Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr. Absent: Wilharm. Invocation by Councilman Getty. 71351 - Moved by Dowie, seconded by Bowers that the Agenda, as amended, for the Regular Session of February 7, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 71352 - Moved by Roehr, seconded by Dowie that the Minutes of the Regular Session held January 24, 1977 at 7:00 P.M., be approved. Motion carried. 71353 - Vincent McCowen, 2713 Edgemont Avenue, representing the property owners of the 2600 and 2700 blocks of Edgemont Avenue and Highview Avenue, cited violations of City code and regulations made by the S & K Con- struction Company when it moved into 2710 Edgemont Avenue, and request- ed this business be removed at once. Building Official Parsons reported this firm was dissolved as of January 31, 1977, and Darwin Sweazey was conducting Bible Class three evenings and one during the day each week. City Attorney Smith re- ported the City code didn't prohibit the 60' antenna. Mayor Rooff commended this group for presenting their problem and listening to the city officials. Councilman Dowie presented a petition requesting discontinuance of the above business at 2710 Edgemont Avenue and removal of the aerial. Moved by Dowie, seconded by Roehr that the above presentation and petition be received and placed on file. Motion carried. 71354 - Several property owners in the 1400 block of Vine Street complained about the bad oiling job done this past summer. Councilman Bowers stated he had observed the poor oiling job and suggested the discon- tinuance of the program until the problems were solved. Mayor Rooff said this street would be reworked in the Spring. Inquiry was made as to paving and petitioning for same. 71355 - Councilman Bowers commended Mayor Rooff for stating the Council was responsible for the paving of Anthony, Plainview, Springview, Colo- rado Streets, etc. and giving credit to the Council and not the CCI group. 71356 - Agnes Robertson, 1030 Roosevelt Street, stated that after observing the last ten Council sessions, she recommended the Councilman salary of $1800.00 per year be increased to $2500.00, and also the Mayor should have an increase. Dwayne Eilers stated he had raised the question previously and asked for a $5,000 per year salary for each Councilman; also, that the Council consider voting on this next week. Mayor Rooff reported the Citizens Budget Committee would be making recommendations shortly for the Council Members and Department Heads. 71357 - Moved by Dowie, seconded by Geiger that communication from the Mayor's Safety Committee, transmitting the petition of Irving Elementary School and Parent groups for installation of a push button walk light at West Ninth Street and Hawthorne Avenue, and requesting a study be made by Quintin Parker of the Sign and Traffic Department, address- ing the following items, be received, placed on file, Quintin Parker instructed to proceed accordingly with a report back to the Council and said Committee: 1 - Possibility of no right Ninth Street; 2 - Review of speed limit on 3 - School crossing light at Motion carried. turn on red at Williston Avenue and West West Ninth Street; West Ninth Street and Hawthorne Avenue. - 2 - 71358- Moved by Roehr, seconded by Bowers that request of George Lindeman for Herbert G. Smith, et al, for the City of Waterloo to vacate, sell and convey a portion of Ralph Road, as shown on print and legally described in attached Exhibit "A", for 5C per square foot plus costs, and Plan and Program Commission's recommendation for approval with retention of a utility easement, be received, placed on file and "Resolution fixing the time and place of hearing on the proposal to vacate, sell and convey a portion of Ralph Road', adopted, date of hearing set as February 28, 1977 at 7:00 P.M. in the Council Chambers in City Hall and the Clerk instructed to publish notice of hearing. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24950. 71359 - Councilman Roehr reminded the Council that at the time Cedar Falls annexed the Deere & Company area, they said they would provide sewer service, and he questioned why Waterloo was being asked as this was Cedar Falls' obligation. Mayor Rooff stated the Metropolitan Sewer Study provided for Waterloo to service a portion of Cedar Falls, all of Hudson and Dewar, for a fee. Moved by Roehr, seconded by Dowie that communication from City Engin- eer, transmitting request of Deere & Company for permission to connect the Product Engineering Center to the city sewer system, and recom- mending approval pending final approval of plans and specifications, be received, placed on file and action deferred for one week to allow Deere officials to explain the short notice requesting Council action. Motion carried. 71360 - Moved by Dowie, seconded by Lichty that communication from Black Hawk County Council on Aging requesting $655.00 for an Elderly Health Screening Project, be received, placed on file and action deferred for one week. Motion carried. 71361 - Moved by Roehr, seconded by Geiger that request of J. S. Den Herder for permission to construct one 36' curb cut and approach at 116 Brookeridge Drive, Lot #55, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 71362 - Moved by Roehr, seconded by Dowie that communication from City Engin- eer, advising improvements required as a condition precedent to the final approval of the Deward Felcher Industrial Park (Phase I), have been completed in substantial conformance with construction plans, standards and requirements of his office, submitting four-year main- tenance bond for street and sewer improvements, and recommending acceptance, be received, placed on file, approved and accepted with effective date on said bond being February 7, 1977. Motion carried. 