Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr. Absent: Wilharm. Invocation by State Auditor Lloyd R. Smith. 71279 - Moved by Roehr, seconded by Dowie that the Agenda, as proposed, for the Regular Session of January 17, 1977 at 7:00 P.M., be accepted and approved. Motion carried. 71280 - Moved by Bowers, seconded by Roehr that the Minutes of the Regular Session held January 10, 1977 at 7:00 P.M., be approved. Motion car- ried. 71281 - State Auditor Lloyd R. Smith presented the 1976 audit reports for the Waterloo Waterworks, Municipal Airport, McElroy Auditorium, Conway Civic Center, and Comprehensive Planning Assistance Program, together with comments and recommiendations on each. He pointed out the purchase of farm machinery by the Airport without following bid- ding procedure and certain travel advances, which were not proper disbursements. He said the Conway Civic Center audit revealed the payment to Manager Steely for customer dinners and refreshments which was an unlawful expenditure from public funds. Moved by Getty, seconded by Bowers that the above 1976 audit reports be received, placed on file and State Auditor Smith thanked for his review of same. Motion carried. 71282 - Judy Geisen, Waterloo -Cedar Falls-Evansdale Metro Area Task Force chairman, presented the Clean Community System Program of the Nation- al Keep America Beautiful, Inc. and showed a 13 -minute film. She stressed increasing the public's awareness of litter, changing public attitudes, education through service clubs, churches, schools, busi- ness participation and asked for a vote of confidence, and financing of $3,000 to $5,000 plus the salary of a project coordinator, to be shared by the three cities. Mayor Rooff said CETA federal funds might be available for the co- ordinator as this program could help reduce vandalism in municipal parks, and strongly recommended this program be made official. Ev Fahr of Fahr Beverage, Inc. spoke in support and said business help and dollars were available. Donna Coyle of the Green Scene committee said $5,000 of block grant funds was to be allocated for trees and offered their help. Moved by Getty, seconded by Geiger that the above presentation be received, placed on file and the City of Waterloo proceed with, and support, this program. Motion carried. 71283 - Upon question, Asst. City Attorney stated the Attorney General's transcript on Corner Pocket Billiard Lounge had not been filed. Moved by Roehr, seconded by Bowers that action on the Class C Beer and Liquor and Sunday Sales applications of Billiards Pocket Lounge, Inc. dba Corner Pocket Billiard Lounge, 3295 University Avenue, be further deferred for thirty days. Ayes: Bowers, Geiger, Roehr. Nay: Dowie, Getty, Lichty. Absent: Wilharm. Motion not carried. 71284 - Moved by Dowie, seconded by Getty that action on the above applica- tions be deferred for one week. Ayes: Bowers, Dowie, Geiger, Getty, Roehr. Nay: Lichty. Absent: Wilharm. Motion carried. 71285 - Councilman Getty reported the Zoning Commission adjourned its meet- ing today for lack of a quorum and suggested members be appointed who could be expected to attend the monthly meetings. Mayor Rooff said a special meeting would be scheduled for Monday to conduct business and attendance would be discussed. Councilman Roehr stated the Plan and Program Commission was having similar problems and some of those members should be jogged to make regular appearances. - 2 - 71286 - Moved by Dowie, seconded by Getty that the offer of Paul C. Stone to purchase Disposal Parcel No. F -6B in Westfield -Virden Urban Re- newal Area, Project Iowa R-7 (Falls Avenue), for the sum of $70,800 for office and warehouse purposes, and approval report of Community Development Board, be received, placed on file, "A resolution author- izing the sale of Disposal Parcel No. F -6B in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7", adopted and hearing set for February 28, 1977 at 7:00 P.M. in Council Chambers in City Hall. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No, 24936. 71287 - Moved by Bowers, seconded by Getty that City Treasurer's Financial Report for December, 1976, showing Balance on Hand 12/1/76 $14,445,- 844.24, Receipts $2,303,048.72, Disbursements $2,267,289.81, Balance on Hand 12/31/76 $14,481,603.15, be received, placed on file and ap- proved. Motion carried. 71288 - Moved by Roehr, seconded by Getty that communication from City Engin- eer, advising improvements required as a condition precedent to the final approval of Southdale Addition (Phase I), have been completed in substantial conformance with the construction plans, standards, and requirements of his office, submitting four-year street improve- ments and two-year sewer improvements maintenance bonds, and recom- mending acceptance, be received, placed on file, approved and accepted with effective dates on said bonds being January 17, 1977. Motion carried. 