Motion carried. 91026 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Wright, seconded by Lichty that "Resolution authorizing the sale and conveyance of a parcel of property located east of Jackson Street and north of Merriman Street to Union Missionary Baptist Church", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. Resolution adopted and upon approval by Mayor assigned No. 1987-525. 91027 - Moved by Miller, seconded by Wright that proof of publication of notice of public hearing on the application of the Waterloo Housing Authority to the U.S. Department of Housing and Urban Development for an additional twenty-one (21) units under Section 8 Rental Rehabilitation Housing Voucher Program as published in the Waterloo Courier on September 9, 1987, be received and placed on file. Motion carried. 91028 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Wright, seconded by Angel that "Resolution approving said application submission", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1987-526. 91029 - ORAL PRESENTATIONS Chuck Walter, 725 Stephan, stated that he was still having problems regarding the Stephen Street reconstruction project. Walter stated that the contractor lowered the street and also lowered the storm sewer in the street. He continued that presently the storm sewer outlet is on a higher grade than his driveway, thus causing a puddling situation at the end of his driveway. Councilperson Angel stated that she had visited the area and that Mr. Walter is partially correct regarding the storm sewer being at a higher grade than his driveway. Walter asked again how many days of wet weather was there to not allow the contractor in the area to work on the project. Eric Thorson, City Engineer, stated that they had reviewed the contract and there were seventeen (17) wet days during the life of the contract. September 28, 1987 Page 3 Gary Schmitz of 732 Stephan stated that he could not understand the timeframe in which the present contractor on the job was working in. He stated that work was not being completed during the days that he felt were dry enough to work. Schmitz continued that he felt that there was lack of communication between the Engineering Office and the contractor on the job and that he has seen little cooperation with the personnel in charge of the project. Eric Thorson, City Engineer, stated that inspectors had been out on the job almost on a daily basis and that he would review some of the complaints that are being voiced first thing Tuesday morning. Jack McDowell, Chairman of the Waterloo Walking Weekend Committee presented a map showing the three different routes for the designated Waterloo Walking Weekend to be held October 17 and 18. McDowell continued that all three routes will begin at the Recreation Center, cover approximately 107 points of interests from past, present and future, and will be held both Saturday and Sunday. McDowell stated that he felt this could generate other interest in other areas of the community that the City could expand into other walking weekends. PETITIONS FROM PUBLIC 91030 - Moved by Dowie, seconded by Angel that communication from City Engineer transmitting request of Thomas L. Siglin, 833 Kingsley Avenue, for temporary concrete driveway to be located on Drexel Avenue without regard to sidewalk grade, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1987-527. 91031 Moved by Dowie, seconded by Angel that communication from City Engineer transmitting request of Dennis D. Reiners for temporary concrete driveway to be located at 95 Joy Drive without regard to sidewalk grade, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. Prior to the vote, City Attorney Hugh Field stated that this was no more than any other Memorandum that the City has passed for other businesses in the community and that there is no commitment on the City's behalf, and no liability for repayment by the City but the liability is on the company and their performance. Councilperson Lichty stated that she is not opposed to jobs in the community but questioned the amount of money that needed to be spent to attract the Albert Trostel & Sons Company to the community, such as $200,000.00 in economic development, $200,000.00 in community development funds, $500,000.00 in sewer improvements, and $500,000.00 in job training. Attorney Field stated that the $8 million requested for Industrial Revenue Bonds again has no liability for the City. Councilperson Lichty questioned a portion of the Memorandum of Agreement regarding the terminology of leasing the property and also questioned the section that relates to allowing Albert Trostel & Sons to develop the property within three years. Attorney Field stated that the language in the document is the same language that has appeared in many of the Memorandum of Agreements that have come before the City Council in the past. Field continued that the attorneys for Albert Trostel & Sons had requested a copy of documents that have been used in the past so that he could develop his documents on those examples. Councilperson Seeber questioned whether these bonds that were to be sold were tax free and also questioned whether the City had any liability for the repayment of said bonds. Attorney Field stated that the City had absolutely no liability for the retirement of the bonds or interests for the Industrial Revenue Bonds that were before the Council this evening. Kathy Oberle, 710 Forest Avenue, stated that her understanding is that the $8 million requested in the Memorandum of Agreement was for Phase I and there could possibly be Phase II and Phase III. Oberle questioned whether the Company could return for additional revenue bonds in the future. Attorney Field stated that the state law allows a City to authorize up to $10 million per bond issue for a company. Fields continued that the law allows $40 million per company for the life of the company. Councilperson Miller stated that his understanding is that Industrial Revenue Bonds are meant to be an avenue to allow lower interest rates for the company in a development project. Mayor McKinley stated that the Board of Directors of Albert Trostel & Sons Company will be making a decision on October 15, 1987 regarding the site selection for their new facility. McKinley continued that Waterloo was still in the running with two other communities in the nation. McKinley continued that Councilperson Lichty has stated in the past that she is not against jobs in the community but has consistently voted against jobs for the past two years. Councilperson Lichty stated that she is aware of at least fifteen businesses that have been turned down for economic aid in the past. Mayor McKinley stated that he would like Councilperson Lichty to be more specific on which businesses were turned down for economic aid. Roll call was taken on the above Resolution. Ayes: Six.
