71388 - The City Clerk reported that inadvertently the hearing was not held
on February 7, 1977 on the proposal to vacate, sell and convey all
East-West alley located between Ida Street and Courier Street,
subject to the retention of a utility easement, to Wendell Lockard
Construction Company and The Culligan Soft Water Service.
Moved by Roehr, seconded by Lichty that "Resolution fixing the time
and place of hearing as February 28, 1977 on proposal to vacate,
sell and convey certain real property to Wendell Lockard Construction
Company and The Culligan Soft Water Service", be adopted and Clerk
instructed to publish notice of hearing. Ayes: Six. Absent: Wil -

71390 - Animal Control Director Hoffman reported the Animal Control Ordinance
needed review to make it more enforceable and recommended some ad-
ditions and deletions be made.
Moved by Getty, seconded by Bowers that the above report and recom-
mendations be received, placed on file, approved and City Attorney
instructed to proceed accordingly. Motion carried.
71391 - Councilman Bowers reported on the problems with dog packs in the
Fourth Ward; there were two groups of people with conflicting in-

terest and Mr. Gillespie's group asked that action be deferred for
further study; that City licensing of kennels be studied but control
was provided through zoning; City has over 2,000 dogs and license
enforcement needed "beefing up". Mr. Gillespie supported delay of
action. Mayor Rooff stated a dog list has been requested of the
City Assessor and a study would be made by volunteers; the Humane
Society has increased their fee and interviewing prospective owners;
the citizens must keep their animals confined; the City now has
tranquilizer guns. A citizen pointed out, the people who complied
with the laws, would be the ones who would be taxed more if license
fees were increased.

placed on file and action deferred for further study. Motion carried.
71392 - Agnes Robertson suggested when city property was to be sold to the
highest bidder, that a news release be given the news media. Plan
and Program Director Franke will make the news release.
71393 - Mr. Hoffman objected to the oiling assessments levied on agricultural
land.
Mayor Rooff told the Council that in two weeks he would ask that the
street oiling program be stopped, unless petitioned by the property
owners.
Moved by Bowers, seconded by Lichty that the request of The National
Bank of Waterloo as the Trustee of the Lula DeWall Trust for the
Benefit of Perry DeWall for cancellation of 1976 oiling assessment
levied against W 17.50 A SE SE Sec. 18 T 89 R 12 in the total amount
of $561.78 due to no benefit being conferred on the agricultural
land as houses were located a great distance down Idaho Street from
the site of oiling, be received, placed on file, and action deferred
until February 22, 1977. Motion carried.
71394 - Moved by Getty, seconded by Roehr that counuunication from Plan and
Program Director, reporting the request of Mr. and Mrs. Henry Erd-
mann, 1117 Dearborn Street, to purchase Lot 2 of Auditor Barnes
Plat of Maywood, rejected under Council Action #71247 of 1/10/77,
has been further researched, a counter offer of $150.00 has been
made by said persons, and recommending favorable review, be received,
placed on file and "Resolution accepting the bid of Henry J. and
Bernice Erdmann, Waterloo, Iowa, in the total amount of $150.00 plus
costs, approving and authorizing the sale and conveyance of Lot 2
of Auditor Barnes Plat of Maywood, as published in the Notice of Pro-
posal to Dispose of Real Estate in Waterloo Courier on December 9,
1976, and directing and authorizing the Mayor and City Clerk to
execute and deliver a deed for said property", adopted. Ayes: Dowie,

71395 - Moved by Roehr, seconded by Geiger that the Financial Report of the
Board of Waterloo Water Works Trustees for the year ending December
31, 1976, be received and placed on file. Motion carried.
71396 - Moved by Dowie, seconded by Bowers that City Treasurer's Financial
Report for January, 1977, showing Balance on Hand on 1/1/77 $14,481,-
603.15, Receipts $2,198,393.01, Disbursements $2,365,171.87, Balance
on Hand 1/31/77 $14,314,824.29, be received and placed on file. Mo-
tion carried.
71397 - Moved by Roehr, seconded by Getty that communication from Finance
Director, transmitting 7th Entitlement Actual Use Report of General
Revenue Sharing for July 1, 1976 thru December 31, 1976, be received,
placed on file, approved and "Resolution directing the City Clerk
to publish the notice of Revenue Sharing Actual Use Report", adopted.

71398 - Under Council Action #71360 of 2/7/77 action was deferred on the
request of Black Hawk Council on Aging for $655.00 for an Elderly
Health Screening Project.
The question was raised if this money could come out of the community
block grant funds.
Moved by Getty, seconded by Dowie that the above request be approved
subject to finding the financial means to pay and Community Develop-
ment Administrator instructed to research the community block grant
requirements. Ayes: Six. Absent: Wilharm. Motion carried.
71399 - Under Council Action #71359 of 2/7/77 action was deferred on the
request of Deere & Company for permission to connect the Product
Engineering Center to the city sewer system.
Bill Slade and Dick Engels of Deere & Co. Engineering Department ex-
plained the State Department of Environmental Quality and federal
Environmental Protection Agency require the waste discharge be intro-
duced to the sanitary sewer by July 1, 1977, that this can be done
including provisions for necessary controls and holding facilities,
by starting immediately and going full speed with engineering and
construction. He stated this would be the most economic and favor-
able solution to the problem. A discussion followed on (1) Cedar
Falls, at time of annexation of this area made testimony that it would
service the area and Waterloo would be assuming the obligation of
Cedar Falls, (2) concern that Waterloo tax money would be used to
provide this service, (3) overload of Orange Grove lift station with
back up into homes, (4) Waterloo, Cedar Falls and Hudson mayors
approving the Metropolitan Comprehensive Plan, (5) problems if
federal government pulled out of program, (6) serving other undevel-
oped land in area.
Councilman Roehr cited various possible problems and spoke against
approval of request at this time.
Moved by Roehr, seconded by Lichty that action be deferred until
February 22, 1977 for further analysis. Ayes: Bowers, Dowie, Geiger,
Lichty, Roehr. Nay: Getty. Absent: Wilharm. Motion carried.
71400 - Moved by Roehr, seconded by Dowie that communication from Community
Development Administrator, transmitting a Grant Agreement for the
Urgent Needs funding of $546,856 for construction of Sans Souci
Bridges approaches, and recommending approval, be received, placed
on file and "Resolution approving and providing for the execution of
Housing and Community Development Block Grant Urgent Need Contract No.
B -77 -UR -19-0001 between the City of Waterloo, Iowa and the U. S. De-
partment of Housing and Urban Development", adopted. Ayes: Six.

Development Administrator, transmitting a proposed Engineering Ser-
vices Contract and recoumiending approval, be received, placed on file

City of Waterloo a contract for engineering services for the West
Side Parking Ramp Reconstruction with the Firm of Brice, Petrides &

71435 - Under Council Action #71357 of 2/7/77 the petition of Irving Elemen-
tary School and Parent groups for installation of a push button walk
light at West Ninth Street and Hawthorne Avenue and for a study on
(1) the possibility of no right turn on red at Williston Avenue and
West Ninth Street, (2) review of speed limit on West Ninth Street (3)
school crossing light at West Ninth Street and Hawthorne Avenue, was

Moved by Roehr, seconded by Dowie that the report of Quintin Parker
recommending (1) school traffic signal be installed as soon as the
equipment becomes available and weather permits, (2) right turns on
red be prohibited, and (3) speed limit on West Ninth Street not
be reduced as this is a through street with "no parking" on either
side, be received, placed on file, and recommendations approved.
