of the "Waterloo, Iowa, Hunting-
ton Road Storm Sewer District Improvement Project, 1977 (Contract No.
95)",be adopted. Ayes: Five. Absent: Lichty and Wilharm. Reso-
lution adopted and upon approval by Mayor, assigned No. 25037.
71623 - Moved by Dowie, seconded by Geiger that "(Proposed) Resolution of
Necessity for the "Waterloo, Iowa, Huntington Road Storm Sewer
District Improvement Project, 1977 (Contract #95)", be adopted and
the date of hearing set as April 11, 1977 at 7:00 P.M. in the
Council Chambers in City Hall. Ayes: Five. Absent: Lichty and

gineer to prepare detailed plans and specifications and directing
Attorney to prepare form of contract and notice to bidders on the
"Waterloo, Iowa, Huntington Road Storm Sewer District Improvement
Project, 1977 (Contract #95)", be adopted. Ayes: Five. Absent:
