Mayor Rooff in the Chair. On roll call, Present: Bowers, Geiger, Getty, Lichty, Roehr, Wilharm. Absent: Dowie. Invocation by Councilman Getty. 71437 - Moved by Roehr, seconded by Wilharm for the Regular Session of February cepted and approved. Motion carried 71438 - Moved by Geiger, seconded by Bowers Session held February 14, 1977 at 7: carried. that the Agenda, as proposed, 22, 1977, at 7:00 P.M., be ac - that the Minutes of the Regular 00 P.M., be approved. Motion 71439 - The Traffic and Street Sign Department and the Finance Committee, having checked the bids for traffic paint and paint thinner, referred to them under Council Action #71389 of 2/14/77, recommended acceptance of the total bid of Vogel Paint and Wax Co., Inc. of Orange City, Iowa, both quality and price being taken into consideration. Moved by Getty, seconded received, placed on file, Co., Inc. of Orange City, traffic paint, $4.48 per $1.48 per gal. for xylol order authorized. Ayes: by Wilharm that the above recommendation be approved and the bid of Vogel Paint and Wax Iowa of $4.02 per gal. for white fast dry gal. for yellow fast dry traffic paint and thinner, accepted and issuance of purchase Six. Absent: Dowie. Motion carried. 71440 - Martin Culpepper, 1731 Cottage Grove Avenue, asked what procedure would be followed for making application for water in the Maywood Ad- dition. Mayor Rooff stated, (1) the City needs to receive approval of funds, (2) then, the City will send a person into the neighborhood to contact the people for their simple language commitment contracts to use the water when brought to the front of their homes, (3) there would be a time limit for signing couu«itment contracts, (4) the Council will let the contract; however, mains larger than 6" will be done by Waterworks, (5) the work will not be started until possibly the middle of May, and (6) if the City doesn't get the grant, then it cant put in the water. 71441 - Dwayne Eilers inquired as to what progress was being made on a raise for Council -persons and Mayor Rooff reported this would be in the pro- posed budget going to the Council, and the budget hearing would be held March 3, 1977 at 7:00 P.M. at Waterloo Recreation Center. 71442 - Kevin O'Connor reported many street traffic lights won't operate for small motorcycles and Mayor Rooff asked that he contact his office tomorrow so the City Electrician could be consulted. 71443 - Moved by Getty, seconded by Lichty that the following request for per- mission to attend a function, with expenses allowed not to exceed amount shown, be received, placed on file and approved: Three Sanitation personnel to Pesticide Applicators -Mosquito Control Program, Ames, Iowa, February 25, 1977, $53.00 with use of City car option. Ayes: Six. Absent: Dowie. Motion carried. 71444 - Mayor Rooff reported that on the Ellis Hotel Halfway House lawsuit, Judge Wild ruled the State Building Code would apply but the local authorities would administer and enforce the State Code, which was very similar to the City Code. City Attorney Smith stated the City has been granted seven days to amend its action against the Department of Court Services, and it would be amended as the State Building Code was being violated. 71445 - Moved by Bowers, seconded by Getty that minutes of Community Develop- ment Board for their regular meeting held January 11, 1977, be re- ceived and placed on file. Motion carried. 71446 - Under Council Action #71399 of 2/14/77 action was deferred on the request of Deere & Company for permission to connect the Product Engin- eering Center to the city sewer system. - 2 71446 - (Continued) City Attorney Smith stated in the annexation proceedings, Cedar Falls gave testimony that they could and they would provide sewer service to Deere & Company. Mayor Rooff reported the City officials would meet with the Department of Environmental Quality this coming week for commitments, then the Council could take action. He stated the Councils of Waterloo, Cedar Falls and Hudson have approved the con- cept of a metropolitan sewer system. INRCOG was working on this, that when DEQ sees this plan they would try to help all of us and their recommendation to the EPA federal people could be of great value in getting the deadline time limit extended. Bill Slade of Deere & Company said they need to meet the federal EPA deadline. Moved by Roehr, seconded by Wilharm that action on the above request be deferred. Ayes: Bowers, Geiger, Lichty, Roehr, Wilharm. Nay: Getty. Absent: Dowie. Motion carried. 71447 - Under Council Action #71393 of 2/14/77 action was deferred on the request for cancellation of 1976 oiling assessment levied against W 17.50 A SE SE Sec. 18 T 89 R 12 from The National Bank of Water- loo as the Trustee of the Lula DeWall Trust for the Benefit of Perry DeWall. Clyde L. Hoffman spoke in support of the cancellation. Moved by Bowers, seconded by Lichty that the above request be ap- proved and "Resolution cancelling the 1976 oiling assessments levied under Certificate No. 92-65-25941 in the amount of $422.39 and Certif- icate No. 92-65-25550 of $139.39", adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24984. 71448 - Under Council Action #71118 of 12/6/76, action was deferred on waiv- ing all special assessments against Lot 43, Sherwood Park, on which Black Hawk County holds title and sold at auction on 11/22/76. Moved by Roehr, seconded by Bowers that communication from Black Hawk County Board of Supervisors requesting action be taken on waiving special assessments in the amount of $368.19 with the City to receive $250.00, the proceeds from the sale, for Lot 43, Sherwood Park, be received, placed on file, special assessments waived sub- ject to all proceeds from the sale to come to the City of Waterloo. Ayes: Six. Absent: Dowie. Motion carried. 