She continued that there legal counsel has given the opinion that the information would be legal which is contrary to the opinion of City Attorney Hugh Field. Tim Yeager of 222 Irving stated that he is a citizen of Waterloo and is a customer of IPS. Mr. Yeager took exception to Mr. Field's opinion regarding the legality of the information. Mayor McKinley stated that he has every intention of obtaining the information prior to the 1989 franchise election with IPS. He stated that he feels the citizens of Waterloo need to be informed about all aspects of the operation of IPS prior to taking a vote on the franchise. City Attorney Hugh Field stated that he had not said that the request was illegal, but in his opinion the Council was not entitled to the information from IPS. Ruth Anderson of 1503 Newell Street stated that she had a misunderstanding of why the resolution was not placed on the agenda between the Mayor and the City Clerk/Auditor. Mayor McKinley stated that he has requested the information from Tom Watt of IPS and IPS has declined to provide that information to him. Tim Yeager of 222 Irving stated that the Mayor should place the resolution as proposed by AMP on the Council agenda so that he can ask for the information in an official capacity. John York of 309 Courtland stated that the City is putting up a roadblock for the citizens of Waterloo who wish to have a clear picture of the decision on granting IPS a new franchise prior to the vote. He continued that he would think that the Mayor and Council would want to work closer with the citizens of the community. Councilperson Wright stated that she was absent on July 13 and was unclear on what the people were requesting. Mayor McKinley explained to Councilperson Wright that the people were asking for information that City Attorney Hugh Field said would not have to be available unless IPS wished to divulge said information. Kathy Oberle of 710 Forest Avenue stated that she would advise the Mayor to move quickly to obtain the information that is needed for the upcoming election. Chuck Adams of 3720 Village Place stated that he was concerned that IPS was controlling the industries looking at locating in the community. He stated that he would like to see the information because he feels that IPS is taking money out of his pocket without having authorization. Adams continued that there is a 40 percent difference in electrical rates between Waterloo and Cedar Falls. Mayor McKinley stated that the issue before the Council tonight was regarding whether the City Council should request the information from IPS. McKinley stated that Cedar Falls started with a municipal utility back when it was very reasonable to do so.