71363 - Moved by Geiger, seconded by Bowers that the report of the Sign and Traffic Department, with recommendation that "yield" signs on Maynard Street from Ansborough Avenue to Letsch Road be changed to "stop" signs, be received, placed on file, approved and City Attorney in- structed to submit an ordinance accordingly. Motion carried. 71364 - Moved by Bowers, seconded by Lichty that the report of the Sign and Traffic Department, with recommendation that Mobile Street be made a through street from the north side of Sumner Street to the south side of Newell Street, be received, placed on file, approved and City Attorney instructed to submit an ordinance accordingly. Motion carried. 71365 Moved by Dowie, seconded by Bowers that Preliminary Plat of Prairie Meadow West Fourth Addition with Deed of Dedication, Report of City Engineer, City Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file. and "Resolution approving the Preliminary Plat of Prairie Meadow West Fourth Addition in the City of Waterloo, Black Hawk County, Iowa", adopted, subject to agreement on street names. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24951. February 7, 1977 - 3 - 71366 - Moved by Roehr, seconded by Lichty that Preliminary Plat of Lockhaven Addition with Deed of Dedication, Report of City Engineer, City Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "Resolution approving the Preliminary Plat of Lockhaven Addition, Waterloo, Iowa", adopted. Resolution adopted and upon approval by Mayor, assigned No. 24952. 71367 - Moved by Dowie, seconded by Bowers that the three following Construct- ion Permits from the Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file: No. 77-206-5 for Sanitary Sewer Extension, Bond's Addition No. 77-205-5 for Sanitary Sewer Extension, Cloverdale Acres Replat No. 1 No. 77-201-S for Sanitary Sewer Extension, Prairie Meadow West Area Motion carried. 71368 - Moved by Getty, seconded by Lichty that communication from Personnel Director, transmitting the Agreement between the City of Waterloo, Iowa, and the Waterloo Policemen's Protective Association for con- tract years 1977-1978 and 1978-1979, be received, placed on file and "Resolution approving an Agreement with the Waterloo Policemen's Protective Association for contract years 1977-1978 and 1978-1979 and authorizing the Mayor to sign and execute same in behalf of the City of Waterloo, Iowa", adopted. Resolu- tion adopted and upon approval by Mayor, assigned No. 24953. 71369 - Moved by Roehr, seconded by Bowers that communication from Community Development Administrator, transmitting copy of a Permanent Easement Agreement dated 2/2/77 from Donald E. Buehler and Coyla E. Buehler for 1524 Black Hawk Road for the sum of $150.00, and recoumiending approval, be received, placed on file and "A resolution authorizing the execution of a Permanent Easement Agreement with Donald E. Buehler and Coyla E. Buehler of the City of Waterloo, Iowa in connection with the Huntington Road Storm Sewer Project", adopted. Ayes: Six. Absent: Wilharm. Prentice for 4505 Hess Road for the sum of $10.00, and recommending approval, be received, placed on file and "A resolution authorizing the execution of a Temporary and Permanent Easement Agreement with Mary E. Prentice of the City of Waterloo, Iowa in connection with the Orange View Sanitary Sewer Project", adopted. Ayes: Six. Absent: Wilharm. Heggebo for 1414 Huntington Road for the sum of $700.00, and recommending approval, be received, placed on file and "A resolution authorizing the execution of a Temporary and Permanent Easement Agreement with Theodore M. Downs and Nancy Downs for 1419 Garden Avenue for the sum of $50.00, and recommending approval, be received, placed on file and "A resolution authorizing the execution of a Temporary and Permanent Easement Agreement with Monroe W. Miller Trust for Hess Road and Shaulis Road for the sum of $400.00, and recommending approval, be received, placed on file and "A resolution authorizing the execution of a Temporary and Permanent Easement Agreement with the Reuben J. Miller Trust, the Waterloo Savings Bank, Trustee of the City of Waterloo, Iowa in connection with the Orange View Sanitary Sewer Project", adopted. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24958. 71374 - Moved by Dowie, seconded by Roehr that "A resolution transferring from the Federal Revenue Sharing Fund the sum of Two hundred eight - one thousand four hundred forty two dollars ($281,442.00) to the General Fund", be adopted. Resolu- tion adopted and upon approval by Mayor, assigned No. 24959. 71375 - Moved by Bowers, seconded by Dowie that Estimate #7 Report for Minor Contract No. 91, with City Engineer's recommendation for approval, be received, placed on file and "Resolution approving Report #7 for work and materials furnished by John G. Miller Construction Com- pany for the Fourth Street Bridge Walkway Canopy, Minor Contract No. 91, and authorizing payment accordingly", adopted. Ayes: Six. Ab- sent: Wilharm. Resolution adopted and upon approval by Mayor, as- signed No. 24960. 71376 - Moved by Roehr, seconded by Lichty that communication from Street Superintendent reporting retirement of Earl Showers as of January 20, 1977 from the Street Department, and entitlement to 252.5 hours of sick leave pay, be received, placed on file and "Resolution ap- proving payment of $1,217.05 sick leave pay to Earl Showers, Retiree of Street Department", adopted.