71449 - Moved by Wilharm, seconded by Getty that communication from City En- gineer, transmitting Right of Way Assurance Statement for Federal - Aid Projects required by Iowa Department of Transportation, and reco- mmending approval, be received, placed on file, approved and Mayor and City Clerk authorized and directed to execute same in behalf of the City of Waterloo. Motion carried. 71450 - Moved by Roehr, seconded by Bowers that Construction Permit No. 77- 217-0 for Northeast Annexation Trunk Sewer, Contract No. 188, from Iowa Department of Environmental Quality, subject to certain condit- ions and requirements, be received and placed on file. Motion car- ried. 71451 - Moved by Wilharm, seconded by Roehr that communication from City Attorney, transmitting a Mutual Release for Contract No. 142, and recommending execution, be received, placed on file and "Resolution approving and directing execution by the Mayor and City Clerk of a Mutual Release dated 2/16/77 between the City of Waterloo, Iowa and Merl F. Goerdt dba M. F. Goerdt Construction Company and J. F. Brennan Company, Inc. in connection with Construction of River Road, Stage I, Contract No. 142", adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24985. 71452 - Moved by Roehr, seconded by Lichty that couaiunication from Plan and Program Director transmitting a proposed resolution authorizing the Mayor to sign the "701" Comprehensive Planning Assistance Grant ap- plication and City agreeing to comply with regulations of the program as they pertain to equal opportunity and affirmative action, be re- ceived, placed on file and "Resolution approving the Fiscal Year 1978 HUD "701" Comprehensive Planning Assistance Grant and confirming the terms and conditions of said Grant", be adopted. - 3 71452 - (Continued) Ayes: Six. Resolution adopted and upon approval by Mayor, assigned No. 24986. 71453 - Moved by Bowers, seconded by Getty that "Resolution transferring from the Sewer Rental Fund the sum of One hundred fifty six thous- and dollars ($156,000.00) to the Debt Service Fund", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24987. 71454 - Moved by Roehr, seconded by Bowers that "Resolution transferring from the Road Use Tax Fund the sum of Two hundred sixty thousand thirty four dollars ($260,034.00) to the Debt Service Fund", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24988. 71455 - Moved by Dowie, seconded by Bowers that communication from City Electrical Department reporting the retirement of Kenney Fox, Super- intendent of Traffic Signals and City Electrician as of February 15, 1977 and entitlement to 642 days sick leave and three weeks vacation pay, be received, placed on file and "Resolution approving payment of $5,075.40 sick leave and vacation pay to Kenney Fox, Retiree as Superintendent of Traffic Signals and City Electrician", adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24989. 71456 - Moved by Bowers, seconded by Getty that the City Engineer be in- structed and authorized to prepare the plans and specifications, form of contract and bond, form of proposal, estimate of cost, etc. for the Guernsey's Orange View Sanitary Sewer, Contract No. 187. Motion carried. 71457 - Moved by Geiger, seconded by Lichty that "Preliminary Resolution for the construction of sewer improvements in the City of Waterloo, Iowa (Guernsey's Orange View Sanitary Sewer, Contract No. 187)", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24990. 71458 - Moved by Geiger, seconded by Lichty that "Resolution fixing values of lots for the Guernsey's Orange View Sanitary Sewer, Contract No. 187", be adopted. Resolution adopted and upon approval by Mayor, assigned No. 24991. 71459 - Moved by Geiger liminary plans, of assessments, Sanitary Sewer, Motion carried. , seconded by Lichty that the City Engineer's pre - specifications, estimate of cost, plats and schedule etc. for the construction of Guernsey's Orange View Contract No. 187, be received and placed on file. 71460 - Moved by Bowers, seconded by Geiger that "Resolution adopting prelim- inary plat and schedule, estimate of cost and proposed plans and specifications for the construction of the "Waterloo, Iowa - Guern- sey's Orange View Sanitary Sewer Improvement Project, 1977 (Contract #187)", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24992. 71461 - Moved by Getty, seconded by Geiger that "(Proposed) Resolution of Necessity for the "Waterloo, Iowa - Guernsey's Orange View Sanitary Sewer Improvement Project, 1977 (Contract No. 187)", be adopted and the date of hearing set as March 14, 1977 at 7:00 P.M. in the Council Chambers in City Hall. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24993. 71462 - Moved by Getty, seconded by Lichty that "Resolution directing Engineer to prepare detailed plans and specifications and directing Attorney to prepare form of contract and notice to bidders on the "Waterloo, Iowa - Guernsey's Orange View Sanitary Sewer Improvement Project, 1977 ( Contract #187)", be adopted. Ayes: Six. Absent: Dowie. Resolution adopted and upon approval by Mayor, assigned No. 24994. February 22, 1977 - 4 - 71463 - Moved by Wilharm, seconded by Lichty that City Engineer's detailed plans, specifications, form of contract, form of proposal, prelimin- ary estimate of cost, etc. and notice to bidders for the Guernsey Orange View Sanitary Sewer Improvement Project, Contract No. 187, be received, placed on file and "Resolution ordering bids, approving plans, specifications and form of contract and notice to bidders, fixing amount of bid security, and ordering Clerk to publish notice and fixing a date for receiving same, and for a public hearing on plans, specifications, form of contract and estimate of costs", adopted, with date set as March 14, 1977.