71289 - Moved by Roehr, seconded by Dowie that communication from City Engin- eer, advising improvements required as a condition precedent to the final approval of South Ridge Terrace Addition, have been completed in substantial conformance with construction plans, standards and requirements of his office, submitting four-year street improvements and two-year sewer improvements maintenance bonds, and recommending acceptance, be received, placed on file, approved and accepted with effective dates on said bonds being January 17,. 1977. Motion carried. 71290 - Moved by Getty, seconded by Lichty that communication from City Engin- eer, advising improvements required as a condition precedent to the final approval of Hammond Hills Third Addition, have been completed in substantial conformance with construction plans, standards and re- quirements of his office, submitting four-year street improvements and two-year sewer improvements maintenance bonds, and recommending acceptance, be received, placed on file, approved and accepted with effective dates on said bonds being January 17, 1977. Motion carried. 71291 - Moved by Dowie, seconded by Bowers that communication from City Engin- eer, advising improvements required as a condition precedent to the final approval of Prairie Meadow West Third Addition, have been com- pleted in substantial conformance with construction plans, standards and requirements of his office, submitting four-year street improve- ments and two-year sewer improvements maintenance bonds, and recom- mending acceptance, be received, placed on file, approved and accept- ed with effective dates on said bonds being January 17, 1977. Motion carried. 71292 - Moved by Bowers, seconded by Getty that communication from Cot unity Development Administrator, transmitting Seventh Amendatory Contract and recommending approval, be received, placed on file and "Resolu- tion approving and providing for the execution of a Seventh Amenda- tory Contract Amending Loan and Capital Grant Contract No. Iowa R-7 (LG) By and Between the City of Waterloo, Iowa, and the United States of America", adopted. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24937. 71293 - Moved by Dowie, seconded by Roehr that construction plans for the Sanitary Sewerage Facilities serving Tract B-3, Prairie Meadow West Addition and Lots 59-62, Prairie Meadow West Fourth Addition, together with Treatment Agreement Form C 9/75 for Department of Environmental Quality, and City Engineer's recommendation for approval with final acceptance of plans to be reviewed and accepted by said Department; January 17, 1977 - 3 71293 - (Continued) be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 71294 - Moved by Roehr, seconded by Bowers that communication from Waterloo Water Works recommending that a charge of $7.00 per quarter be es- tablished as appropriate standard quarterly billing for all accounts using City sewer facilities but not Waterloo Water Works water, with current billing to be included on water statements, be received, placed on file and approved. Motion carried. 71295 - Moved by Bowers, seconded by Dowie that the communication from City Engineer recommending (1) the changing of one block of Commercial Street from one-way traffic, West bound, to two-way traffic between West Mullan Avenue and West First Street, and (2) the Traffic and Sign Department be authorized to mark and sign a double left -turn movement from Commercial Street to West Mullan Avenue and West First Street under Section 195, Paragraph 6., of Traffic Ordinance, be re- ceived, placed on file, approved and City Attorney instructed to submit an ordinance accordingly. Motion carried. 71296 - Moved by Dowie, seconded by Roehr that City Engineer's Certification of Completion, Breakdown of Costs, etc., be received and placed on file. Motion carried. 71297 - Moved by Geiger, seconded by Lichty that "Resolution accepting work and ordering preparation of plat and schedule of assessments for the 1976 Oiling Program", be adopted. Ayes: Six. Absent: Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24938. 71298 - Moved by Getty, seconded by Lichty that the Engineer's Final Plat and Schedule of Assessments, etc. for the 1976 Oiling Program, be received and placed on file. Motion carried. 71299 - Moved by Bowers, seconded by Geiger that "Resolution adopting and levying final schedule of assessments, and providing for the payment thereof", be adopted, Ayes: Six. Absent: WilhaLin. Resolution adopted and upon approval by Mayor, assigned No. 24939. 71300 - Moved by Lichty, seconded by Geiger that following requests for per- mission to attend functions, with expenses allowed not to exceed amount shown, be received, placed on file and approved: Council Finance Committee Chairman and the City Treasurer to 71st Annual Municipal Finance Officers Association International Conference on Public Finance, Atlanta, Georgia, April 16 thru 21, 1977, $575.00 and $570.00 respectively. Ayes: Six. Absent: Wilharm. Motion carried. 71305 - Moved by Geiger, seconded by Bowers that the following applications and bonds for renewal of City Permits to operate Mobile Home Parks at designated locations, be received, placed on file and approved: John J.
