portion of former Greenwood Avenue lying southerly of and adjacent to the
property at 166 Greenwood Avenue as published in the Waterloo Courier on
November 27, 1987 be received and placed on file.

ORAL PRESENTATIONS
91363 - Diane Gibson, 3904 Oak Park Circle, stated that while on her way home from the
Waterloo Symphony on December 11, 1987 at 11:20 p.m., she was stopped by a
Waterloo Police Officer and ticketed for failure to wear her seat belt. Gibson
continued that upon refusal to sign the ticket, she was subsequently arrested
and placed in the Black Hawk County Jail for the night. Gibson stated that she
felt that if the Waterloo Police Department was in the process of cracking down
on violators of the Iowa Seat Belt Law that the public should be so informed
prior to the crackdown. Ms. Gibson continued that she also disagreed with
being arrested for a simple misdemeanor. She continued that instead of an
arrest the officers should call witnesses to verify that the violator would not
sign the ticket that that would be adequate for a simple misdemeanor.

Ordinances to Be Adopted - continued
Councilperson Seeber stated that in his opinion the Seat Belt Law is the same
as any other law, if you violate it and are stopped, you should be given a
summons.
Police Chief Roger Shook stated that the grant that was authorized by the State
was for the use in high traffic problem areas and that is the reason why the
University Avenue area was chosen for the increased patrolling.
Councilperson Lichty questioned why only seat belt violators were being stopped
on University Avenue and not other violators.
Chief Shook stated that all types of traffic laws were being enforced on
University Avenue and not just seat belt violations.
Moved by Seeber, seconded by Dowie
that "an Ordinance amending the Traffic Code of the City of Waterloo by adding
Section 491, Safety Belts and Safety Harnesses --Use Required, and Section 493,
Child Restraint Devices", be received, placed on file, passed and considered
for the first time. Ayes: Dowie, Seeber. Nays: Miller, Lichty. Absent:
Budak, Angel, Wright.

TRAVEL REQUESTS
