Piburn, Jr., for property located at 919 East Donald Street in conjunction with the East Donald Street Reconstruction Project IX -6662(2)--79-07", be tabled for one week. Motion carried. 90140 - Moved by Budak, seconded by Angel that "Resolution establishing a fee for fingerprinting of individuals for non -law enforcement reasons", be adopted. Ayes: Six. Absent: Miller. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1987-106. 90141 - The recommendation of the Buildings and Grounds Committee to release liens in the amount of $10,000 for property formerly occupied by the Ellis Hotel for the expansion of Sibert's-Unique Cleaners was brought to the table for discussion. Councilperson Lichty indicated that the City had more money than $10,000 involved in this property. In addition to the investment of the Waterloo Industrial Development Association of $27,500, the City's revenue sharing in the amount of $10,000, and the Community Development Funds in the amount of $22,500, the City Street Department was involved in the removal of the rubble from the site with manpower and equipment totalling $160,000. Moved by Lichty, seconded by Wright that an amendment be added to the Resolution cancelling liens in the amount of $10,000 for property located at East Fifth and Sycamore Streets to require Sibert's to develop the site within two (2) years, or the developer would be responsible for the payment of the liens. Prior to a vote on this amendment, the following comments were heard. Richard Ludwig, 710 Perry Street, Dubuque, Iowa, reiterated Sibert's-Unique development proposal for the site as related to the Buildings and Grounds Committee on March 9, 1987. He indicated that the company did not intend to build on this site for at least one year; however, the company is committed to the City of Waterloo and intends to expand at this location. In response to a question from Mayor Pro Tern Seeber, Mr. Ludwig indicated that the two-year requirement would make it extremely difficult to go ahead with the project. Mr. Ludwig also offered the company's intent to buy Foxy's and remove this dilapidated structure. Mitzi Reckward, Lockhard Realty, reported that the City would realize $15,000 as payment on the property taxes against said property if the property is sold. She also reported that foreclosure proceedings have begun and if the sale is not consummated, foreclosure proceedings would remove all liens from the property. Councilpersons Lichty and Wright withdrew their amendment. Community Development Administrator Jim Lindsey reported that the demolition of the Ellis Hotel site was an eligible block grant activity (removal of blighted structures). Deputy Clerk/Auditor Michelle Temeyer read a letter submitted by Councilperson Miller supporting the Sibert's-Unique Cleaners request. They felt that one form was sufficient. Mr. Sueppel indicated that the ordinance would be amended to reflect a change. They also objected to Section 23-27 which item that he or she has pawned any time excluding Sundays and legal holidays. Mr. Sueppel clarified this section by reporting that goods and merchandise shall not be stored or continuously displayed on any public street, alley or public parking. Carol Ennenja, owner of the Corner Variety, 1304 Lafayette Street, objected to listing all items she buys for resale. Alan Levi, 304 East 4th Street, thanked Assistant City Attorney Bill Sueppel for his spirit of cooperation in working with concerned citizens on the Pawn Shop Ordinance. He stressed the importance of working together so that everyone can work within the confines of the ordinance. Gene Geiger, 1110 Randolph Street, reported that the proposed ordinance was an attempt to put in writing the current practices of the pawn shop business. Mr. Sueppel indicated his willingness to speak with anyone in his office concerning the proposed ordinance. He also clarified that flea markets are exempt from the ordinance provision. It was suggested by the Council that anyone having concerns on the proposed ordinance to contact Mr. Sueppel within the next week. There were also questions raised concerning whether or not jewelry stores are covered by the ordinance since some do purchase diamonds frau secondhand stores.
