Mayor Bernard L. McKinley in the Chair. Roll call: Budak, Seeber, Lichty, Wright, Angel, and Miller. Absent: Dowie. Invocation by: Reverend Elick Patterson of Pilgrim's Rest Baptist Church. Pledge of Allegiance: Daisy Troop No. 56 - Lucinda Mitchell, Jenna Harang, and Laurie Wentz. 90033 - Moved by Wright, seconded by Angel that the Agenda, as amended, for the Regular Session of February 23, 1987, at 7:00 p.m., be accepted and approved. Motion carried. 90034 - Moved by Wright, seconded by Angel that the Minutes of the Regular Session held February 16, 1987 at 7:00 p.m. be approved. Motion carried. ORAL PRESENTATIONS 90035 - Mayor McKinley presented Bob Stevenson, City Planner, a Certificate of Award for the high quality of portland cement concrete municipal paving used on behalf of the San Marnan Drive Project by the Iowa Concrete Paving Association. Robert Mills, representing the Apartment Association, spoke to the Council and requested that the Mayor and Council change sections of the Ordinance relating to the certification of delinquent sewer and garbage fees to the property taxes. Mills continued that he had a copy of a letter from the Water Works Board supporting the Apartment Association's recommendation. Mayor McKinley stated that he would be in favor of the Water Works Board shutting off the water service to a rental property if the sewer and garbage portion of the bill was not paid. Hugh Field, City Attorney, stated that Section 384.84 of the Iowa State Code requires that charges be assessed to the property. Mr. Field continued that there would be a possibility that the Water Works could collect a deposit for the payment of garbage and sewer but if that was done, it would have to be on a uniform basis to where not only tenants pay the deposit, but everyone signing up for the service would have to pay the deposit. Clayton Bronson, a city landlord, stated that he had received notification of a potential bill of $654 from the City Clerk/Auditor's Office. He stated that these bills were City bills and not his responsibility for collection. Paul Cole, a real estate broker within the community, asked if the City could not refer the uncollected sewer and garbage bills to the Credit Bureau instead of assessment on the property.
